Hadith 3197

حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ، عَنْ عَلِيِّ بْنِ مُسْهِرٍ، عَنْ أَشْعَثَ، عَنْ الشَّعْبِيِّ، عَنْ عَلِيٍّ، وَعُمَرَ، وَزَيْدٍ، قَالُوا: "الْوَالِدُ يَجُرُّ وَلَاءَ وَلَدِهِ".
It is narrated from Imam Sha'bi (may Allah have mercy on him) that Sayyiduna Ali, Sayyiduna Umar, and Sayyiduna Zaid (may Allah be pleased with them) said: The father will draw the wala’ (allegiance) of his son towards himself.

Brief Explanation
(Commentary on Hadith 3196)

Regarding the inheritance of the wala’ (allegiance) of a slave, the correct position is that if he has no blood relative as an heir, then the owner of the slave will inherit all of his wealth.

In this chapter, it is mentioned that the father can inherit the wala’ of the son, and the grandfather can inherit the wala’ of the father.
