أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ، ثنا بَحْرُ بْنُ نَصْرٍ، ثنا عَبْدُ اللهِ بْنُ وَهْبٍ، أَخْبَرَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ أَنَّهُ قَالَ فِي رَجُلٍ قَدَرَ عَلَى قَاتِلِ أَخِيهِ: أَعَلَيْهِ حَرَجٌ فِيمَا بَيْنَهُ وَبَيْنَ اللهِ إِنْ خَافَ أَنْ يَفُوتَهُ قَبْلَ أَنْ يَبْلُغَ بِهِ إِلَى الْإِمَامِ، إِنْ هُوَ قَتَلَهُ؟ قَالَ ابْنُ شِهَابٍ: مَضَتِ السُّنَّةُ أَنْ لَا يُغْتَصَبَ فِي قَتْلِ النُّفُوسِ دُونَ الْإِمَامِ وَرُوِّينَا فِي حَدِيثِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ، فِي الَّتِي وُطِئَتْ مُسْتَكْرَهَةً، حَيْثُ كَتَبَ إِلَى الْآفَاقِ: أَنْ لَا تَقْتُلُوا أَحَدًا إِلَّا بِإِذْنِي.
Ibn Shihab (may Allah have mercy on him) said concerning a man who seizes his brother's killer and takes retaliation from him before bringing him to the imam: The Sunnah is that, in the killing of souls, no one may take matters into his own hands without the order of the imam.
It has also been narrated to us from Sayyiduna Umar (may Allah be pleased with him) that he wrote to his governors that no one is to be killed without his order.
