وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ، ثنا يَحْيَى، أنا يَزِيدُ، أنا خَالِدُ بْنُ يَزِيدَ الْهَدَادِيُّ، عَنْ صَالِحٍ الدَّهَّانِ، أَوْ سَلَمَةَ بْنِ كُلَيْبٍ قَالَ: سُئِلَ جَابِرُ بْنُ زَيْدٍ عَنِ الْخُنْثَى كَيْفَ يُوَرَّثُ، فَقَالَ: " يَقُومُ فَيَدْنُو مِنْ حَائِطٍ ثُمَّ يَبُولُ، فَإِنْ أَصَابَ الْحَائِطَ فَهُوَ غُلَامٌ، وَإِنْ سَالَ بَيْنَ فَخِذَيْهِ فَهُوَ جَارِيَةٌ " وَقَدْ رُوِيَ فِيهِ حَدِيثٌ مُسْنَدٌ بِإِسْنَادٍ ضَعِيفٍ.
Salamah bin Kulayb (may Allah have mercy on him) said that Jabir bin Zayd (may Allah have mercy on him) was asked about the inheritance of a hermaphrodite, and he said: He should stand and urinate towards a wall. If the urine hits the wall, he is a boy, and if it flows between his thighs, she is a girl.
