وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ، ثنا يَحْيَى، أنا يَزِيدُ، أنا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ: امْرَأَةٌ تَرَكَتِ ابْنَيْ عَمِّهَا، أَحَدُهُمَا زَوْجُهَا وَالْآخَرُ أَخُوهَا لِأُمِّهَا، فِي قَوْلِ عَلِيٍّ وَزَيْدٍ رَضِيَ اللهُ عَنْهُمَا: " لِلزَّوْجِ النِّصْفُ وَلِلْأَخِ مِنَ الْأُمِّ السُّدُسُ، وَهُمَا شَرِيكَانِ فِيمَا بَقِيَ "، وَفِي قَوْلِ عَبْدِ اللهِ: " لِلزَّوْجِ النِّصْفُ وَلِلْأَخِ مِنَ الْأُمِّ مَا بَقِيَ " قَالَ يَزِيدُ: بِقَوْلِ عَلِيٍّ وَزَيْدٍ رَضِيَ اللهُ عَنْهُمَا يُؤْخَذُ.
It is narrated from al-Sha'bi concerning a woman who leaves behind two sons of her paternal uncle, one of them her husband and the other her (maternal half-)brother: according to the view of Ali and Zayd (may Allah be pleased with them both), the husband gets half and the maternal half-brother a sixth, and the two of them share in the remainder; and according to the view of Abdullah (may Allah be pleased with him), the husband gets half and all the rest goes to the maternal half-brother.
