قَالَ: وَحَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنِ الْحَجَّاجِ بْنِ أَرْطَاةَ، عَنِ الرُّكَيْنِ بْنِ الرَّبِيعِ، عَنْ حَنْظَلَةَ بْنِ نُعَيْمٍ، أَنَّ الْمُغِيرَةَ بْنَ شُعْبَةَ رَضِيَ اللهُ عَنْهُ " أَجَّلَهُ سَنَةً مِنْ يَوْمِ رَافَعَتْهُ "، قَالَ عَبْدُ الرَّحْمَنِ: وَكَذَلِكَ قَالَ سُفْيَانُ، وَمَالِكٌ مِنْ يَوْمِ تُرَافِعُهُ.
Sayyiduna Mughirah bin Shu'bah (may Allah be pleased with him) said: The impotent man is to be given a respite of one year from the time his case is presented before the ruler.
Imam Malik (may Allah have mercy on him) said: The respite is to be counted from the day the case is presented before the judge.
