Hadith 4049
نَا نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ الْبَغَوِيُّ ، نَا سَعِيدُ بْنُ يَحْيَى الأُمَوِيُّ ، نَا أَبِي ، نَا ابْنُ جُرَيْجٍ ، أَخْبَرَنِي عَبْدُ اللَّهِ بْنُ أَبِي مُلَيْكَةَ ، قَالَ : سَأَلْتُ عَبْدَ اللَّهِ بْنَ الزُّبَيْرِ ، " عَنِ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ فَيَبُتُّهَا ، ثُمَّ يَمُوتُ فِي عِدَّتِهَا ؟ ، فَقَالَ ابْنُ الزُّبَيْرِ طَلَّقَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ ، امْرَأَتَهُ تُمَاضِرَ بِنْتَ الأَصْبَغِ الْكَلْبِيَّةَ ، ثُمَّ مَاتَ وَهِيَ فِي عِدَّتِهَا ، فَوَرِثَهَا عُثْمَانُ " .
Abdullah bin Abu Malika reports: I asked Sayyiduna Abdullah bin Zubair (may Allah be pleased with them both) about a man who gives his wife an irrevocable divorce, and then that man dies during the woman’s waiting period (‘iddah). So Sayyiduna Abdullah bin Zubair (may Allah be pleased with them both) informed: Sayyiduna Abdur Rahman bin Awf divorced his wife Tamadur bint Asbagh Kalbi, then during her waiting period Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) passed away, so Sayyiduna Uthman (may Allah be pleased with him) considered that woman to be an heir.
Hadith 4050
نَا نَا أَحْمَدُ بْنُ عِيسَى بْنِ السُّكَيْنِ ، نَا عَبْدُ الْحَمِيدِ بْنُ مُحَمَّدِ بْنِ الْمُسْتَهَامِ ، نَا مَخْلَدُ بْنُ يَزِيدَ ، أَخْبَرَنِي ابْنُ جُرَيْجٍ ، أَخْبَرَنِي ابْنُ أَبِي مُلَيْكَةَ ، قَالَ : لَقِيتُ ابْنَ الزُّبَيْرِ وَهُوَ مُقْبِلٌ مِنْ قُعَيْقِعَانَ عَلَى بِرْذَوْنٍ ، فَقُلْتُ : " كَيْفَ تَرَى فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثًا ؟ ، قَالَ : أَمَّا عُثْمَانُ فَوَرِثَهَا ".
Ibn Abu Mulaykah says: I met Sayyiduna Abdullah bin Zubair, he came riding a mule from Qaiqan. I asked: "What is your opinion about a person who gives his wife three divorces?" He replied: "Sayyiduna Uthman (may Allah be pleased with him) has considered such a woman as an heir."
Hadith 4051
نَا نَا عَبْدُ الْغَافِرِ بْنُ سَلامَةَ ، نَا أَبُو شُرَحْبِيلَ عِيسَى بْنُ خَالِدٍ ، نَا أَبُو الْمُغِيرَةِ ، نَا الأَوْزَاعِيُّ ، عَنِ الزُّهْرِيِّ ، أَنَّ طَلْحَةَ بْنَ عَبْدِ اللَّهِ بْنِ عَوْفٍ ، حَدَّثَهُ ، أَنَّ عُثْمَانَ بْنَ عَفَّانَ ، وَرِثَ تُمَاضِرَ بِنْتَ الأَصْبَغِ مِنْ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ ، وَكَانَ عَبْدُ الرَّحْمَنِ طَلَّقَهَا ، وَهِيَ آخِرُ طَلاقِهَا فِي مَرَضِهِ " .
Talhah bin Abdullah reports: Sayyiduna Uthman (may Allah be pleased with him) made Tamadur bint Asbagh an heir of Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him), even though Sayyiduna Abdur Rahman (may Allah be pleased with him) had divorced this woman. He had divorced her during his illness.
Hadith 4052
نَا نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا أَيُّوبُ بْنُ الْوَلِيدِ أَبُو سُلَيْمَانَ الضَّرِيرُ ، نَا زَيْدُ بْنُ الْحُبَابِ ، نَا سُفْيَانُ الثَّوْرِيُّ ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو ، قَالَ : " وَجَدُوا فِي كِتَابِ عُمَرَ إِذَا مَا عَبَثَ طَلَّقَ عَنْهُ وَلِيُّهُ يَعْنِي الْمَجْنُونَ " .
Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) narrates: People found this statement in the letter of Sayyiduna Umar (may Allah be pleased with him): "When someone acts foolishly, his guardian should pronounce divorce on his behalf." What he meant was when someone becomes insane.
Hadith 4053
نَا نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا الصَّاغَانِيُّ ، نَا قَبِيصَةُ ، نَا سُفْيَانُ ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، قَالَ : وَجَدْنَا فِي كِتَابِ عَبْدِ اللَّهِ بْنِ عَمْرٍو " إِذَا عَبَثَ الْمَجْنُونُ بِامْرَأَتِهِ ، طَلَّقَ عَنْهُ وَلِيُّهُ " .
Amr bin Shu'aib narrates: We found this statement in the written document of Abdullah bin Amr (may Allah be pleased with them): "When a madman begins to behave indecently with his wife, then his guardian should divorce her on his behalf."
Hadith 4054
نَا نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا أَحْمَدُ بْنُ مَنْصُورٍ ، نَا يَزِيدُ الْعَدَنِيُّ ، نَا سُفْيَانُ ، نَا حَبِيبُ بْنُ أَبِي ثَابِتٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، قَالَ : وَجَدْنَا فِي كِتَابِ عَبْدِ اللَّهِ بْنِ عَمْرٍو ، عَنْ عُمَرَ بْنِ الْخَطَّابِ ، قَالَ : " إِذَا عَبَثَ الْمَعْتُوهُ بِامْرَأَتِهِ ، أُمِرَ وَلِيُّهُ أَنْ يُطَلِّقَ " ، قَالَ : تَابَعَهُ أَبُو حُذَيْفَةَ ، عَنْ سُفْيَانَ مِثْلَهُ.
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: "When a madman behaves indecently with his wife, his guardian will be ordered to divorce her."
Hadith 4055
نَا نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا سُلَيْمَانُ بْنُ تَوْبَةَ ، نَا أَبُو حُذَيْفَةَ .

Hadith 4056
ح وَنا ابْنُ مَنِيعٍ ، نَا دَاوُدُ بْنُ رُشَيْدٍ ، نَا مُحَمَّدُ بْنُ سَلَمَةَ ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ ، عَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ قُسَيْطٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، قَالَ : أَبْقَتْ أَمَةٌ لِبَعْضِ الْعَرَبِ فَوَقَعَتْ بِوَادِي الْقُرَى فَانْتَهَتْ إِلَى الْحَيِّ الَّذِي أَبْقَتْ مِنْهُمْ ، فَتَزَوَّجَهَا رَجُلٌ مِنْ بَنِي عُذْرَةَ ، فَنَثَرَتْ لَهُ ذَاتَ بَطْنِهَا ، ثُمَّ عَثَرَ عَلَيْهَا سَيِّدُهَا بَعْدُ فَاسْتَاقَهَا وَوَلَدَهَا ، فَقَضَى عُمَرُ لِلْعُذْرِيِّ بِغَرَرِ وَلَدِهِ الْغُرَّةُ لِكُلِّ وَصِيفٍ وَصِيفٌ ، وَلِكُلِّ وَصِيفَةٍ وَصِيفَةٌ ، وَجَعَلَ ثَمَنَ الْغُرَّةِ إِذْ لَمْ يُوجَدْ عَلَى أَهْلِ الْقُرَى سِتِّينَ دِينَارًا ، أَوْ سَبْعَمِائَةِ دِرْهَمٍ ، وَعَلَى أَهْلِ الْبَادِيَةِ سِتَّ فَرَائِضَ " .
Saeed bin Musayyib narrates: A slave girl belonging to an Arab ran away and reached Wadi al-Qura. She reached the tribe from whom she had fled. A man from the tribe of Banu Udhrah married her, and she bore him many children. Then the master of the slave girl reached her and wanted to take possession of the slave girl and her children. So, Sayyiduna Umar (may Allah be pleased with him) gave this verdict in the case: The man from the tribe of Udhrah should pay compensation for his children by giving a slave (or slave girl) in exchange; for a boy, a male slave, and for a girl, a female slave. If these are not available, then for a city dweller, 60 dinars or 700 dirhams should be paid in exchange for a slave, and for villagers, six faraid will be imposed.
Hadith 4057
نَا نَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الْبَزَّازُ ، نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا عَبْدُ اللَّهِ بْنُ بَكْرٍ ، نَا سَعِيدُ بْنُ أَبِي عَرُوبَةَ ، عَنْ مَطَرٍ الْوَرَّاقِ ، عَنْ عَطَاءٍ ، عَنْ عَائِشَةَ ، أَنَّهَا قَالَتْ : " فِي الْحَرَامِ يَمِينٌ تُكَفِّرُ " .
Sayyida Aisha (may Allah be pleased with her) regarding declaring something haram said: "This is an oath, for which expiation must be given."
Hadith 4058
نَا يَعْقُوبُ ، نَا ابْنُ عَرَفَةَ ، نَا السَّهْمِيُّ ، عَنْ سَعِيدٍ ، عَنْ قَتَادَةَ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، وَعَطَاءٍ ، وَطَاوُسٍ ، وَسُلَيْمَانَ بْنِ يَسَارٍ ، وَسَعِيدِ بْنِ جُبَيْرٍ ، أَنَّهُمْ قَالُوا : " فِي الْحَرَامِ يَمِينٌ تُكَفِّرُ " .
Saeed bin Musayyib, Ata, Tawus, Sulaiman bin Yasar, and Saeed bin Jubair say: "Declaring something haram (forbidden) is an oath, for which expiation must be given."
