أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ يُوسُفَ الرَّفَّاءُ، أنا عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثنا إِسْمَاعِيلُ الْقَاضِي، ثنا ابْنُ أَبِي أُوَيْسٍ، ثنا ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ فِي الثَّمَرِ يَكُونُ بَيْنَ الرَّجُلَيْنِ أَنَّهُ " لَا بَأْسَ أَنْ يُقَسِّمَاهُ فِي رُءُوسِ النَّخْلِ بِالْخَرْصِ فَيَجُوزُ كُلُّ وَاحِدٍ مِنْهُمَا طَائِفَةً مِنَ النَّخْلِ ".
Ibn Abi al-Zinad (may Allah have mercy on him) narrates from his father (may Allah have mercy on him), who narrates from the reliable jurists of Madinah (may Allah have mercy on them), that they used to say concerning fruit shared between two men that they may divide it by estimation while it is still on the trees. It will be permissible for them each to take a portion of the palm trees.
