أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي أَبُو مُحَمَّدِ بْنُ زِيَادٍ الْعَدْلُ، أنبأ مُحَمَّدُ بْنُ إِسْحَاقَ، ثنا سَلْمُ بْنُ جُنَادَةَ، ثنا وَكِيعٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا {وَمَا يُتْلَى عَلَيْكُمْ فِي الْكِتَابِ فِي يَتَامَى النِّسَاءِ اللَّاتِي، لَا تُؤْتُونَهُنَّ مَا كُتِبَ لَهُنَّ، وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ} [النساء: ١٢٧] قَالَتْ: " هَذِهِ الْيَتِيمَةُ تَكُونُ عِنْدَ الرَّجُلِ، هُوَ وَلِيُّهَا ⦗٢١٢⦘ لَعَلَّهَا تَكُونُ شَرِيكَتَهُ فِي مَالِهِ، وَهُوَ أَوْلَى بِهَا، فَيَرْغَبُ عَنْهَا أَنْ يَنْكِحَهَا، وَيَعْضِلُهَا لِمَا لَهَا، فَلَا يُنْكِحُهَا غَيْرَهُ كَرَاهِيَةَ أَنْ يَشْرَكَهُ أَحَدٌ فِي مَالِهِ " رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ، عَنْ يَحْيَى عَنْ وَكِيعٍ، وَأَخْرَجَهُ مُسْلِمٌ مِنْ أَوْجُهٍ عَنْ هِشَامٍ.
Hisham bin Urwah narrates from his father, and he from Sayyidah Aishah (may Allah be pleased with her): "And what is recited to you in the Book concerning orphan girls, to whom you do not give what is prescribed for them, and whom you desire to marry" [Surah al-Nisa: 127]. Sayyidah Aishah (may Allah be pleased with her) says: This is an orphan girl who is in a man's care, and he is her guardian; perhaps she is his partner in his wealth, and he has the most right over her, yet he does not wish to marry her, and because of her wealth he prevents her from marrying, and does not marry her to anyone else, disliking that someone else should become his partner in his wealth.
