أَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحَسَنِ بْنِ فُورَكٍ، أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ الْأَصْبَهَانِيُّ، ثنا يُونُسُ بْنُ حَبِيبٍ، ثنا أَبُو دَاوُدَ الطَّيَالِسِيُّ، ثنا شُعْبَةُ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ بَرِيرَةَ فَتُعْتِقَهَا، وَأَرَادَ مَوَالِيهَا أَنْ يَشْتَرِطُوا الْوَلَاءَ فَذَكَرَتْ عَائِشَةُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ رَسُولُ اللهِ صلَّى الله عَلَيْهِ وَسَلَّمَ: " اشْتَرِيهَا وَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ " قَالَتْ: وَأُتِيَ بِلَحْمٍ فَقَالَ: " مَا هَذَا؟ " فَقَالُوا: هَذَا أَهْدَتْهُ إِلَيْنَا بَرِيرَةُ تُصُدِّقَ بِهَا عَلَيْهَا، فَقَالَ رَسُولُ اللهِ صلَّى الله عَلَيْهِ وَسَلَّمَ: " هُوَ عَلَيْهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ "، قَالَتْ: وَخُيِّرَتْ وَكَانَ زَوْجُهَا حُرًّا، قَالَ شُعْبَةُ: ثُمَّ سَأَلْتُهُ بَعْدُ فَقَالَ: مَا أَدْرِي أَحُرٌّ هُوَ أَمْ عَبْدٌ؟ قَالَ شُعْبَةُ: فَقُلْتُ لِسِمَاكِ بْنِ ⦗٣٥٩⦘ حَرْبٍ: إِنِّي أَتَّقِي أَنْ أَسْأَلَهُ عَنِ الْإِسْنَادِ فَسَلْهُ أَنْتَ، قَالَ: وَكَانَ فِي خَلْقِهِ فَقَالَ لَهُ سِمَاكٌ بَعْدَمَا حَدَّثَ: أَحَدَّثَكَ هَذَا أَبُوكَ عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا؟ فَقَالَ عَبْدُ الرَّحْمَنِ: نَعَمْ، فَلَمَّا خَرَجَ قَالَ لِي سِمَاكٌ: يَا شُعْبَةُ اسْتَوْثَقْتُهُ لَكَ مِنْهُ، رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ، عَنْ أَحْمَدَ بْنِ عُثْمَانَ النَّوْفَلِيِّ عَنْ أَبِي دَاوُدَ، وَأَخْرَجَهُ هُوَ، وَالْبُخَارِيُّ، مِنْ حَدِيثِ غُنْدَرٍ عَنْ شُعْبَةَ وَلَمْ يَذْكُرُوا قَوْلَ سِمَاكِ بْنِ حَرْبٍ، وَقَدْ رَوَاهُ سِمَاكُ بْنُ حَرْبٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ فَأَثْبَتَ عَنْهُ كَوْنَ زَوْجِهَا عَبْدًا.
Abd al-Rahman bin al-Qasim narrates from his father that Sayyidah Aishah (may Allah be pleased with her) intended to buy Barirah and set her free, but her owners stipulated the wala' (right of inheritance from the freed slave) for themselves. Sayyidah Aishah (may Allah be pleased with her) mentioned this to the Prophet (peace and blessings be upon him), and the Messenger of Allah (peace and blessings be upon him) said: "Buy her and set her free, for the wala' belongs to the one who sets free." She said: Barirah was given some meat. He (peace and blessings be upon him) asked: "What is this?" They said: This meat was given in charity to Barirah. He (peace and blessings be upon him) said: "For her it is charity, and for us it is a gift." She said: Barirah was given the choice, and her husband was free. Shu'bah said: After that I asked him, and he said: I do not know whether he was free or a slave. Shu'bah said: I said to Simak bin Harb: I am wary of asking him about the chain, so you ask him. So Simak asked: Did your father narrate this to you from Sayyidah Aishah (may Allah be pleased with her)? He said: Yes. Shu'bah said: When Simak was leaving, he said: I have confirmed it for you.
