باب: نكاح المحدثين وما جاء في قول الله عز وجل: الزاني لا ينكح إلا زانية أو مشركة والزانية لا ينكحها إلا زان أو مشرك وحرم ذلك على المؤمنين
Chapter: The marriage of fornicators, and reports on the saying of Allah the Mighty and Majestic: "The fornicator does not marry except a fornicatress or a polytheist woman, and the fornicatress none marries except a fornicator or a polytheist man, and that has been forbidden to the believers"

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ قِرَاءَةً، وَأَبُو مُحَمَّدٍ عُبَيْدُ بْنُ مُحَمَّدِ بْنِ مُحَمَّدِ بْنِ مَهْدِيٍّ الْقُشَيْرِيُّ لَفْظًا قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا يَحْيَى بْنُ جَعْفَرِ بْنِ أَبِي طَالِبٍ، أنبأ عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ، أنبأ ابْنُ جُرَيْجٍ، عَنْ عَطَاءٍ، أَنَّهُ قَالَ: " كُنَّ بَغَايَا مُتَعَلِّنَاتٍ، أَوْ ⦗٢٤٨⦘ مُعْلِنَاتٍ فِي الْجَاهِلِيَّةِ، بَغِيُّ آلِ فُلَانٍ، وَبَغِيُّ آلِ فُلَانٍ، فَقَالَ اللهُ تَعَالَى: {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ} [النور: ٣] قَالَ: فَأَحْكَمَ اللهُ مِنْ ذَلِكَ أَمْرَ الْجَاهِلِيَّةِ بِالْإِسْلَامِ " قَالَ ابْنُ جُرَيْجٍ فَقِيلَ لِعَطَاءٍ: أَبَلَغَكَ ذَلِكَ عَنِ ابْنِ عَبَّاسٍ؟ قَالَ: نَعَمْ.
Ata' (may Allah have mercy on him) says: In the Days of Ignorance there were prostitutes who were open about it: the prostitute of such-and-such family, the prostitute of such-and-such family. So Allah Almighty said: "The fornicator does not marry except a fornicatress or a polytheist woman, and the fornicatress none marries her except a fornicator or a polytheist man, and that has been made unlawful for the believers." [Surah al-Nur: 3] So through Islam Allah Almighty forbade that practice of the Days of Ignorance. Ibn Jurayj (may Allah have mercy on him) says: Ata' (may Allah have mercy on him) was asked: "Did this reach you from Ibn Abbas (may Allah be pleased with them both)?" He said: "Yes."
