باب: من سلف في شيء فلا يصرفه إلى غيره ولا يبعه حتى يقبضه
Chapter: One who pays in advance for a thing should not exchange it for something else or sell it until he takes possession of it
Bayhaqi 11156 — One who pays in advance for a thing
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْفَضْلِ بْنُ إِبْرَاهِيمَ، ثنا أَحْمَدُ بْنُ سَلَمَةَ، ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أنبأ عَبْدُ اللهِ بْنُ الْحَارِثِ، حَدَّثَنِي الضَّحَّاكُ، عَنْ بُكَيْرِ بْنِ عَبْدِ اللهِ بْنِ الْأَشَجِّ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ أَبِي هُرَيْرَةَ، أَنَّهُ قَالَ لِمَرْوَانَ: " أَحْلَلْتَ بَيْعَ الصِّكَاكِ وَقَدْ نَهَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعِ الطَّعَامِ قَبْلَ أَنْ يَسْتَوْفِيَ " قَالَ: فَخَطَبَ مَرْوَانُ وَنَهَى عَنْ بَيْعِهَا قَالَ سُلَيْمَانُ بْنُ يَسَارٍ: فَرَأَيْتُ الْحَرَسَ يَأْخُذُونَهَا مِنْ أَيْدِي النَّاسِ رَوَاهُ مُسْلِمٌ عَنْ إِسْحَاقَ بْنِ إِبْرَاهِيمَ.
Sulayman bin Yasar (may Allah have mercy on him) said that Sayyiduna Abu Hurayrah (may Allah be pleased with him) said to Marwan: You have made bay' al-sukuk (the sale of vouchers) lawful, whereas the Messenger of Allah (peace and blessings be upon him) "forbade selling wheat before it has been measured out." He said: Then Marwan delivered a sermon and forbade that sale. Sulayman bin Yasar (may Allah have mercy on him) said: I saw the guards snatching them from people's hands.
