وَأَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، نا أَبُو الْعَبَّاسِ الْأَصَمُّ، أنا الرَّبِيعُ قَالَ: قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ حِكَايَةً عَنْ شَرِيكٍ عَنْ أَبِي حُصَيْنٍ عَنْ يَحْيَى بْنِ وَثَّابٍ عَنْ مَسْرُوقٍ، عَنْ عَبْدِ اللهِ قَالَ: " إِذَا قَالَ الرَّجُلُ لِامْرَأَتِهِ: اسْتَلْحِقِي بِأَهْلِكِ أَوْ وَهَبَهَا لِأَهْلِهَا فَقَبِلُوهَا فَهِيَ تَطْلِيقَةٌ وَهُوَ أَحَقُّ بِهَا ".
Masruq (may Allah have mercy on him) narrates from Sayyiduna Abdullah (may Allah be pleased with him): When a man says to his wife, "Join your family," or gives her away to her family, and they accept her, it is one divorce and the husband has more right to take her back.
