أَخْبَرَنَا الشَّيْخُ أَبُو الْفَتْحِ الْعُمَرِيُّ، أنا عَبْدُ الرَّحْمَنِ بْنُ أَبِي شُرَيْحٍ، أنا أَبُو الْقَاسِمِ الْبَغَوِيُّ، ثنا عَلِيُّ بْنُ الْجَعْدِ، أنا هُشَيْمٌ، وَأَبُو مُعَاوِيَةَ، عَنِ الشَّيْبَانِيِّ، عَنْ مُحَمَّدِ بْنِ عُبَيْدِ اللهِ الثَّقَفِيِّ أَنَّهُ اشْتَرَى مِنْ رَجُلٍ سِلْعَةً، فَنَقَدَهُ بَعْضَ الثَّمَنِ وَبَقِيَ بَعْضٌ، فَقَالَ: ادْفَعْهَا إِلِيَّ فَأَبَى الْبَائِعُ فَانْطَلَقَ الْمُشْتَرِي، وَتَعَجَّلَ لَهُ بَقِيَّةَ الثَّمَنِ فَدَفَعَهُ إِلَيْهِ، فَقَالَ: ادْخُلْ وَاقْبِضْ سِلْعَتَكَ فَوَجَدَهَا مَيْتَةً، فَقَالَ لَهُ: رُدَّ عَلَيَّ مَالِي فَأَبَى فَاخْتَصَمَا إِلَى شُرَيْحٍ، فَقَالَ شُرَيْحٌ: " رُدَّ عَلَى الرَّجُلِ مَالَهُ، وَارْجِعْ إِلَى جِيفَتِكَ فَادْفِنْهَا ".
Muhammad bin Ubaydullah al-Thaqafi (may Allah have mercy on him) bought goods from a man; he paid part of the price in cash and part remained. He said: Hand over the goods, but the seller refused. Then the buyer quickly brought the remaining price and gave it to him. He said: Come and take possession of your goods. He found it dead. He said: Return my money, but he refused. The two of them brought the dispute to Qadi Shurayh (may Allah have mercy on him), and Qadi Shurayh (may Allah have mercy on him) said: Return his money, and go and bury your carcass.
