وَقَدْ أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثنا عَبَّاسُ بْنُ مُحَمَّدٍ الدُّورِيُّ، ثنا سَعِيدُ بْنُ سُلَيْمَانَ، ثنا سُلَيْمَانُ بْنُ كَثِيرٍ، ثنا عَمْرُو بْنُ دِينَارٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " مَنْ قُتِلَ فِي عِمِّيَّا أَوْ رِمِّيَّا تَكُونُ بَيْنَهُمْ بِحَجَرٍ أَوْ بِعَصًا فَعَقْلُهُ عَقْلُ خَطَأٍ، وَمَنْ قُتِلَ عَمْدًا فَقَوَدُ يَدَيْهِ، فَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ، لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ " قَوْلُهُ: فَعَقْلُهُ عَقْلُ خَطَأٍ يُرِيدُ بِهِ وَاللهُ أَعْلَمُ شِبْهَ الْخَطَأِ، وَهُوَ شِبْهُ الْعَمْدِ وَقَوْلُهُ: فَهُوَ خَطَأٌ يُرِيدُ بِهِ شِبْهَ خَطَأٍ، حَتَّى لَا يَجِبَ بِهِ الْقَوَدُ، وَقَدْ يُحْتَمَلُ أَنْ يَكُونَ الْمُرَادُ بِهِ الْخَطَأَ الْمَحْضَ، وَذَلِكَ أَنْ يَرْمِيَ شَيْئًا فَيُصِيبَ غَيْرَهُ فَيَكُونَ عَقْلُهُ عَقْلَ الْخَطَأِ، وَاللهُ أَعْلَمُ.
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said: "Whoever is killed by mistake, that is, an arrow strikes him by mistake, or he dies from a whip or a stick, that is accidental killing and there is diyah for it. Whoever kills deliberately, there is retaliation for it. And whoever stands in the way of the prescribed punishments, upon him is the curse of Allah, the angels and all the people, and none of his deeds, obligatory or voluntary, will be accepted."
