باب في الْعَبْدِ يَكُونُ بَيْنَ الرَّجُلَيْنِ فَيَعْتِقُ أَحَدُهُمَا نَصِيبَهُ:
Chapter on a slave owned by two men, and one frees his share
Sunan ad-Darimi 3173 — on a slave owned by two men, and one frees
حَدَّثَنَا هَارُونُ بْنُ مُعَاوِيَةَ، عَنْ أَبِي سُفْيَانَ الْمَعْمَرِيِّ، عَنْ مَعْمَرٍ، عَنْ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ: فِي عَبْدٍ بَيْنَ رَجُلَيْنِ، أَعْتَقَ أَحَدَهُمَا نَصِيبَهُ وَأَمْسَكَهُ الْآخَرُ، قَالَ: "مِيرَاثُهُ بَيْنَهُمَا".
Ibn Tawus narrated from his father: If a slave is owned between two men (i.e., is the slave of two people), and one of them frees his share while the other withholds, Tawus (may Allah have mercy on him) said: His inheritance will be divided between both (owners).
