Bayhaqi 14189 — Reports on the marriage of the muhallil

Umar bin Nafi' narrates from his father that a man came to Sayyiduna Ibn Umar (may Allah be pleased with them both) and asked him about a man who had divorced his wife three times, after which his brother married her without consulting him, in order to make her lawful for his brother. Is she lawful for the first (husband)? He said: No, unless the marriage is out of genuine desire. Otherwise, in the time of the Messenger of Allah (peace and blessings be upon him) we used to count this marriage as fornication.
