Bayhaqi 11554 — Pre-emption in what has not been divided

It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) ruled: "Pre-emption (shuf'ah) applies in everything that has not been divided. When boundaries have been set and the paths have been redirected, the right of pre-emption no longer remains."
