أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، أنا أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ نَصْرٍ، ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، مِنْ كِتَابِهِ، أنا عَبْدُ الرَّزَّاقِ، أنا ابْنُ جُرَيْجٍ قَالَ: قُلْتُ لِابْنِ طَاوُسٍ: تَرَكَ أَبَاهُ وَأُمَّهُ وَابْنَتَهُ، كَيْفَ؟ قَالَ: لِابْنَتِهِ النِّصْفُ لَا تُزَادُ، وَالسُّدُسُ لِلْأُمِّ، وَالسُّدُسُ لِلْأَبِ، ⦗٣٨٤⦘ ثُمَّ السُّدُسُ الْآخَرُ لِلْأَبِ، ثُمَّ أَخْبَرَنِي عَنْ أَبِيهِ أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: " أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ، فَمَا تَرَكَتِ الْفَرَائِضُ فَلِأَدْنَى رَجُلٍ ذَكَرٍ ".
Ibn Jurayj (may Allah have mercy on him) said: I said to Ibn Tawus (may Allah have mercy on him): (A man) has left a father, a mother and a daughter; how will the inheritance be divided? He said: The daughter gets half, the mother a sixth and the father also a sixth, then another sixth goes to the father. Then he informed me from his father that the Prophet (peace and blessings be upon him) said: "Give the wealth of the fixed shares to those entitled to it. Whatever is left, give it to the nearest male."
