Hadith 3928
قَالَ : وَنا قَالَ : وَنا ابْنُ الْمُبَارَكِ ، أنا سُفْيَانُ ، عَنْ عَمْرِو بْنِ مُرَّةَ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، قَالَ : جَاءَ رَجُلٌ إِلَى ابْنِ عَبَّاسٍ ، فَقَالَ : " إِنِّي طَلَّقْتُ امْرَأَتِي أَلْفًا ، قَالَ : أَمَّا ثَلاثٌ فَتُحَرِّمُ عَلَيْكَ امْرَأَتَكَ ، وَبَقِيَّتُهُنَّ وِزْرٌ اتَّخَذْتَ آيَاتِ اللَّهِ هُزُوًا " ، .
Saeed bin Jubair narrates: A man came to Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) and said, "I have given my wife one thousand divorces." So Sayyiduna Ibn Abbas (may Allah be pleased with them) said, "Because of three divorces, your wife has become unlawful for you, and the remaining divorces have become a sin for you, because you have made a mockery of the verses of Allah."
Hadith 3929
نَا ابْنُ صَاعِدٍ ، نَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ ، نَا عَبْدُ الرَّحْمَنِ ، نَا سُفْيَانُ ، بِإِسْنَادِهِ مِثْلَهُ.
This narration is also transmitted with another chain of transmission.
Hadith 3930
نَا إِسْحَاقُ بْنُ مُحَمَّدِ بْنِ الْفَضْلِ الزَّيَّاتُ ، نَا عَلِيُّ بْنُ شُعَيْبٍ ، نَا عَبْدُ الْمَجِيدِ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ طَاوُسٍ ، عَنْ مُعَاذِ بْنِ جَبَلٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا طَلاقَ قَبْلَ نِكَاحٍ ، وَلا نَذَرَ فِيمَا لا يَمْلِكُ " .
Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "Divorce cannot be given before marriage, and a person cannot make a vow regarding something he does not own."
Hadith 3931
نَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِبْرَاهِيمَ بْنِ نَيْرُوزٍ ، نَا عَمْرُو بْنُ عَلِيٍّ ، نَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ الصَّمَدِ ، نَا مَطَرٌ الْوَرَّاقُ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا يَجُوزُ طَلاقٌ ، وَلا عَتَاقٌ ، وَلا بَيْعٌ ، وَلا وَفَاءُ نَذْرٍ ، فِيمَا لا يَمْلِكُ " .
Amr ibn Shu'aib, narrating from his father, from his grandfather, reports: The Prophet Muhammad (peace be upon him) said: "A man cannot pronounce divorce, set free, sell, or fulfill a vow regarding something he does not own."
Hadith 3932
نَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ بْنِ مُحَمَّدٍ صَاحِبُ أَبِي صَخْرَةَ ، نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا عَبْدَةُ بْنُ سُلَيْمَانَ ، عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ . ح وَنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ بْنِ نَيْرُوزٍ ، نَا عَمْرُو بْنُ عَلِيٍّ ، نَا عَبْدُ الأَعْلَى ، وَمُحَمَّدُ بْنُ سَوَاءٍ ، قَالا : نَا سَعِيدٌ ، عَنْ مَطَرٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَيْسَ عَلَى الرَّجُلِ طَلاقٌ فِيمَا لا يَمْلِكُ ، وَلا بَيْعٌ فِيمَا لا يَمْلِكُ ، وَلا عِتْقُ فِيمَا لا يَمْلِكُ " .
Amr ibn Shu'aib narrates from his father, from his grandfather: The Prophet Muhammad (peace be upon him) said: "A man cannot pronounce divorce for that which he does not own, cannot sell that which he does not own, and cannot set free that which he does not own."
Hadith 3933
نَا مُحَمَّدُ بْنُ نَيْرُوزٍ ، نَا عَمْرُو بْنُ عَلِيٍّ ، نَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ الصَّمَدِ ، نَا عَامِرٌ الأَحْوَلُ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا يَجُوزُ عَتَاقٌ ، وَلا طَلاقٌ فِيمَا لا يَمْلِكُ " ، وَلَمْ يَذْكُرْ فِيهِ الْبَيْعَ.
Amr ibn Shu'ayb narrates from his father, from his grandfather: The Prophet Muhammad (peace be upon him) said: "It is not permissible for a man to free or divorce someone whom he does not own." The narrator did not mention selling in this narration.
Hadith 3934
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا يُوسُفُ بْنُ مُوسَى ، نَا أَبُو أُسَامَةَ ، نَا الْوَلِيدُ بْنُ كَثِيرٍ ، حَدَّثَنِي عَبْدُ الرَّحْمَنِ بْنُ الْحَارِثِ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ يُطَلِّقُ مَا لا يَمْلِكُ فَلا طَلاقَ لَهُ ، وَمَنْ أَعْتَقَ مَا لا يَمْلِكُ فَلا عَتَاقَ لَهُ ، وَمَنْ نَذَرَ فِيمَا لا يَمْلِكُ فَلا نَذْرَ لَهُ ، وَمَنْ حَلَفَ عَلَى مَعْصِيَةٍ فَلا يَمِينَ لَهُ ، وَمَنْ حَلَفَ عَلَى قَطِيعَةِ رَحِمٍ فَلا يَمِينَ لَهُ " .
Amr ibn Shu'aib narrates from his father, from his grandfather: The Prophet Muhammad (peace be upon him) said: "Whoever pronounces a divorce over something he does not own, then that divorce will not take effect; whoever frees someone whom he does not own, then that person will not be freed; whoever makes a vow regarding something he does not own, then his vow will not be valid; and whoever swears an oath to commit a sin, his oath will not be considered; and whoever swears an oath to sever ties of kinship, his oath will not be considered."
Hadith 3935
نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا أَبُو بَكْرٍ إِسْمَاعِيلُ بْنُ الْفَضْلِ الْبَلْخِيُّ ، حَدَّثَنِي أَبُو صَالِحٍ أَحْمَدُ بْنُ يَعْقُوبَ ، بِبَلْخَ ، نَا الْوَلِيدُ بْنُ سَلَمَةَ الأَزْدِيُّ ، نَا يُونُسُ ، عَنِ الزُّهْرِيِّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ ، قَالَتْ : " بَعَثَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَبَا سُفْيَانَ بْنَ حَرْبٍ ، فَكَانَ فِيمَا عَهَدَ إِلَيْهِ ، أَنْ لا يُطَلِّقَ الرَّجُلُ مَنْ لا يَتَزَوَّجُ ، وَلا يُعْتِقَ مَنْ لا يَمْلِكُ " .
Sayyida Aisha (may Allah be pleased with her) narrates: The Noble Prophet (peace and blessings be upon him) sent Sayyiduna Abu Sufyan bin Harb (may Allah be pleased with him) and instructed him: "(That is, the command is) A man cannot divorce until he marries, and he cannot set free one whom he does not own."
Hadith 3936
نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ سَعِيدٍ ، نَا مُحَمَّدُ بْنُ عُبَيْدِ بْنِ عُتْبَةَ ، نَا مَعْمَرُ بْنُ بَكَّارٍ ، نَا إِبْرَاهِيمُ بْنُ سَعْدٍ ، عَنِ الزُّهْرِيِّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ ، قَالَتْ : " بَعَثَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَبَا سُفْيَانَ عَلَى نَجْرَانَ الْيَمَنِ عَلَى صَلاتِهَا وَحَرْبِهَا وَصَدَقَاتِهَا ، وَبَعَثَ مَعَهُ رَاشِدَ بْنَ عَبْدِ اللَّهِ ، وَكَانَ إِذَا ذَكَرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : رَاشِدٌ خَيْرٌ مِنْ سُلَيْمٍ ، وَأَبُو سُفْيَانَ خَيْرٌ مِنْ عُرَيْنَةَ ، فَكَانَ فِيمَا عَهَدَ إِلَى أَبِي سُفْيَانَ أَوْصَاهُ بِتَقْوَى اللَّهِ ، وَقَالَ : لا يُطَلِّقُ رَجُلٌ مَا لا يَنْكِحُ ، وَلا يُعْتِقُ مَا لا يَمْلِكُ ، وَلا نَذْرَ فِي مَعْصِيَةِ اللَّهِ " .
Lady Aisha (may Allah be pleased with her) narrates: The Noble Prophet (peace and blessings be upon him) sent Abu Sufyan to the city of Najran in Yemen, so that he may lead the prayers there, fight (in battle), and collect charity. The Noble Prophet (peace and blessings be upon him) also sent Rashid bin Abdullah with him. Whenever the Noble Prophet (peace and blessings be upon him) mentioned them, he would say: "Rashid is better than the entire tribe of Sulaym, and Abu Sufyan is better than the entire tribe of Uraynah." The Noble Prophet (peace and blessings be upon him) advised Abu Sufyan, instructing him to adopt the fear of Allah, and gave this guidance: "No person can divorce a woman whom he has not married, and no person can free a slave whom he does not own, and there is no validity to a vow made to disobey Allah."
Hadith 3937
نَا أَبُو الْحُسَيْنِ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ جَعْفَرٍ الْجُوزِيُّ ، نَا مُحَمَّدُ بْنُ غَالِبِ بْنِ حَرْبٍ ، نَا خَالِدُ بْنُ يَزِيدَ الْقَرَنِيُّ ، نَا عَبْدُ الرَّحْمَنِ بْنُ مُسْهِرٍ ، نَا أَبُو خَالِدٍ الْوَاسِطِيُّ ، عَنْ أَبِي هَاشِمٍ الرُّمَّانِيِّ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، عَنِ ابْنِ عُمَرَ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ ، قَالَ : " يَوْمَ أَتَزَوَّجُ فُلانَةَ ، فَهِيَ طَالِقٌ ، قَالَ : طَلَّقَ مَا لا يَمْلِكُ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates about the Noble Prophet (peace and blessings be upon him): He was asked about a person who says, "The day I marry such-and-such woman, she is divorced." The Noble Prophet (peace and blessings be upon him) said: "He has pronounced a divorce over which he has no authority."
Hadith 3938
نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ قَطَنٍ ، نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا عُمَرُ بْنُ يُونُسَ ، عَنْ سُلَيْمَانَ بْنِ أَبِي سُلَيْمَانَ الزُّهْرِيِّ ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا نَذْرَ إِلا فِيمَا أُطِيعُ اللَّهُ فِيهِ ، وَلا يَمِينَ فِي قَطِيعَةِ رَحِمٍ ، وَلا عَتَاقَ ، وَلا طَلاقَ فِيمَا لا يَمْلِكُ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) narrates: The Noble Prophet (peace and blessings be upon him) said: "A vow is only valid regarding that in which Allah Almighty is obeyed; there is no validity to an oath concerning severing ties of kinship; and there is no validity to freeing or divorcing something which a person does not own."
Hadith 3939
نَا مُحَمَّدُ بْنُ الْحُسَيْنِ الْحَرَّانِيُّ ، نَا أَحْمَدُ بْنُ يَحْيَى بْنِ زُهَيْرٍ ، نَا عَبْدُ الرَّحْمَنِ بْنُ سَعْدٍ أَبُو أُمَيَّةَ ، نَا إِبْرَاهِيمُ أَبُو إِسْحَاقَ الضَّرِيرُ ، نَا يَزِيدُ بْنُ عِيَاضٍ ، عَنِ الزُّهْرِيِّ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، عَنْ مُعَاذٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا طَلاقَ إِلا بَعْدَ نِكَاحٍ ، وَإِنْ سَمَّيْتَ الْمَرْأَةَ بِعَيْنِهَا " ، يَزِيدُ بْنُ عِيَاضٍ ، ضَعِيفٌ.
Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "Divorce can only be given after marriage, even if the woman's name is specifically mentioned." The narrator named Yazid bin 'Iyad is weak.
Hadith 3940
نَا يَحْيَى بْنُ مُحَمَّدِ بْنِ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ زُنْبُورٍ الْمَكِّيُّ ، نَا إِسْمَاعِيلُ بْنُ جَعْفَرٍ ، نَا ابْنُ أَرْدَكَ ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ ، عَنِ ابْنِ مَاهَكَ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " ثَلاثٌ جِدُّهُنَّ جِدٌّ وَهَزْلُهُنَّ جِدٌّ : النِّكَاحُ ، وَالطَّلاقُ ، وَالرَّجْعَةُ " ، .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: “There are three things in which seriousness is considered seriousness and joking is also considered seriousness: divorce, marriage, and taking back (i.e., taking back one’s wife after divorce).”
Hadith 3941
نَا الْقَاضِي الْمَحَامِلِيُّ ، نَا أَحْمَدُ بْنُ الْوَلِيدِ ، نَا إِسْمَاعِيلُ ، حَدَّثَنِي سُلَيْمَانُ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ حَبِيبِ بْنِ أَرْدَكَ ، أَنَّهُ سَمِعَ عَطَاءً ، يَقُولُ : أَخْبَرَنِي يُوسُفُ بْنُ مَاهَكَ ، أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ ، يُحَدِّثُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ.
This narration is also transmitted with another chain of transmission.
Hadith 3942
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ أَحْمَدَ الْمَارَسْتَانِيُّ ، نَا الْقَاسِمُ بْنُ سَعِيدٍ ، نَا عَبْدُ الرَّحْمَنِ بْنُ قَيْسٍ ، نَا عَبْدُ الرَّحْمَنِ بْنُ سَعِيدٍ الْقَيْسِيُّ ، نَا عَمْرُو بْنُ خَالِدٍ ، نَا زَيْدُ بْنُ عَلِيٍّ ، عَنْ آبَائِهِ أَنَّ رَجُلا أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، " إِنَّ أُمِّي عَرَضَتْ عَلَيَّ قَرَابَةً لِي أَتَزَوَّجُهَا ، فَقُلْتُ : هِيَ طَالِقٌ ثَلاثًا إِنْ تَزَوَّجْتُهَا ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : هَلْ كَانَ قَبْلَ ذَلِكَ مِنْ مِلْكٍ ؟ ، قَالَ : لا ، قَالَ : لا بَأْسَ فَتَزَوَّجْهَا " .
Imam Zaid bin Ali, may Allah be pleased with him, narrates from his forefathers: A man came to the service of the Noble Prophet, peace and blessings be upon him, and said: "O Messenger of Allah! My mother mentioned to me a relative girl of mine, suggesting that I marry her. So I said: If I marry this woman, she will have three divorces (upon her). (What is the ruling now?)" The Noble Prophet, peace and blessings be upon him, said: "Was she under your ownership before this?" He replied: "No." The Noble Prophet, peace and blessings be upon him, said: "Then there is no harm." The narrator states: Then that man married that woman.
Hadith 3943
نَا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ ، نَا يَحْيَى بْنُ عَبْدِ الْبَاقِي الأَذَنِيُّ . ح وَنا عُثْمَانُ بْنُ أَحْمَدَ الدَّقَّاقُ ، نَا يَحْيَى بْنُ عَبْدِ الْبَاقِي الأَذَنِيُّ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الْقَاسِمِ الصَّنْعَانِيُّ ، نَا عَمْرُو بْنُ عَبْدِ اللَّهِ بْنِ فَلاحٍ الصَّنْعَانِيُّ ، نَا مُحَمَّدُ بْنُ عُيَيْنَةَ ، عَنْ عَبْدِ اللَّهِ بْنِ الْوَلِيدِ الْوَصَّافِيِّ ، وَصَدَقَةَ بْنِ أَبِي عِمْرَانَ ، عَنْ إِبْرَاهِيمَ بْنِ عُبَيْدِ اللَّهِ بْنِ عُبَادَةَ بْنِ الصَّامِتِ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ : طَلَّقَ بَعْضُ آبَائِي امْرَأَتَهُ أَلْفًا ، فَانْطَلَقَ بَنُوهُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالُوا : يَا رَسُولَ اللَّهِ ، " إِنَّ أَبَانَا طَلَّقَ أُمَّنَا أَلْفًا ، فَهَلْ لَهُ مِنْ مَخْرَجٍ ؟ فَقَالَ : إِنَّ أَبَاكُمْ لَمْ يَتَّقِ اللَّهَ فَيَجْعَلْ لَهُ مِنْ أَمْرِهِ مَخْرَجًا ، بَانَتْ مِنْهُ بِثَلاثٍ عَلَى غَيْرِ السُّنَّةِ ، وَتِسْعُمِائَةٌ وَسَبْعَةٌ وَتِسْعُونَ إِثْمٌ فِي عُنُقِهِ " ، رُوَاتُهُ مَجْهُولُونَ وَضُعَفَاءُ ، إِلا شَيْخُنَا ، وَابْنُ عَبْدِ الْبَاقِي.
Ibrahim bin Ubaidullah narrates from his father, who reports from his grandfather: One of his elders gave his wife one thousand divorces. The children of that man came to the service of the Prophet Muhammad (peace be upon him) and said, "O Messenger of Allah! Our father has given our mother one thousand divorces, is there any concession for them?" The Prophet Muhammad (peace be upon him) said: "Your father did not fear Allah, otherwise he would have found a concession for her. That woman will be separated from that man due to three divorces, which are against the Sunnah, and the remaining nine hundred ninety-seven divorces will be a sin upon his neck." (Imam Daraqutni, may Allah have mercy on him, states) Our teacher Ibn Abdul Baqi (besides these two persons) all the narrators of this narration are unknown and weak.
Hadith 3944
نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ الْحَدَّادُ ، نَا أَبُو الصَّلْتِ إِسْمَاعِيلُ بْنُ أَبِي أُمَيَّةَ الدَّارِعُ . ح وَنا عَبْدُ الْبَاقِي بْنُ قَانِعٍ ، نَا عَبْدُ الْوَارِثِ بْنُ إِبْرَاهِيمَ الْعَسْكَرِيُّ ، نَا إِسْمَاعِيلُ بْنُ أَبِي أُمَيَّةَ ، نَا حَمَّادُ بْنُ زَيْدٍ ، نَا عَبْدُ الْعَزِيزِ بْنُ صُهَيْبٍ ، عَنْ أَنَسٍ ، قَالَ : سَمِعْتُ مُعَاذَ بْنَ جَبَلٍ ، قَالَ : قَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " يَا مُعَاذُ ، مَنْ طَلَّقَ فِي بِدْعَةٍ وَاحِدَةٍ ، أَوِ اثْنَتَيْنِ ، أَوْ ثَلاثًا أَلْزَمْنَاهُ بِدْعَتَهُ " ، إِسْمَاعِيلُ بْنُ أَبِي أُمَيَّةَ الْقُرَشِيُّ ، ضَعِيفٌ مَتْرُوكُ الْحَدِيثِ.
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: I heard Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) saying that the Prophet (peace and blessings be upon him) said to me: "O Mu'adh! Whoever gives one, two, or three divorces as an innovation (i.e., contrary to the Sunnah), We will make his innovation binding upon him." The narrator Isma'il bin Abu Umayyah Basri is abandoned in hadith.
Hadith 3945
نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ سَعِيدٍ ، نَا أَحْمَدُ بْنُ يَحْيَى الصُّوفِيُّ ، نَا إِسْمَاعِيلُ بْنُ أَبِي أُمَيَّةَ الْقُرَشِيُّ ، نَا عُثْمَانُ بْنُ مَطَرٍ ، عَنْ عَبْدِ الْغَفُورِ ، عَنْ أَبِي هَاشِمٍ ، عَنْ زَاذَانَ ، عَنْ عَلِيٍّ ، قَالَ : سَمِعَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " رَجُلا طَلَّقَ الْبَتَّةَ فَغَضِبَ ، وَقَالَ : تَتَّخِذُونَ آيَاتِ اللَّهِ هُزُوًا ، أَوْ دِينَ اللَّهِ هُزُوًا وَلَعِبًا ، مَنْ طَلَّقَ الْبَتَّةَ أَلْزَمْنَاهُ ثَلاثًا ، لا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ " ، إِسْمَاعِيلُ بْنُ أَبِي أُمَيَّةَ ، هَذَا كُوفِيُّ ضَعِيفُ الْحَدِيثِ.
Sayyiduna Ali (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) heard a person (or about a person) who pronounced divorce to his wife, so the Prophet (peace be upon him) became angry and said: "Do you people make a mockery of Allah’s verses (the narrator is unsure, perhaps these are the words) and play with the commands of Allah’s religion? Whoever pronounces divorce, we will make his three divorces binding, and that woman will not be lawful for that man until she marries another (and then becomes widowed or divorced)." The narrator Ismail bin Abu Umayyah is a Kufan and is weak in hadith.
Hadith 3946
نَا ابْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ زُنْبُورٍ ، نَا فُضَيْلُ بْنُ عِيَاضٍ ، عَنِ الأَعْمَشِ ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ ، قَالَ : جَاءَ رَجُلٌ إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ ، فَقَالَ : " إِنِّي طَلَّقْتُ امْرَأَتِي أَلْفًا ، قَالَ عَلِيٌّ : يُحَرِّمُهَا عَلَيْكَ ثَلاثٌ ، وَسَائِرُهُنَّ اقْسِمْهُنَّ بَيْنَ نِسَائِكَ " .
Habib bin Abu Thabit narrates: A man came to Sayyiduna Ali (may Allah be pleased with him) and said, "I have given my wife one thousand divorces." Sayyiduna Ali said, "Three divorces have made her unlawful for you, and the remaining divorces you may distribute among your other wives."
Hadith 3947
نَا نَا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ ، نَا بَحْرُ بْنُ نَصْرٍ الْخَوْلانِيُّ ، بِمِصْرَ ، نَا يَحْيَى بْنُ حَسَّانَ ، نَا مَنْصُورُ بْنُ أَبِي الأَسْوَدِ ، عَنْ مُسْلِمٍ الأَعْوَرِ الْمُلائِيِّ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، وَمُجَاهِدٍ ، عَنِ ابْنِ عَبَّاسٍ ، أَنَّهُ " سُئِلَ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ عَدَدَ النُّجُومِ ، فَقَالَ : أَخْطَأَ السُّنَّةَ ، حُرِّمَتْ عَلَيْهِ امْرَأَتُهُ " .
Saeed bin Jubair and Mujahid narrate regarding Sayyiduna Abdullah bin Abbas (may Allah be pleased with them): He was asked about a person who gives his wife divorces equal to the number of stars, so Sayyiduna Ibn Abbas said: "This person has acted against the Sunnah, and his wife has become unlawful for him."
Hadith 3948
نَا نَا أَبُو عُبَيْدٍ الْقَاسِمُ بْنُ إِسْمَاعِيلَ ، نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ سَعِيدٍ الصَّيْرَفِيُّ أَبُو عَبْدِ اللَّهِ ، نَا مُحَمَّدُ بْنُ كَثِيرٍ ، نَا مُسْلِمٌ الأَعْوَرُ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، عَنِ ابْنِ عَبَّاسٍ ، " أَنَّ رَجُلا طَلَّقَ امْرَأَتَهُ عَدَدَ النُّجُومِ ، فَقَالَ : أَخْطَأَ السُّنَّةَ ، وَحُرِّمَتْ عَلَيْهِ امْرَأَتُهُ " .
Saeed bin Jubair narrates: A man gave his wife as many divorces as the number of stars, so regarding this, Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "This person has acted against the Sunnah; his wife has become forbidden for him."
Hadith 3949
نَا عُثْمَانُ بْنُ أَحْمَدَ الدَّقَّاقُ ، نَا عَبْدُ الْمَلِكِ بْنُ مُحَمَّدٍ أَبُو قِلابَةَ ، نَا أَبِي ، نَا حَرْبُ بْنُ أَبِي الْعَالِيَةِ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " الْمُطَلَّقَةُ ثَلاثًا لَهَا السُّكْنَى ، وَالنَّفَقَةُ " .
Sayyiduna Jabir (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "A pregnant widow will not receive maintenance."
Hadith 3950
نَا عَلِيُّ بْنُ الْفَضْلِ بْنِ طَاهِرٍ ، نَا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْبُوشَنْجِيُّ ، نَا إِسْحَاقُ بْنُ زِيَادٍ الأَيْلِيُّ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الرَّقَاشِيُّ ، نَا حَرْبُ بْنُ أَبِي الْعَالِيَةِ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَيْسَ لِلْحَامِلِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا نَفَقَةٌ " .
Sayyiduna Jabir (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "A pregnant widow will not receive maintenance."
Hadith 3951
نَا حَامِدُ بْنُ مُحَمَّدٍ الْهَرَوِيُّ ، نَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الرَّقَاشِيُّ ، نَا حَرْبُ بْنُ أَبِي الْعَالِيَةِ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ " فِي الْحَامِلِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا : لا نَفَقَةَ لَهَا " .
Sayyiduna Jabir (may Allah be pleased with him) reports: The Noble Prophet (peace and blessings be upon him) said regarding a pregnant widow: "She will not receive maintenance."
Hadith 3952
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا عَلِيُّ بْنُ أَحْمَدَ الْحَوَارِبِيُّ ، نَا يَزِيدُ ، نَا شَرِيكٌ ، عَنْ جَابِرٍ ، عَنْ عَامِرٍ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْمُطَلَّقَةُ ثَلاثًا لا سُكْنَى لَهَا وَلا نَفَقَةَ ، إِنَّمَا السُّكْنَى ، وَالنَّفَقَةُ لِمَنْ يَمْلِكُ الرَّجْعَةَ " .
Sayyida Fatimah bint Qays (may Allah be pleased with her) narrates: The Noble Prophet (peace and blessings of Allah be upon him) said: "A woman who has been given three divorces is not entitled to residence or maintenance; residence and maintenance (for a divorced woman) are due when the husband still has the right to take her back."
Hadith 3953
نَا أَبُو صَالِحٍ عَبْدُ الرَّحْمَنِ بْنُ سَعِيدِ بْنِ هَارُونَ الأَصْبَهَانِيُّ ، نَا الْعَبَّاسُ بْنُ مُحَمَّدٍ ، نَا أَسْوَدُ بْنُ عَامِرٍ ، عَنِ الْحَسَنِ بْنِ صَالِحٍ ، عَنِ السُّدِّيِّ ، عَنِ الْبَهِيِّ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قالَ لِفَاطِمَةَ : " إِنَّمَا السُّكْنَى وَالنَّفَقَةُ ، لِمَنْ كَانَ لِزَوْجِهَا عَلَيْهَا رَجْعَةٌ " .
Lady Aisha (may Allah be pleased with her) narrates: The Noble Prophet (peace and blessings be upon him) said to Fatimah bint Qais: "Residence and maintenance will be provided to the woman whose husband still has the right to take her back."
Hadith 3954
نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ إِبْرَاهِيمَ ، نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْوَلِيدِ بْنِ بُرْدٍ ، نَا الْهَيْثَمُ بْنُ جَمِيلٍ ، نَا زُهَيْرٌ ، عَنْ جَابِرٍ ، عَنْ عَامِرٍ الشَّعْبِيِّ ، قَالَ : دَخَلْنَا عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ ، فَقُلْنَا لَهَا : حَدِّثِينَا عَنْ قَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِيكِ ، قَالَتْ : " دَخَلْتُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَمَعِي أَخُو زَوْجِي ، فَقُلْتُ : إِنَّ زَوْجِي طَلَّقَنِي ، وَإِنَّ هَذَا يَزْعُمُ أَنْ لَيْسَ لِي سُكْنَى وَلا نَفَقَةٌ ، فَقَالَ : بَلْ لَكِ سُكْنَى وَلَكِ نَفَقَةٌ ، قَالَ : إِنَّ زَوْجَهَا طَلَّقَهَا ثَلاثًا ، فَقَالَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : إِنَّمَا السُّكْنَى وَالنَّفَقَةُ عَلَى مَنْ لَهُ عَلَيْهَا رَجْعَةٌ " فَلَمَّا قَدِمْتُ الْكُوفَةَ طَلَبَنِي الأَسْوَدُ بْنُ يَزِيدَ يَسْأَلُنِي عَنْ ذَلِكَ ، وَأَنَّ أَصْحَابَ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ لَيَقُولُونَ : لَهَا السُّكْنَى وَالنَّفَقَةُ ".
‘Amir al-Sha‘bi narrates: We went to Lady Fatimah bint Qays (may Allah be pleased with her), and we said to her: “Narrate to us the hadith in which the decision of the Prophet (peace and blessings be upon him) regarding you is mentioned.” So Lady Fatimah bint Qays (may Allah be pleased with her) said: I went to the Prophet (peace and blessings be upon him), and my brother-in-law was with me. I said: “My husband has divorced me, and he (i.e., my brother-in-law) says that I will not get accommodation and maintenance.” The Prophet (peace and blessings be upon him) said: “You will get accommodation and maintenance.” (Her brother-in-law) said: “Her husband has given her three divorces.” So the Prophet (peace and blessings be upon him) said: “Accommodation and maintenance are for the woman whose husband has the right to take her back.” Al-Sha‘bi narrates: When I came to Kufa, al-Aswad ibn Yazid called me to ask me about this. The students of Abdullah ibn Mas‘ud (may Allah be pleased with him) say: Such a woman will get accommodation and maintenance.
Hadith 3955
حَدَّثَنَا حَدَّثَنَا ابْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ عُمَرَ بْنِ الْوَلِيدِ ، نَا أَسْبَاطُ بْنُ مُحَمَّدٍ ، عَنِ الأَعْمَشِ ، عَنْ إِبْرَاهِيمَ ، عَنِ الأَسْوَدِ ، قَالَ : قَالَ عُمَرُ " لَمَّا بَلَغَهُ قَوْلُ فَاطِمَةَ بِنْتِ قَيْسٍ : لا نُجِيزُ فِي الْمُسْلِمِينَ قَوْلَ امْرَأَةٍ ، فَكَانَ يَجْعَلُ لِلْمُطَلَّقَةِ ثَلاثًا السُّكْنَى وَالنَّفَقَةَ " .
Aswad narrates: When Sayyiduna Umar (may Allah be pleased with him) came to know about the statement of Sayyidah Fatimah bint Qais (may Allah be pleased with her), he said: "We will not impose a ruling upon the Muslims based on the statement of a woman." Sayyiduna Umar (may Allah be pleased with him) granted the right of residence and maintenance to a woman who had been given three divorces.
Hadith 3956
نَا نَا ابْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ عُمَرَ بْنِ الْوَلِيدِ ، وَأَبُو هِشَامٍ الرِّفَاعِيُّ ، قَالا : نَا وَكِيعٌ ، عَنْ دَاوُدَ الأَوْدِيِّ الزَّعَافِرِيِّ ، عَنِ الشَّعْبِيِّ ، قَالَ : لَقِيَنِي الأَسْوَدُ بْنُ يَزِيدَ ، فَقَالَ : " يَا شَعْبِيُّ ، اتَّقِ اللَّهَ وَارْجِعْ عَنْ حَدِيثِ فَاطِمَةَ بِنْتِ قَيْسٍ ، فَإِنَّ عُمَرَ ، كَانَ يَجْعَلُ لَهَا السُّكْنَى وَالنَّفَقَةَ ، فَقُلْتُ : لا أَرْجِعُ عَنْ شَيْءٍ حَدَّثَتْنِي بِهِ فَاطِمَةُ بِنْتُ قَيْسٍ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " .
Sha'bi narrates: Aswad bin Yazid met me, and he said to me: "O Sha'bi! Fear Allah, and refrain from narrating the hadith of Sayyidah Fatimah bint Qais (may Allah be pleased with her), because Sayyiduna Umar (may Allah be pleased with him) granted such a woman the right to residence and maintenance." So I said: "I will not refrain from it, because Sayyidah Fatimah bint Qais (may Allah be pleased with her) narrated this hadith to me from the Prophet (peace and blessings be upon him)."
Hadith 3957
نَا ابْنُ صَاعِدٍ ، نَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ ، نَا هُشَيْمٌ ، عَنْ سَيَّارٍ ، وَحُصَيْنٍ ، وَمُغِيرَةَ ، وَأَشْعَثَ ، وَدَاوُدَ ، وَمُجَالِدٍ ، وَإِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ ، كُلُّهُمْ عَنِ الشَّعْبِيِّ ، قَالَ : دَخَلْتُ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ فَسَأَلْتُهَا " عَنْ قَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَتْ : طَلَّقَهَا زَوْجُهَا الْبَتَّةَ ، فَأَتَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرَتْ ذَلِكَ لَهُ ، قَالَتْ : فَلَمْ يَجْعَلْ لِي سُكْنَى وَلا نَفَقَةَ ، وَقَالَ : إِنَّمَا السُّكْنَى وَالنَّفَقَةُ لِمَنْ يَمْلِكُ الرَّجْعَةَ " ، خَالَفَهُ الْحَسَنُ بْنُ عَرَفَةَ جَعَلَ آخِرَ الْحَدِيثِ ، عَنْ مُجَالِدٍ وَحْدَهُ ، عَنِ الشَّعْبِيِّ .
Shu’bi narrates: I went to Lady Fatimah bint Qais (may Allah be pleased with her) and asked her about the decision of the Prophet (peace and blessings be upon him) regarding her. She informed me: Her husband had divorced her, so she went to the Prophet (peace and blessings be upon him) and mentioned this matter before him. Lady Fatimah (may Allah be pleased with her) narrates: The Prophet (peace and blessings be upon him) did not grant me the right to residence or maintenance. The Prophet (peace and blessings be upon him) said: “Residence and maintenance are for the woman whose husband has the right to take her back.”
Hadith 3958
ثنا بِهِ الْمَحَامِلِيُّ ، وَمُحَمَّدُ بْنُ مَخْلَدٍ ، وَعُمَرُ بْنُ أَحْمَدَ الدَّرَنِيُّ ، وَعَلِيُّ بْنُ الْحَسَنِ بْنِ هَارُونَ ، قَالُوا : نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا هُشَيْمٌ ، نَا مُغِيرَةُ ، وَحُصَيْنٌ ، وَأَشْعَثُ ، وَإِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ ، وَدَاوُدُ ، وَسَيَّارٌ ، وَمُجَالِدٌ ، كُلُّهُمْ عَنِ الشَّعْبِيِّ بِهَذَا . قَالَ هُشَيْمٌ : قَالَ مُجَالِدٌ فِي حَدِيثِهِ : " إِنَّمَا السُّكْنَى وَالنَّفَقَةُ ، لِمَنْ كَانَ لَهَا عَلَى زَوْجِهَا رَجْعَةٌ ".
This same narration is transmitted with some other chains, and in the narration of Mujalid, these words are present: "Residence and maintenance are given to the woman whose husband can take her back."
Hadith 3959
نَا نَا إِبْرَاهِيمُ بْنُ حَمَّادٍ ، نَا الْحُسَيْنُ بْنُ عَلِيِّ بْنِ الأَسْوَدِ ، نَا مُحَمَّدُ بْنُ فُضَيْلٍ ، نَا الأَعْمَشُ ، عَنْ إِبْرَاهِيمَ ، عَنِ الأَسْوَدِ ، عَنْ عُمَرَ بْنِ الْخَطَّابِ ، أَنَّهُ لَمَّا بَلَغَهُ قَوْلُ فَاطِمَةَ بِنْتِ قَيْسٍ ، قَالَ : " لا نَدَعُ كِتَابَ اللَّهِ لِقَوْلِ امْرَأَةٍ ، لَعَلَّهَا نَسِيَتْ " .
Aswad reports: When Umar bin Khattab (may Allah be pleased with him) came to know of the statement of Fatimah bint Qais (may Allah be pleased with her), he said: "We will not abandon the command of Allah's Book because of the statement of a woman; perhaps she has forgotten."
Hadith 3960
نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ يُوسُفَ بْنِ مَسْعَدَةَ ، نَا أَحْمَدُ بْنُ عِصَامِ بْنِ عَبْدِ الْمَجِيدِ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الأَسَدِيُّ وَهُوَ أَبُو أَحْمَدَ الزُّبَيْرِيُّ ، نَا عَمَّارُ بْنُ رُزَيْقٍ ، عَنْ أَبِي إِسْحَاقَ ، قَالَ : كُنْتُ مَعَ الأَسْوَدِ بْنِ يَزِيدَ جَالِسًا فِي الْمَسْجِدِ الأَعْظَمِ وَمَعَنَا الشَّعْبِيُّ ، فَحَدَّثَ الشَّعْبِيُّ بِحَدِيثِ فَاطِمَةَ بِنْتِ قَيْسٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " لَمْ يَجْعَلْ لَهَا سُكْنَى ، وَلا نَفَقَةً ، فَأَخَذَ الأَسْوَدُ كَفًّا مِنْ حَصَى فَحَصَبَهُ ، ثُمَّ قَالَ : وَيْلَكَ تُحَدِّثُ بِمِثْلِ هَذَا ، قَالَ عُمَرُ : لا نَتْرُكُ كِتَابَ اللَّهِ وَسُنَّةَ نَبِيِّنَا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِقَوْلِ امْرَأَةٍ لا نَدْرِي حَفِظَتْ أَوْ نَسِيَتْ ، لَهَا السُّكْنَى وَالنَّفَقَةُ ، قَالَ اللَّهُ تَعَالَى لا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ سورة الطلاق آية 1 الآيَةَ .
Abu Ishaq narrates: I was sitting with Aswad bin Yazid in the great mosque. Shu’bi was also present with us. Shu’bi narrated this hadith regarding Sayyida Fatimah bint Qais (may Allah be pleased with her) that the Prophet (peace and blessings be upon him) did not grant her the right to residence and maintenance. So Aswad, grabbing pebbles in his fist, threw them at Shu’bi and said: “Woe to you, you narrate such reports, while Sayyiduna Umar (may Allah be pleased with him) has said: We will not abandon the command of Allah’s Book and the Sunnah of our Prophet (peace and blessings be upon him) because of a woman’s statement, for we do not know whether that woman remembered (the matter) or forgot it. Such (thrice-divorced) women will be given residence and maintenance, because Allah has said: ‘Do not expel them from their houses, nor should they leave, except in case they commit a clear immorality.’”
Hadith 3961
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ يَحْيَى بْنِ سَعِيدٍ ، نَا يَحْيَى بْنُ آدَمَ ، نَا عَمَّارُ بْنُ رُزَيْقٍ ، عَنْ أَبِي إِسْحَاقَ ، عَنِ الشَّعْبِيِّ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ ، قَالَتْ : " طَلَّقَنِي زَوْجِي ثَلاثًا فَأَرَدْتُ النَّفَقَةَ ، فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " انْتَقِلِي إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ " ، قَالَ أَبُو إِسْحَاقَ : فَلَمَّا حَدَّثَ بِهِ الشَّعْبِيُّ حَصَبَهُ الأَسْوَدُ ، وَقَالَ : وَيْحَكَ تُحَدِّثُ ، أَوْ تُفْتِي بِمِثْلِ هَذَا ، قَدْ أَتَتْ عُمَرَ ، فَقَالَ : إِنْ جِئْتِ بِشَاهِدَيْنِ يَشْهَدَانِ أَنَّهُمَا سَمِعَاهُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَإِلا لَمْ نَتْرُكْ كِتَابَ اللَّهِ لِقَوْلِ امْرَأَةٍ لا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ سورة الطلاق آية 1 الآيَةَ . وَلَمْ يَقُلْ فِيهِ : وَسُنَّةَ نَبِيِّهِ ، وَهَذَا أَصَحُّ مِنَ الَّذِي قَبْلَهُ ، لأَنَّ هَذَا الْكَلامَ لا يُثْبَتُ ، وَيَحْيَى بْنُ آدَمَ أَحْفَظُ مِنْ أَبِي أَحْمَدَ الزُّبَيْرِيِّ وَأَثْبَتُ مِنْهُ ، وَاللَّهُ أَعْلَمُ . وَقَدْ تَابَعَهُ قَبِيصَةُ بْنُ عُقْبَةَ .
Lady Fatimah bint Qais (may Allah be pleased with her) narrates: My husband gave me three divorces. I sought maintenance. I went to the service of the Prophet (peace and blessings be upon him), and he said: "Move to the house of Ibn Umm Maktum (may Allah be pleased with him)." Abu Ishaq narrates: When Sha'bi narrated this narration, Aswad threw pebbles at him and said: Woe to you, are you narrating this narration or giving a fatwa based on it? That woman had also gone to the service of Sayyiduna Umar (may Allah be pleased with him). So Sayyiduna Umar (may Allah be pleased with him) said: If you bring two such witnesses who testify that they heard the Prophet (peace and blessings be upon him) say this, then fine, otherwise we will not abandon the command of Allah's Book because of the statement of one woman (the command is): "Do not expel them from their houses, nor should they leave, except in case they commit a clear immorality." In this narration, the narrator did not mention these words: and will not abandon the Sunnah (command) of our Prophet (peace and blessings be upon him). This narration is more authentic than the previous narration, because these words are not established. The narrator named Yahya is of greater memory and more reliable than Abu Ahmad Zubayri. Hadith 3962
نَا بِهِ عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ أَبِي سَعِيدٍ ، نَا السَّرِيُّ بْنُ يَحْيَى ، نَا قَبِيصَةُ ، نَا عَمَّارُ بْنُ رُزَيْقٍ ، عَنْ أَبِي إِسْحَاقَ ، مثل قَوْلِ يَحْيَى بْنِ آدَمَ سَوَاءً.
This narration is also transmitted with another chain of transmission.
Hadith 3963
نَا أَبُو أَحْمَدَ الْقَاسِمُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ بِلَيْلٍ الزَّعْفَرَانِيُّ ، نَا أَحْمَدُ بْنُ مُحَمَّدٍ الشَّعْبِيُّ ، نَا الْقَاسِمُ بْنُ الْحَكَمِ ، نَا الْحَسَنُ بْنُ عُمَارَةَ ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ ، عَنْ عَبْدِ اللَّهِ بْنِ الْخَلِيلِ الْحَضْرَمِيُّ ، قَالَ : ذُكِرَ لِعُمَرَ بْنِ الْخَطَّابِ ، قَوْلُ فَاطِمَةَ بِنْتِ قَيْسٍ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " لَمْ يَجْعَلْ لَهَا السُّكْنَى وَلا النَّفَقَةَ ، فَقَالَ عُمَرُ : لا نَدَعُ كِتَابَ اللَّهِ وَسُنَّةَ نَبِيِّهِ لِقَوْلِ امْرَأَةٍ " ، الْحَسَنُ بْنُ عُمَارَةَ مَتْرُوكٌ.
Abdullah bin Khalil Hadrami narrates: The statement of Sayyidah Fatimah bint Qais (may Allah be pleased with her) was mentioned before Sayyiduna Umar bin Khattab (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) did not grant her the right to residence and maintenance. So Sayyiduna Umar (may Allah be pleased with him) said: "We will not abandon the Book of Allah and the Sunnah of His Prophet (peace and blessings of Allah be upon him) because of the statement of a woman." The narrator named Hasan bin Ammarah is abandoned.
Hadith 3964
نَا نَا الْحَسَنُ بْنُ الْخَضِرِ ، بِمِصْرَ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ يُونُسَ أَبُو كُرَيْبٍ ، نَا حَفْصُ بْنُ غِيَاثٍ ، عَنْ أَشْعَثَ ، عَنِ الْحَكَمِ ، وَحَمَّادٍ ، عَنْ إِبْرَاهِيمَ ، عَنِ الأَسْوَدِ ، عَنْ عُمَرَ ، قَالَ : " لا نَدَعُ كِتَابَ اللَّهِ وَسُنَّةَ نَبِيِّنَا لِقَوْلِ امْرَأَةٍ : الْمُطَلَّقَةُ ثَلاثًا لَهَا السُّكْنَى وَالنَّفَقَةُ " ، أَشْعَثُ بْنُ سَوَّارٍ ، ضَعِيفُ الْحَدِيثِ . وَرَوَاهُ الأَعْمَشُ ، عَنْ إِبْرَاهِيمَ ، عَنِ الأَسْوَدِ وَلَمْ يَقُلْ : " وَسُنَّةَ نَبِيِّنَا " . وَقَدْ كَتَبْنَاهُ قَبْلَ هَذَا ، وَالأَعْمَشُ أَثْبَتُ مِنْ أَشْعَثَ ، وَأَحْفَظُ مِنْهُ .
Aswad narrates this statement from Sayyiduna Umar (may Allah be pleased with him): "We will not abandon the Book of Allah and the Sunnah of His Noble Prophet (peace be upon him) because of the statement of any woman; a woman who has been given three divorces will receive residence and maintenance." The narrator named Ash'ath bin Sawar is weak. A'mash has narrated this from Aswad on the authority of Ibrahim, and in it, these words are not mentioned: "and the Sunnah of our Noble Prophet (peace be upon him)." But we have already noted this narration before: A'mash is more reliable and a greater memorizer of hadith than Ash'ath.
Hadith 3965
نَا ابْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ عُمَرَ بْنِ وَلِيدٍ ، نَا أَسْبَاطُ بْنُ مُحَمَّدٍ . ح وَنا إِبْرَاهِيمُ بْنُ حَمَّادٍ ، نَا الْحُسَيْنُ بْنُ عَلِيِّ بْنِ الأَسْوَدِ ، نَا مُحَمَّدُ بْنُ فُضَيْلٍ ، قَالا : نَا الأَعْمَشُ ، عَنْ إِبْرَاهِيمَ ، عَنِ الأَسْوَدِ ، عَنْ عُمَرَ ، وَقَدْ كَتَبْتُ لَفْظَهُ قَبْلَ هَذَا.

Hadith 3966
نَا أَبُو الْقَاسِمِ عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، نَا أَبُو الْجَهْمِ الْعَلاءُ بْنُ مُوسَى ، نَا لَيْثُ بْنُ سَعْدٍ ، عَنْ نَافِعٍ ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ ، " طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً وَاحِدَةً ، فَأَمَرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُرَاجِعَهَا ، ثُمَّ يُمْسِكَهَا حَتَّى تَطْهُرَ ، ثُمَّ تَحِيضَ عِنْدَهُ حَيْضَةً أُخْرَى ، ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ مِنْ حَيْضَتِهَا ، فَإِنْ أَرَادَ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا حِينَ تَطْهُرُ مِنْ قَبْلِ أَنْ يُجَامِعَهَا فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ تَعَالَى بِهَا أَنْ تُطَلَّقَ لَهَا النِّسَاءُ ، قَالَ : وَكَانَ عَبْدُ اللَّهِ بْنُ عُمَرَ إِذَا سُئِلَ عَنْ ذَلِكَ ، قَالَ : أَمَّا أَنْتَ طَلَّقْتَ امْرَأَتَكَ تَطْلِيقَةً أَوْ تَطْلِيقَتَيْنِ ، فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَنِي بِهَذَا ، وَإِنْ كُنْتَ طَلَّقْتَهَا ثَلاثًا فَقَدْ حُرِّمَتْ عَلَيْكَ ، حَتَّى تَنْكِحَ زَوْجًا غَيْرَكَ ، وَعَصَيْتَ اللَّهَ فِيمَا أَمَرَكَ مِنْ طَلاقِ امْرَأَتِكَ " .
Nafi’ narrates: Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) divorced his wife while she was in her menstrual period. The Prophet Muhammad (peace and blessings be upon him) instructed him: “Take her back, then leave her as she is until she becomes pure, then when she experiences her next menstruation, leave her as she is until she becomes pure from that menstruation. Then, if you wish to divorce her, divorce her while she is pure, before you have had intercourse with her. This is the method about which Allah Almighty has commanded that women should be divorced accordingly.” The narrator states: When Sayyiduna Abdullah bin Umar was asked about this matter, he would say: “If you have given your wife one or two divorces (then you should take her back), because the Prophet Muhammad (peace and blessings be upon him) commanded me to do so. But if you have given her three divorces, then she is forbidden for you until she marries another man and becomes divorced or widowed. You have disobeyed Allah regarding the command He gave you about divorcing your wife.”
Hadith 3967
نَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الْبَزَّازُ ، نَا الْحَسَنُ بْنُ عَرَفَةَ . ح وَنا أَحْمَدُ بْنُ الْحُسَيْنِ بْنِ مُحَمَّدِ بْنِ أَحْمَدَ بْنِ الْجُنَيْدِ ، نَا زِيَادُ بْنُ أَيُّوبَ ، قَالا : نَا إِسْمَاعِيلُ بْنُ عُلَيَّةَ ، نَا أَيُّوبُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ ، وَقَالَ ابْنُ عَرَفَةَ : إِنَّ ابْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً وَهِيَ حَائِضٌ ، فَسَأَلَ عُمَرُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَمَرَهُ أَنْ يُرَاجِعَهَا ثُمَّ يُمْهِلَهَا حَتَّى تَحِيضَ حَيْضَةً أُخْرَى ، ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ ، ثُمَّ يُطَلِّقَهَا قَبْلَ أَنْ يَمَسَّهَا ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ ، قَالَ : وَكَانَ ابْنُ عُمَرَ إِذَا سُئِلَ عَنِ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ وَهِيَ حَائِضٌ ، يَقُولُ : أَمَّا أَنْتَ طَلَّقْتَهَا طَلْقَةً وَاحِدَةً أَوِ اثْنَتَيْنِ ، فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَمَرَهُ أَنْ يُرَاجِعَهَا ، ثُمَّ يُمْهِلَهَا حَتَّى تَحِيضَ حَيْضَةً أُخْرَى ، ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ ، ثُمَّ يُطَلِّقَهَا قَبْلَ أَنْ يَمَسَّهَا ، وَأَمَّا أَنْتَ طَلَّقْتَهَا ثَلاثًا فَقَدْ عَصَيْتَ اللَّهَ تَعَالَى فِيمَا أَمَرَكَ بِهِ مِنْ طَلاقِ امْرَأَتِكَ ، وَبَانَتْ مِنْكَ " .
Nafi’ reports: Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) divorced his wife while she was in her menstrual period. The narrator named Ibn ‘Urfa reports: Sayyiduna Abdullah bin Umar gave his wife one divorce while she was in her menstrual period. After this, both narrators transmitted these words: Sayyiduna Umar (may Allah be pleased with him) asked the Prophet (peace and blessings be upon him) about this matter, so the Prophet (peace and blessings be upon him) instructed (Ibn Umar) to take his wife back, then leave her as she is until she experiences her next menstrual period, then leave her as she is until she becomes pure, then before having intercourse with her, divorce her. This is the method about which Allah Almighty has commanded that women should be divorced accordingly. The narrator reports: When Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) was asked about a person who divorced his wife during her menstrual period, Sayyiduna Ibn Umar would say: “If you have given one or two divorces, then the Prophet (peace and blessings be upon him) has instructed regarding such a person that he should take his wife back, then leave her as she is until she experiences her next menstrual period, then leave her as she is until she becomes pure, then before having intercourse with her, divorce her. If you have given your wife three divorces, then you have disobeyed what Allah has commanded you regarding divorcing your wife, and your wife has become irrevocably separated from you.”
