Bayhaqi 11930 — Charity according to the endower's conditions

Hisham bin Urwah (may Allah have mercy on him) said that Sayyiduna al-Zubayr (may Allah be pleased with him) made his houses a charity (sadaqah) and said: "The daughter of his who is sent back (to her family) may live there, neither causing harm nor being harmed; but if she becomes self-sufficient through a husband, then she has no share in it."
Abu Ubayd (may Allah have mercy on him) said that al-Asma'i said: "al-mardudah" (the one sent back) means "al-mutallaqah" (the divorced woman).
