(403) بَابُ ذِكْرِ الدَّلِيلِ عَلَى أَنَّ الشَّيْخَ الْكَبِيرَ إِذَا اسْتَفَادَ مَالًا بَعْدَ كِبَرِ السِّنِّ وَهُوَ غَنِيٌّ، أَوِ اسْتَفَادَ مَالًا بَعْدَ الْإِسْلَامِ كَانَ فَرْضُ الْحَجِّ وَاجِبًا عَلَيْهِ وَإِنْ كَانَ غَيْرَ مُسْتَطِيعٍ أَنْ يَحُجَّ بِنَفْسِهِ،
Evidence that if an elderly person gains wealth after old age or after Islam, Hajj becomes obligatory even if unable to perform it personally.

حَدَّثَنَا عَبْدُ الْجَبَّارِ بْنُ الْعَلاءِ ، حَدَّثَنَا سُفْيَانُ ، قَالَ : سَمِعْتُ الزُّهْرِيَّ . ح وحَدَّثَنَا الْمَخْزُومِيُّ ، حَدَّثَنَا سُفْيَانُ . ح وحَدَّثَنَا عَلِيُّ بْنُ خَشْرَمٍ ، أَخْبَرَنَا ابْنُ عُيَيْنَةَ ، عَنِ الزُّهْرِيِّ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنِ ابْنِ عَبَّاسٍ ، أَنَّ امْرَأَةً مِنْ خَثْعَمٍ ، سَأَلَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غَدَاةَ النَّحْرِ ، وَالْفَضْلُ رِدْفُهُ ، فَقَالَتْ : يَا رَسُولَ اللَّهِ ، إِنَّ فَرِيضَةَ اللَّهِ فِي الْحَجِّ عَلَى عِبَادِهِ أَدْرَكَتْ أَبِي شَيْخًا كَبِيرًا لا يَسْتَطِيعُ أَنْ يَسْتَمْسِكُ عَلَى الرَّاحِلَةِ ، هَلْ تَرَى أَنْ أَحُجَّ عَنْهُ ؟ قَالَ : " نَعَمْ " ، وَقَالَ الْمَخْزُومِيُّ : غَدَاةَ جَمْعٍ ، وَقَالَ : أَنَّ أَحُجَّ عَنْهُ ، لَمْ يَقُلْ : وَالْفَضْلُ رِدْفُهُ ، وَلَفْظُ ابْنِ خَشْرَمٍ فِي الْمَتْنِ مِثْلُ حَدِيثِ عَبْدِ الْجَبَّارِ ، غَيْرَ أَنَّهُ قَالَ : أَفَأَحُجُّ عَنْهُ ؟ قَالَ : " نَعَمْ "
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that on the morning of the Day of Sacrifice, a woman from the tribe of Khath’am asked the Messenger of Allah (peace be upon him) while Sayyiduna Fadl (may Allah be pleased with him) himself was riding behind him on the mount. She said, “O Messenger of Allah, Allah has made Hajj obligatory upon His servants. My elderly father is not able to sit firmly on a mount. What do you command? Should I perform Hajj on his behalf?” The Prophet (peace be upon him) said: “Yes.” In the narration of Makhzumi, it is mentioned: on the morning of Muzdalifah. And it is said: Should I perform Hajj on his behalf? And it is not narrated that Sayyiduna Fadl (may Allah be pleased with him) was riding behind you. The wording of the narration of Ali bin Khushram is the same as that of Abdul Jabbar’s narration, except for this difference: Should I perform Hajj on his behalf? The Prophet (peace be upon him) said: “Yes.”
