Bayhaqi 10463 — What is taken while bargaining, or under a sale

Imam al-Sha'bi (may Allah have mercy on him) said: Sayyiduna Umar (may Allah be pleased with him) settled on a price for a horse with a man. A man rode on it, and the horse perished while in his possession. Sayyiduna Umar (may Allah be pleased with him) said: Come, appoint a man as arbiter between yourself and me. The man chose Judge Shurayh al-Iraqi (may Allah have mercy on him). They came to Judge Shurayh (may Allah have mercy on him), and Shurayh (may Allah have mercy on him) said to Sayyiduna Umar (may Allah be pleased with him): Since you took the horse sound and healthy, you are liable for it until you return it sound and healthy. Sayyiduna Umar (may Allah be pleased with him) liked his judgment, and he appointed him as a judge.
