أَخْبَرَنَا أَبُو الْقَاسِمِ عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ الْعَطَّارُ، بِبَغْدَادَ، ثنا أَحْمَدُ بْنُ سَلْمَانَ الْفَقِيهُ، ثنا عَبْدُ الْمَلِكِ بْنُ مُحَمَّدٍ، ثنا مُعَلَّى بْنُ أَسَدٍ، ثنا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ، ثنا مُجَالِدُ بْنُ سَعِيدٍ، حَدَّثَنِي الشَّعْبِيُّ، عَنْ جَابِرِ بْنِ عَبْدِ اللهِ، أَنَّ امْرَأَتَيْنِ، مِنْ هُذَيْلٍ قَتَلَتْ إِحْدَاهُمَا الْأُخْرَى، وَلِكُلِّ وَاحِدَةٍ مِنْهُمَا زَوْجٌ وَوَلَدٌ، فَجَعَلَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: دِيَةَ الْمَقْتُولَةِ عَلَى عَاقِلَةِ الْمَرْأَةِ الْقَاتِلَةِ، وَبَرَّأَ زَوْجَهَا وَوَلَدَهَا، فَقَالَتْ عَاقِلَةُ الْمَقْتُولَةِ: مِيرَاثُهَا لَنَا، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " مِيرَاثُهَا لِزَوْجِهَا وَوَلَدِهَا " وَكَانَتْ حُبْلَى فَأَلْقَتْ جَنِينَهَا، فَخَافَتْ عَاقِلَةُ الْقَاتِلَةِ أَنْ يُضَمِّنَهُمْ، فَقَالُوا: يَا رَسُولَ اللهِ، لَا شَرِبَ، وَلَا أَكَلَ، وَلَا صَاحَ فَاسْتَهَلَّ، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " هَذَا سَجْعُ الْجَاهِلِيَّةِ " فَقَضَى، فِي الْجَنِينِ غُرَّةٌ: عَبْدٌ أَوْ أَمَةٌ،.
Sayyiduna Jabir (may Allah be pleased with him) says that two women of Hudhayl fought with each other and one of them killed the other. Each of them had a husband and a son. So the Prophet (peace and blessings be upon him) placed the blood money (diyah) of the slain woman upon the paternal kin ('asabah) of the woman who killed her, and he declared her husband and son free of it. The 'aqilah (paternal kin) of the slain woman said: "Her inheritance will come to us." So he (peace and blessings be upon him) said: "Her inheritance belongs to her husband and son." That slain woman was pregnant, and her child also miscarried. The paternal kin of the killer feared that they would have to pay blood money for it as well, so they said: "It neither ate, nor drank, nor spoke, nor cried out." So he (peace and blessings be upon him) said: "These are the words of the Jahiliyyah." Then he (peace and blessings be upon him) ruled that a male or female slave be given for that child as well.
