أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا الْحَسَنُ بْنُ مُكْرَمٍ، ثنا أَبُو النَّضْرِ، ثنا مُحَمَّدُ بْنُ رَاشِدٍ، عَنْ سُلَيْمَانَ بْنِ مُوسَى، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ " قَضَى أَنَّ كُلَّ مُسْتَلْحَقٍ اسْتُلْحِقَ بَعْدَ أَبِيهِ الَّذِي يُدْعَى إِلَيْهِ فَادَّعَاهُ وَرَثَتُهُ مِنْ بَعْدُ، فَقَضَى إِنْ كَانَ مِنْ أَمَةٍ يَمْلِكُهَا يَوْمَ أَصَابَهَا فَقَدْ لَحِقَ بِمَنِ اسْتَلْحَقَهُ، لَيْسَ لَهُ فِيمَا قُسِمَ قَبْلَهُ مِنَ الْمِيرَاثِ شَيْءٌ، وَمَنْ أَدْرَكَ الْمِيرَاثَ لَمْ يُقْسَمْ فَلَهُ نَصِيبُهُ وَلَا يَلْحَقُ إِذَا كَانَ أَبُوهُ الَّذِي يُدْعَى لَهُ أَنْكَرَهُ، فَإِنْ كَانَ مِنْ أَمَةٍ لَا يَمْلِكُهَا أَوْ مِنْ حُرَّةٍ عَاهَرَ بِهَا، فَإِنَّهُ لَا يَلْحَقُ وَلَا يَرِثُ، وَإِنْ كَانَ أَبُوهُ الَّذِي يُدْعَى لَهُ هُوَ ادَّعَاهُ فَهُوَ وَلَدُ زِنًا لِأَهْلِ أُمِّهِ مَنْ كَانُوا حُرَّةً أَوْ أَمَةً ".
Amr bin Shu'ayb narrates from his father, from his grandfather (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) gave a ruling about a boy who, after the death of the father he was named after, is attached to him, and the father's heirs wish to attach him. He (peace and blessings be upon him) ruled: "If the boy is from a slave woman whom he owned at the time of intercourse, his lineage is joined to the one who attaches him; but he has no share in the estate that was divided before he was attached, while in the estate that has not yet been divided he will have his share. However, if the father to whom his lineage is attributed denied him during his lifetime, he will not be joined by the heirs' attaching him. If the boy is from a slave woman whom his father did not own, or from a free woman with whom his father committed fornication, his lineage will not be joined and he will not inherit from him, even if his father claimed him during his lifetime, because he is a child of fornication, whether from a free woman or from a slave woman."
