وحدثنا
إِسْحَاقَ بْنُ إِبْرَاهِيمَ الْحَنْظَلِيُّ ،
وَمُحَمَّدُ بْنُ أَبِي عُمَرَ ، وَتَقَارَبَا فِي لَفْظِ الْحَدِيثِ ، قَالَ ابْنُ أَبِي عُمَرَ : حدثنا ، وقَالَ إِسْحَاقَ : أَخْبَرَنا
عَبْدُ الرَّزَّاقِ ، أَخْبَرَنا
مَعْمَرٌ ، عَنِ
الزُّهْرِيِّ ، عَنْ
عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي ثَوْرٍ ، عَنِ
ابْنِ عَبَّاسٍ ، قَالَ : لَمْ أَزَلْ حَرِيصًا أَنْ أَسْأَلَ
عُمَرَ ، عَنِ الْمَرْأَتَيْنِ مِنْ أَزْوَاجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : اللَّتَيْنِ ، قَالَ اللَّهُ تَعَالَى : إِنْ تَتُوبَا إِلَى اللَّهِ فَقَدْ صَغَتْ قُلُوبُكُمَا سورة التحريم آية 4 ، حَتَّى حَجَّ عُمَرُ ، وَحَجَجْتُ مَعَهُ ، فَلَمَّا كُنَّا بِبَعْضِ الطَّرِيقِ عَدَلَ عُمَرُ ، وَعَدَلْتُ مَعَهُ بِالْإِدَاوَةِ فَتَبَرَّزَ ثُمَّ أَتَانِي ، فَسَكَبْتُ عَلَى يَدَيْهِ فَتَوَضَّأَ ، فَقُلْتُ : يَا أَمِيرَ الْمُؤْمِنِينَ ، " مَنِ الْمَرْأَتَانِ مِنْ أَزْوَاجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اللَّتَانِ قَالَ اللَّهُ عَزَّ وَجَلَّ لَهُمَا : إِنْ تَتُوبَا إِلَى اللَّهِ فَقَدْ صَغَتْ قُلُوبُكُمَا سورة التحريم آية 4 ، قَالَ عُمَرُ : وَاعَجَبًا لَكَ يَا ابْنَ عَبَّاسٍ ، قَالَ الزُّهْرِيُّ : كَرِهَ وَاللَّهِ مَا سَأَلَهُ عَنْهُ وَلَمْ يَكْتُمْهُ ، قَالَ : هِيَ حَفْصَةُ ، وَعَائِشَةُ " ، ثُمَّ أَخَذَ يَسُوقُ الْحَدِيثَ ، قَالَ : كُنَّا مَعْشَرَ قُرَيْشٍ قَوْمًا نَغْلِبُ النِّسَاءَ ، فَلَمَّا قَدِمْنَا الْمَدِينَةَ ، وَجَدْنَا قَوْمًا تَغْلِبُهُمْ نِسَاؤُهُمْ ، فَطَفِقَ نِسَاؤُنَا يَتَعَلَّمْنَ مِنْ نِسَائِهِمْ ، قَالَ : وَكَانَ مَنْزِلِي فِي بَنِي أُمَيَّةَ بْنِ زَيْدٍ بِالْعَوَالِي ، فَتَغَضَّبْتُ يَوْمًا عَلَى امْرَأَتِي ، فَإِذَا هِيَ تُرَاجِعَنِي ، فَأَنْكَرْتُ أَنْ تُرَاجِعَنِي ، فقَالَت : مَا تُنْكِرُ أَنْ أُرَاجِعَكَ ، فَوَاللَّهِ إِنَّ أَزْوَاجَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَيُرَاجِعْنَهُ وَتَهْجُرُهُ إِحْدَاهُنَّ الْيَوْمَ إِلَى اللَّيْلِ ، فَانْطَلَقْتُ فَدَخَلْتُ عَلَى حَفْصَةَ ، فَقُلْتُ : أَتُرَاجِعِينَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ ، فقَالَت : نَعَمْ ، فَقُلْتُ : أَتَهْجُرُهُ إِحْدَاكُنَّ الْيَوْمَ إِلَى اللَّيْلِ ؟ ، قَالَت : نَعَمْ ، قُلْتُ : قَدْ خَابَ مَنْ فَعَلَ ذَلِكَ مِنْكُنَّ وَخَسِرَ ، أَفَتَأْمَنُ إِحْدَاكُنَّ أَنْ يَغْضَبَ اللَّهُ عَلَيْهَا لِغَضَبِ رَسُولِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَإِذَا هِيَ قَدْ هَلَكَتْ ، لَا تُرَاجِعِي رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَا تَسْأَلِيهِ شَيْئًا وَسَلِينِي مَا بَدَا لَكِ ، وَلَا يَغُرَّنَّكِ أَنْ كَانَتْ جَارَتُكِ هِيَ أَوْسَمَ وَأَحَبَّ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْكِ ، يُرِيدُ عَائِشَةَ ، قَالَ : وَكَانَ لِي جَارٌ مِنَ الْأَنْصَارِ ، فَكُنَّا نَتَنَاوَبُ النُّزُولَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَيَنْزِلُ يَوْمًا وَأَنْزِلُ يَوْمًا ، فَيَأْتِينِي بِخَبَرِ الْوَحْيِ وَغَيْرِهِ وَآتِيهِ بِمِثْلِ ذَلِكَ ، وَكُنَّا نَتَحَدَّثُ أَنَّ غَسَّانَ تُنْعِلُ الْخَيْلَ لِتَغْزُوَنَا فَنَزَلَ صَاحِبِي ثُمَّ أَتَانِي عِشَاءً ، فَضَرَبَ بَابِي ثُمَّ نَادَانِي ، فَخَرَجْتُ إِلَيْهِ ، فقَالَ : حَدَثَ أَمْرٌ عَظِيمٌ ، قُلْتُ مَاذَا ، أَجَاءَتْ غَسَّانُ ؟ قَالَ : لَا بَلْ أَعْظَمُ مِنْ ذَلِكَ وَأَطْوَلُ : طَلَّقَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نِسَاءَهُ ، فَقُلْتُ : قَدْ خَابَتْ حَفْصَةُ وَخَسِرَتْ ، قَدْ كُنْتُ أَظُنُّ هَذَا كَائِنًا حَتَّى إِذَا صَلَّيْتُ الصُّبْحَ شَدَدْتُ عَلَيَّ ثِيَابِي ، ثُمَّ نَزَلْتُ فَدَخَلْتُ عَلَى حَفْصَةَ وَهِيَ تَبْكِي ، فَقُلْتُ : أَطَلَّقَكُنَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ فقَالَت : لَا أَدْرِي هَا هُوَ ذَا مُعْتَزِلٌ فِي هَذِهِ الْمَشْرُبَةِ ، فَأَتَيْتُ غُلَامًا لَهُ أَسْوَدَ ، فَقُلْتُ : اسْتَأْذِنْ لِعُمَرَ ، فَدَخَلَ ثُمَّ خَرَجَ إِلَيَّ ، فقَالَ : قَدْ ذَكَرْتُكَ لَهُ فَصَمَتَ ، فَانْطَلَقْتُ حَتَّى انْتَهَيْتُ إِلَى الْمِنْبَرِ فَجَلَسْتُ ، فَإِذَا عَنْدَهُ رَهْطٌ جُلُوسٌ يَبْكِي بَعْضُهُمْ ، فَجَلَسْتُ قَلِيلًا ، ثُمَّ غَلَبَنِي مَا أَجِدُ ، ثُمَّ أَتَيْتُ الْغُلَامَ ، فَقُلْتُ : اسْتَأْذِنْ لِعُمَرَ ، فَدَخَلَ ثُمَّ خَرَجَ إِلَيَّ ، فقَالَ : قَدْ ذَكَرْتُكَ لَهُ فَصَمَتَ فَوَلَّيْتُ مُدْبِرًا ، فَإِذَا الْغُلَامُ يَدْعُونِي ، فقَالَ : ادْخُلْ فَقَدْ أَذِنَ لَكَ ، فَدَخَلْتُ فَسَلَّمْتُ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَإِذَا هُوَ مُتَّكِئٌ عَلَى رَمْلِ حَصِيرٍ قَدْ أَثَّرَ فِي جَنْبِهِ ، فَقُلْتُ : أَطَلَّقْتَ يَا رَسُولَ اللَّهِ نِسَاءَكَ ؟ فَرَفَعَ رَأْسَهُ إِلَيَّ ، وَقَالَ : " لَا " ، فَقُلْتُ : اللَّهُ أَكْبَرُ لَوْ رَأَيْتَنَا يَا رَسُولَ اللَّهِ ، وَكُنَّا مَعْشَرَ قُرَيْشٍ قَوْمًا نَغْلِبُ النِّسَاءَ فَلَمَّا قَدِمْنَا الْمَدِينَةَ وَجَدْنَا قَوْمًا تَغْلِبُهُمْ نِسَاؤُهُمْ فَطَفِقَ نِسَاؤُنَا يَتَعَلَّمْنَ مِنْ نِسَائِهِمْ ، فَتَغَضَّبْتُ عَلَى امْرَأَتِي يَوْمًا فَإِذَا هِيَ تُرَاجِعَنِي ، فَأَنْكَرْتُ أَنْ تُرَاجِعَنِي ، فقَالَت : مَا تُنْكِرُ أَنْ أُرَاجِعَكَ ، فَوَاللَّهِ إِنَّ أَزْوَاجَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَيُرَاجِعْنَهُ وَتَهْجُرُهُ إِحْدَاهُنَّ الْيَوْمَ إِلَى اللَّيْلِ ، فَقُلْتُ : قَدْ خَابَ مَنْ فَعَلَ ذَلِكِ مِنْهُنَّ وَخَسِرَ ، أَفَتَأْمَنُ إِحْدَاهُنَّ أَنْ يَغْضَبَ اللَّهُ عَلَيْهَا لِغَضَبِ رَسُولِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَإِذَا هِيَ قَدْ هَلَكَتْ ، فَتَبَسَّمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقُلْتُ : يَا رَسُولَ اللَّهِ ، قَدْ دَخَلْتُ عَلَى حَفْصَةَ ، فَقُلْتُ : لَا يَغُرَّنَّكِ أَنْ كَانَتْ جَارَتُكِ هِيَ أَوْسَمُ مِنْكِ وَأَحَبُّ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْكِ ، فَتَبَسَّمَ أُخْرَى ، فَقُلْتُ : أَسْتَأْنِسُ يَا رَسُولَ اللَّهِ ، قَالَ : " نَعَمْ " ، فَجَلَسْتُ فَرَفَعْتُ رَأْسِي فِي الْبَيْتِ فَوَاللَّهِ مَا رَأَيْتُ فِيهِ شَيْئًا يَرُدُّ الْبَصَرَ إِلَّا أُهَبًا ثَلَاثَةً ، فَقُلْتُ : ادْعُ اللَّهَ يَا رَسُولَ اللَّهِ ، أَنْ يُوَسِّعَ عَلَى أُمَّتِكَ فَقَدْ وَسَّعَ عَلَى فَارِسَ ، وَالرُّومِ ، وَهُمْ لَا يَعْبُدُونَ اللَّهَ ، فَاسْتَوَى جَالِسًا ، ثُمَّ قَالَ : " أَفِي شَكٍّ أَنْتَ يَا ابْنَ الْخَطَّابِ " ، أُولَئِكَ قَوْمٌ عُجِّلَتْ لَهُمْ طَيِّبَاتُهُمْ فِي الْحَيَاةِ الدُّنْيَا " ، فَقُلْتُ : اسْتَغْفِرْ لِي يَا رَسُولَ اللَّهِ ، وَكَانَ أَقْسَمَ أَنْ لَا يَدْخُلَ عَلَيْهِنَّ شَهْرًا مِنْ شِدَّةِ مَوْجِدَتِهِ عَلَيْهِنَّ ، حَتَّى عَاتَبَهُ اللَّهُ عَزَّ وَجَلَّ .
Mu’ammar narrated from Zuhri, who narrated from ‘Ubaydullah bin ‘Abdullah bin Abi Thawr, who narrated from Ibn ‘Abbas (may Allah be pleased with them), who said: I was very eager to ask ‘Umar (may Allah be pleased with him) about those two wives of the Prophet (peace and blessings be upon him) regarding whom Allah, the Exalted, said: “If you two turn in repentance to Allah, then indeed your hearts have inclined (to the truth)” until ‘Umar (may Allah be pleased with him) performed Hajj and I also performed Hajj with him. (On the way back) we were in a part of the road when ‘Umar (may Allah be pleased with him) turned aside (for his need) and I also turned aside with a water vessel. He went into the desert, then came to me, so I poured water on his hands and he performed ablution. I said: O Commander of the Faithful! Who were those two wives among the wives of the Prophet (peace and blessings be upon him) about whom Allah, the Exalted, said: “If you two turn in repentance to Allah, then indeed your hearts have inclined (to the truth)?” ‘Umar (may Allah be pleased with him) said: Ibn ‘Abbas! I am amazed at you! ... Zuhri said: By Allah! The question he (Ibn ‘Abbas) asked him displeased him, and he did not conceal (the answer). He said: They were Hafsah and ‘A’ishah (may Allah be pleased with them). Then ‘Umar (may Allah be pleased with him) began to narrate and said: We, the people of Quraysh, were a people who used to dominate our women. When we came to Madinah, we found a people whose women dominated them, so our women began to learn from their women (and started replying to men). ‘Umar (may Allah be pleased with him) said: My house was in the upper area in the neighborhood of Banu Umayyah bin Zayd. One day I became angry with my wife, and she replied to me. I found her reply very unpleasant, so she said: Do you find it unpleasant that I reply to you? By Allah! The wives of the Prophet (peace and blessings be upon him) also reply to him, and one of them even keeps away from him for the whole day until night (remaining upset). I went to Hafsah (may Allah be pleased with her) and said: Do you reply to the Messenger of Allah (peace and blessings be upon him)? She said: Yes. I (then) asked: Does any of you keep away from him for the whole day until night? She said: Yes! I said: Whoever among you does that has failed and incurred loss. Does any of you feel secure that, due to the anger of the Messenger of Allah (peace and blessings be upon him), Allah will not become angry with her and she will be ruined? (In the future) do not reply to the Messenger of Allah (peace and blessings be upon him) and do not ask him for anything; whatever you need, ask me. Do not let it deceive you that your neighbor (co-wife) is more beautiful than you and more beloved to the Messenger of Allah (peace and blessings be upon him). He meant ‘A’ishah (may Allah be pleased with her). ‘Umar (may Allah be pleased with him) said: ... I had a neighbor from among the Ansar ... We used to take turns going down (from the upper area) to the Messenger of Allah (peace and blessings be upon him). One day he would go down and one day I would go down. He would bring me news of revelation and so on, and I would bring him similar news on my day. (In those days) we were talking among ourselves that the Ghassanids were preparing their horses to fight us. My companion went down (from ‘Awali to the Messenger of Allah, peace and blessings be upon him), then came to me at nightfall, knocked on my door, and called me. I came out and he said: A great event has occurred. I asked: What happened? Have the Ghassanids come? He said: No, but it is even greater and more serious than that. The Prophet (peace and blessings be upon him) has divorced his wives. I said: Hafsah has failed and incurred loss. I already thought this was going to happen. (The next day) when I had performed the morning prayer, I put on my clothes, came to Madinah, and went to Hafsah. She was crying. I asked: Did the Messenger of Allah (peace and blessings be upon him) divorce all of you? She said: I do not know, but he is secluded in that upper room. I went to his black slave and said: Ask permission for ‘Umar. He went in, then came out to me and said: I mentioned you to the Prophet (peace and blessings be upon him), but he remained silent. I went away until I sat by the pulpit, and there were many people sitting there, some of them weeping. I sat for a while, then the state that had overcome me overwhelmed me again. I went to the slave and said: Ask permission for ‘Umar. He entered, then came out to me and said: I mentioned you to the Prophet (peace and blessings be upon him), but he remained silent. I turned away, and suddenly the slave called me and said: Enter, for the Prophet (peace and blessings be upon him) has given you permission. I entered, greeted the Messenger of Allah (peace and blessings be upon him), and saw that he was reclining on a mat made of palm fibers, which had left marks on his side. I said: O Messenger of Allah, have you divorced your wives? He raised his blessed head towards me and said: “No.” I said: Allah is the Greatest. O Messenger of Allah! If you had seen us, we Quraysh were a people who used to dominate our women. When we came to Madinah, we found a people whose women dominated them, so our women began to learn from their women (and started replying to men). One day I became angry with my wife, and she replied to me. I found her reply extremely unpleasant. She said: Do you find it unpleasant that I reply to you? By Allah! The wives of the Prophet (peace and blessings be upon him) also reply to him, and one of them even keeps away from him until night (remaining upset). So I said: Whoever among them does that has failed and incurred loss. Can any of them feel secure that, by doing this, Allah will not become angry with her due to the anger of His Messenger, and she will be ruined? At this, the Messenger of Allah (peace and blessings be upon him) smiled. So I said: O Messenger of Allah! I went to Hafsah and said to her: Do not let it deceive you that your neighbor (co-wife) is more beautiful than you and more beloved to the Messenger of Allah (peace and blessings be upon him). At this, he smiled again. So I said: O Messenger of Allah! (May I sit and) talk with you? He said: “Yes.” So I sat down and looked around the house, and by Allah! I saw nothing in it except three hides. I said: O Messenger of Allah! Pray to Allah to grant abundance to your Ummah. The Persians and Romans have been given abundance, even though they do not worship Allah, the Exalted. At this, the Prophet (peace and blessings be upon him) sat up straight and said: “O son of al-Khattab! Are you in doubt? They are people whose good things have been hastened for them in this world.” I said: O Messenger of Allah! Seek forgiveness for me. And you had sworn, due to your intense anger at them (your wives), that you would not go to them for a month, until Allah, the Exalted, admonished you (for being grieved at your wives’ words and for vowing to abstain from lawful things).
Hadith 1475

الزُّهْرِيُّ : فَأَخْبَرَنِي
عُرْوَةُ ، عَنْ
عَائِشَةَ ، قَالَت : لَمَّا مَضَى تِسْعٌ وَعِشْرُونَ لَيْلَةً دَخَلَ عَلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، بَدَأَ بِي ، فَقُلْتُ : يَا رَسُولَ اللَّهِ ، إِنَّكَ أَقْسَمْتَ أَنْ لَا تَدْخُلَ عَلَيْنَا شَهْرًا ، وَإِنَّكَ دَخَلْتَ مِنْ تِسْعٍ وَعِشْرِينَ أَعُدُّهُنَّ ، فقَالَ : " إِنَّ الشَّهْرَ تِسْعٌ وَعِشْرُونَ " ، ثُمَّ قَالَ : " يَا عَائِشَةُ ، إِنِّي ذَاكِرٌ لَكِ أَمْرًا ، فَلَا عَلَيْكِ أَنْ لَا تَعْجَلِي فِيهِ حَتَّى تَسْتَأْمِرِي أَبَوَيْكِ " ، ثُمَّ قَرَأَ عَلَيَّ الْآيَةَ : يَأَيُّهَا النَّبِيُّ قُلْ لأَزْوَاجِكَ ، حَتَّى بَلَغَ أَجْرًا عَظِيمًا سورة الأحزاب آية 28 - 29 ، قَالَت عَائِشَةُ : قَدْ عَلِمَ وَاللَّهِ أَنَّ أَبَوَيَّ لَمْ يَكُونَا لِيَأْمُرَانِي بِفِرَاقِهِ ، قَالَت : فَقُلْتُ : أَوَ فِي هَذَا أَسْتَأْمِرُ أَبَوَيَّ ، فَإِنِّي أُرِيدُ اللَّهَ وَرَسُولَهُ وَالدَّارَ الْآخِرَةَ ، قَالَ
مَعْمَرٌ : فَأَخْبَرَنِي
أَيُّوبُ : أَنَّ
عَائِشَةَ قَالَت : لَا تُخْبِرْ نِسَاءَكَ أَنِّي اخْتَرْتُكَ ، فقَالَ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّ اللَّهَ أَرْسَلَنِي مُبَلِّغًا وَلَمْ يُرْسِلْنِي مُتَعَنْتًا " ، قَالَ قَتَادَةُ : صَغَتْ قُلُوبُكُمَا مَالَتْ قُلُوبُكُمَا .
Zuhri said: 'Urwa informed me that 'A'isha (Allah be pleased with her) said: When twenty-nine nights were over, Allah's Messenger (ﷺ) visited me, and he began (his visit) with me. I said: Messenger of Allah, you had taken an oath that you would not visit us for a month, while you have visited after I have counted only twenty-nine (nights). Thereupon he said: The month may also be of twenty-nine (days). He then said: 'A'isha, I am going to talk to you about a matter, and you should not be hasty in it (and do not give your final decision) until you have consulted your parents. He then recited this verse to me: "O Prophet, say to your wives" till he reached "mighty reward" (xxxiii. 28). 'A'isha (Allah be pleased with her) said: By Allah, he knew that my parents would not allow me to separate from him. I said: Is there any need to consult my parents in this matter? I in fact choose Allah and His Messenger (ﷺ) and the abode in the Hereafter. Ma'mar said: Ayyub reported to me that 'A'isha said: Don't inform your wives that I have chosen you, whereupon Allah's Apostle (ﷺ) said: Verily Allah has sent me as a conveyer of message, and He has not sent me as a source of hardship (to others). Qatada said: "Saghat qulubukum" means "Your hearts have inclined."
Hadith 1480
Hassan ibn Ali al-Hulwani and Abd ibn Humaid, both from Ya'qub ibn Ibrahim ibn Sa'd, narrated to us; my father narrated to us, from Salih, from Ibn Shihab, that Abu Salamah ibn Abd al-Rahman ibn Awf informed him: that Fatimah bint Qays informed him: that she was married to Abu Amr ibn Hafs ibn al-Mughira, and he divorced her with the last of three divorces. She claimed that she went to the Messenger of Allah, peace and blessings be upon him, seeking his verdict regarding her leaving her house, "so he ordered her to move to Ibn Umm Maktum, the blind man." Marwan refused to believe her regarding the divorced woman leaving her house, and Urwah said: Aisha rejected that from Fatimah bint Qays.

عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ : أَنَّ أَبَا عَمْرِو بْنَ حَفْصِ بْنِ الْمُغِيرَةِ خَرَجَ مَعَ عَلِيِّ بْنِ أَبِي طَالِبٍ إِلَى الْيَمَنِ ، فَأَرْسَلَ إِلَى امْرَأَتِهِ
فَاطِمَةَ بِنْتِ قَيْسٍ بِتَطْلِيقَةٍ كَانَتْ بَقِيَتْ مِنْ طَلَاقِهَا ، وَأَمَرَ لَهَا الْحَارِثَ بْنَ هِشَامٍ ، وَعَيَّاشَ بْنَ أَبِي رَبِيعَةَ بِنَفَقَةٍ ، فقَالَا لَهَا : وَاللَّهِ مَا لَكِ نَفَقَةٌ ، إِلَّا أَنْ تَكُونِي حَامِلًا ، فَأَتَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرَتْ لَهُ قَوْلَهُمَا ، فقَالَ : " لَا نَفَقَةَ لَكِ " ، فَاسْتَأْذَنَتْهُ فِي الِانْتِقَالَ : فَأَذِنَ لَهَا ، فقَالَت : أَيْنَ يَا رَسُولَ اللَّهِ ؟ فقَالَ : " إِلَى ابْنِ أُمِّ مَكْتُومٍ " ، وَكَانَ أَعْمَى تَضَعُ ثِيَابَهَا عَنْدَهُ وَلَا يَرَاهَا ، فَلَمَّا مَضَتْ عِدَّتُهَا أَنْكَحَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُسَامَةَ بْنَ زَيْدٍ ، فَأَرْسَلَ إِلَيْهَا مَرْوَانُ : قَبِيصَةَ بْنَ ذُؤَيْبٍ يَسْأَلُهَا عَنِ الْحَدِيثِ ، فَحَدَّثَتْهُ بِهِ ، فقَالَ مَرْوَانُ : لَمْ نَسْمَعْ هَذَا الْحَدِيثَ إِلَّا مِنَ امْرَأَةٍ سَنَأْخُذُ بِالْعِصْمَةِ الَّتِي وَجَدْنَا النَّاسَ عَلَيْهَا ، فقَالَت فَاطِمَةُ : حِينَ بَلَغَهَا قَوْلُ مَرْوَانَ ، فَبَيْنِي وَبَيْنَكُمُ الْقُرْآنُ ، قَالَ اللَّهُ عَزَّ وَجَلَّ : لا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ سورة الطلاق آية 1 الْآيَةَ ، قَالَت : هَذَا لِمَنْ كَانَتْ لَهُ مُرَاجَعَةٌ ، فَأَيُّ أَمْرٍ يَحْدُثُ بَعْدَ الثَّلَاثِ ، فَكَيْفَ تَقُولُونَ : لَا نَفَقَةَ لَهَا ، إِذَا لَمْ تَكُنْ حَامِلًا ، فَعَلَامَ تَحْبِسُونَهَا .
'Ubaidullah bin 'Abdullah bin 'Utba reported that 'Amr bin Hafs bin al-Mughirahh set out along with ' Ali Ibn Abi Talib (RA) to the Yemen and sent to his wife the one pronouncement of divorce which was still left from the (irrevocable) divorce; and he commanded al-Harith bin Hisham and 'Ayyash bin Abu Rabi'a to give her maintenance allowance. They said to her: By Allah, there is no maintenance allowance for you, except in case you are pregnant. She came to Allah's Apostle (ﷺ) (may peace he upon him) and mentioned their opinion to him, whereupon he said: There is no maintenance allowance for you. Then she sought permission to move (to another place), and he (the Holy Prophet) permitted her. She said: Allah's Messenger, where (should I go)? He said: To the house of Ibn Umm Maktum and, as he is blind, she could put off her garmeqts in his presence and he would not see her. And when her 'Idda was over. Allah's Apostle (ﷺ) married her to Usama bin Zaid. Marwan (the governor of Madinah) sent Qabisa bin Dhuwaib in order to ask her about this hadith, and she narrated it to him, whereupon Marwan said: We have not heard this hadith but from a woman. We would adopt a safe (path) where we found the people. Fatima said that when these words of, Marwan were conveyed to her. There is between me and you the word of Allah, the Exalted and Majestic: Do "not turn them out" of their houses. She asserted: This is in regard to the revocable divorce what new (turn can the event take) after three pronouncements (separation between irrevocable). Why do you say there is no maintenance allowance for her if she is not pregnant? Then on what ground do you restrain her?

عُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ : أَنَّ أَبَاهُ كَتَبَ إِلَى عُمَرَ بْنِ عَبْدِ اللَّهِ بْنِ الْأَرْقَمِ الزُّهْرِيِّ يَأْمُرُهُ أَنْ يَدْخُلَ عَلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ الْأَسْلَمِيَّةِ ، فَيَسْأَلَهَا عَنْ حَدِيثِهَا ، وَعَمَّا قَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حِينَ اسْتَفْتَتْهُ ؟ فَكَتَبَ
عُمَرُ بْنُ عَبْدِ اللَّهِ إِلَى عَبْدِ اللَّهِ بْنِ عُتْبَةَ ، يُخْبِرُهُ ، أَنَّ
سُبَيْعَةَ ، أَخْبَرَتْهُ : أَنَّهَا كَانَتْ تَحْتَ سَعْدِ بْنِ خَوْلَةَ وَهُوَ فِي بَنِي عَامِرِ بْنِ لُؤَيٍّ ، وَكَانَ مِمَّنْ شَهِدَ بَدْرًا ، فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الْوَدَاعِ وَهِيَ حَامِلٌ ، فَلَمْ تَنْشَبْ أَنْ وَضَعَتْ حَمْلَهَا بَعْدَ وَفَاتِهِ ، فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا ، تَجَمَّلَتْ لِلْخُطَّابِ ، فَدَخَلَ عَلَيْهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ رَجُلٌ مِنْ بَنِي عَبْدِ الدَّارِ ، فقَالَ لَهَا : مَا لِي أَرَاكِ مُتَجَمِّلَةً لَعَلَّكِ تَرْجِينَ النِّكَاحَ ، إِنَّكِ وَاللَّهِ مَا أَنْتِ بِنَاكِحٍ حَتَّى تَمُرَّ عَلَيْكِ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ ، قَالَت سُبَيْعَةُ : فَلَمَّا قَالَ لِي ذَلِكَ جَمَعْتُ عَلَيَّ ثِيَابِي حِينَ أَمْسَيْتُ ، فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَسَأَلْتُهُ عَنْ ذَلِكَ ، " فَأَفْتَانِي بِأَنِّي قَدْ حَلَلْتُ حِينَ وَضَعْتُ حَمْلِي ، وَأَمَرَنِي بِالتَّزَوُّجِ إِنْ بَدَا لِي " ، قَالَ ابْنُ شِهَابٍ : فَلَا أَرَى بَأْسًا أَنْ تَتَزَوَّجَ حِينَ وَضَعَتْ ، وَإِنْ كَانَتْ فِي دَمِهَا غَيْرَ أَنْ لَا يَقْرَبُهَا زَوْجُهَا حَتَّى تَطْهُرَ .
'Ubaidullah bin 'Abdullah bin 'Utba (b. Mas'ud) reported that his father wrote to Umar bin 'Abdullah b al Arqam al-Zuhri that he would go to Subai'ah bint al-Hirith al-Aslamiyya (Allah be pleased with her) and ask her about a verdict from him which Allah's Messenger (ﷺ) gave her when she had asked that from him (in regard to the termination of 'Idda at the birth of a child) 'Umar bin'Abdullah wrote to 'Abdullah bin 'Utba informing him that Subai'ah had told him that she had been married to Sa'd bin Khaula and he belonged to the tribe of Amir bin Lu'ayy, and was one of those who participated in the Battle of Badr, and he died in the Farewell Pilgrimage and she had been in the family way at that time. And much time had not elapsed that she gave birth to a child after his death and when she was free from the effects of childbirth she embellished herself for those who had to give proposals of marriage. Abdul Sunabil bin Ba'kak (from Banu 'Abdul Dar) came to her and said: What is this that I see you embellished; perhaps you are inclined to marry, By Allah, you cannot marry unless four months and ten days (of 'Idda are passed). When he said that, I dressed myself, and as it was evening I came to Allah's Messenger (ﷺ) and asked him about it, and he gave me a religious verdict that I was allowed to marry when I had given birth to a child and asked me to marry if I so liked. Ibn Shihab said: I do not find any harm fur her in marrying when she has given birth to a child even when she is bleeding (after the birth of the child) except that her husband should not go near her until she is purified.
Hadith 1491
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) as saying: It is not permissible for a woman believing in Allah and the Hereafter to observe mourning on the dead for more than three (days), except in case of her husband.

يَحْيَي بْنُ يَحْيَي ، قَالَ : قَرَأْتُ عَلَى
مَالِكٍ ، عَنْ
ابْنِ شِهَابٍ : أَنَّ
سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ ، أَخْبَرَهُ : أَنَّ عُوَيْمِرًا الْعَجْلَانِيَّ جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ الْأَنْصَارِيِّ ، فَقَالَ لَهُ : أَرَأَيْتَ يَا عَاصِمُ ، لَوْ أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ ، فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ ؟ فَسَلْ لِي عَنْ ذَلِكَ يَا عَاصِمُ ، رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَسَأَلَ عَاصِمٌ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَكَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسَائِلَ وَعَابَهَا ، حَتَّى كَبُرَ عَلَى عَاصِمٍ ، ومَا سَمِعَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ ، فَقَالَ : يَا عَاصِمُ ، مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ ، قَالَ عَاصِمٌ : لِعُوَيْمِرٍ : لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا ، قَالَ عُوَيْمِرٌ : وَاللَّهِ لَا أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا ، فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَسَطَ النَّاسِ فَقَالَ : يَا رَسُولَ اللَّهِ ، أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ ، فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ ؟ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " قَدْ نَزَلَ فِيكَ وَفِي صَاحِبَتِكَ ، فَاذْهَبْ فَأْتِ بِهَا " ، قَالَ سَهْلٌ : فَتَلَاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلَمَّا فَرَغَا ، قَالَ عُوَيْمِرٌ : كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ ، إِنْ أَمْسَكْتُهَا ، فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ ابْنُ شِهَابٍ : فَكَانَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ " .
Sahl bin Sa'd al-Sa'idi reported that'Uwaimir al-'Ajlani came to 'Asim bin 'Adi al-Ansari and said to him. Tell me about a person who finds a man with his wife; should he kill him, and be killed in retaliation; or how should he act? 'Asim, ask for me (religious verdict about it) from Allah's Messenger (ﷺ) . So 'Asim asked Allah's Messenger (ﷺ) and he did not like this question and he disapproved of it so much that'Asim felt aggrieved at what he had heard from Allah's Messenger (ﷺ) . When 'Asim came back to his family, 'Uwaimir came to him and said: 'Asim, what did Allah's Messenger (ﷺ) say to you? 'Asim said to 'Uwaimir: You did not bring something good. Allah's Messenger (ﷺ) did not like this religious verdict that I sought from him. 'Uwaimir said: By Allah, I will not rest until I have asked him about it. 'Uwaimir proceeded until he came to Allah's Messenger (ﷺ) as he was sitting amidst people, and said: Messenger of Allah, tell me about a person who found a man with his wife. Should he kill him, and then you would kill him, or how should he act? Thereupon Allah's Messenger (ﷺ) said: (Verses) have been revealed concerning you and your wife; so go and bring her. Sahl said that they both invoked curses (and further said): I was along with people in the company of Allah's Messenger (ﷺ) . And when they had finished, Uwaimir said: Allah's Messenger, I shall have told a lie against her if I keep her (now). So he divorced her with three pronouncements before Allah's Messenger (ﷺ) had commanded him. Ibn Shihab said: Subsequently that was the practice of invokers of curses (al Mutala'inain)
Hadith 1492
وحَدَّثَنِي
حَرْمَلَةُ بْنُ يَحْيَي ، أَخْبَرَنَا

سَهْلُ بْنُ سَعْدٍ الْأَنْصَارِيُّ ، أَنَّ عُوَيْمِرًا الْأَنْصَارِيَّ مِنْ بَنِي الْعَجْلَانِ ، أَتَى عَاصِمَ بْنَ عَدِيٍّ ، وَسَاقَ الْحَدِيثَ بِمِثْلِ حَدِيثِ مَالِكٍ ، وَأَدْرَجَ فِي الْحَدِيثِ قَوْلَهُ وَكَانَ فِرَاقُهُ إِيَّاهَا بَعْدُ سُنَّةً فِي الْمُتَلَاعِنَيْنِ وَزَادَ فِيهِ ، قَالَ سَهْلٌ : فَكَانَتْ حَامِلًا فَكَانَ ابْنُهَا يُدْعَى إِلَى أُمِّهِ ، ثُمَّ جَرَتِ السُّنَّةُ أَنَّهُ يَرِثُهَا وَتَرِثُ مِنْهُ مَا فَرَضَ اللَّهُ لَهَا .
Sahl bin Sa'd reported.. 'Uwaimir al-Ansari (RA) from Banu'l-'Ajlan came to 'Asim bin 'Adi (RA) the remaining part of the hadith is the same and it was also reecorded in it: "And subsequebtly the separation became the practice of al-Mutala'inain." And this addition was also made: "She was pregnant and her son was ascribed to her, and it became customary that such (a son) would inherit her and she would inherit him in the share prescribed by Allah for her.

وحَدَّثَنَا
مُحَمَّدُ بْنُ رَافِعٍ ، حَدَّثَنَا
عَبْدُ الرَّزَّاقِ ، أَخْبَرَنَا
ابْنُ جُرَيْجٍ ، أَخْبَرَنِي
ابْنُ شِهَابٍ ، عَنِ الْمُتَلَاعِنَيْنِ ، وَعَنِ السُّنَّةِ فيهما ، عَنْ حَدِيثِ سَهْلِ بْنِ سَعْدٍ أَخِي بَنِي سَاعِدَةَ ، أَنَّ رَجُلًا مِنْ الْأَنْصَارِ جَاءَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا ، وَذَكَرَ الْحَدِيثَ بِقِصَّتِهِ ، وَزَادَ فِيهِ ، فَتَلَاعَنَا فِي الْمَسْجِدِ وَأَنَا شَاهِدٌ ، وَقَالَ فِي الْحَدِيثِ : فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَفَارَقَهَا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ذَاكُمُ التَّفْرِيقُ بَيْنَ كُلِّ مُتَلَاعِنَيْنِ .
Ibn Shihab narrated about the invokers of curses and the practice of (li'an) based on the authority of Sahl bin Sa'd, of the tribe of Sa'ida. that a person from the Ansar came to Allah's Apostle (ﷺ) and said: Allah's Messenger, tell me about the person who found a man with his wife. The remaining part of the hadith is the same (but) with this addition: They invoked curses in the mosque and I was present there. And he narrated in the hadith: He divorced her with three pronouncements before Allah's Messenger (ﷺ) commanded him (to get separation). He separated from her in the presence of Allah's Apostle (ﷺ) , whereupon he said: There is a separation between the invokers of curses.
Hadith 1500
Abu Hurairah (RA) reported: There came a person to the Holy Prophet (ﷺ) (may peace he upon him) from Banu Fazara and said: My wife has given birth to a child who is black, whereupon Allah's Apostle (ﷺ) said: Have you any camels? He said: Yes. He again said: What is this colour? He said: They are red. He said: Is there a dusky one among them? He said: Yes, there are dusky ones among them. He said: How has it come about? He said: It is perhaps the strain to which it has reverted, whereupon he (the Holy Prophet) said: It is perhaps the strain to which he (the child) has reverted.
Hadith 1500
This hadith has been narrated on the authority of Zuhri with the same chain of transmitters. In the hadith transmitted on the authority of Ma'mar, the (words are): "Messengser of Allah, my wife has given birth to a dark-complexioned boy, and he at that time was intending to disown him." And this addition has been made at the end of the hadith: "He (the Holy Prophet) did not permit him to disown him."

أَبِي هُرَيْرَةَ ، أَنَّ أَعْرَابِيًّا أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ وَإِنِّي أَنْكَرْتُهُ ، فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " هَلْ لَكَ مِنْ إِبِلٍ ؟ " ، قَالَ : نَعَمْ ، قَالَ : " مَا أَلْوَانُهَا ؟ " ، قَالَ : حُمْرٌ ، قَالَ : " فَهَلْ فِيهَا مِنْ أَوْرَقَ ؟ " ، قَالَ : نَعَمْ ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " فَأَنَّى هُوَ " ، قَالَ : لَعَلَّهُ يَا رَسُولَ اللَّهِ ، يَكُونُ نَزَعَهُ عِرْقٌ لَهُ ، فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " وَهَذَا لَعَلَّهُ يَكُونُ نَزَعَهُ عِرْقٌ لَهُ " .
Abu Hurairah (RA) reported: A desert Arab came to Allah's Messenger (ﷺ) and said: My wife has given birth to a dark-complexioned child and I have disowned him. Thereupon Allah's Apostle (ﷺ) said: Have you any camels? He said: Yes. He said: What is their colour? He said? They are red. He said: Is there anyone dusky among them? He said: Yes. Allah's Messenger (ﷺ) said: How has it come about? He said: Messenger of Allah, it is perhaps due to the strain to which it has reverted, whereupon the Holy Prophet (ﷺ) said: It (the birth) of the black child may be due to the strain to which he (the child) might have reverted.

عَائِشَةَ ، أَخْبَرَتْهُ : أَنَّ بَرِيرَةَ جَاءَتْ عَائِشَةَ تَسْتَعِينُهَا فِي كِتَابَتِهَا ، وَلَمْ تَكُنْ قَضَتْ مِنْ كِتَابَتِهَا شَيْئًا ، فَقَالَتْ لَهَا عَائِشَةُ : ارْجِعِي إِلَى أَهْلِكِ ، فَإِنْ أَحَبُّوا أَنْ أَقْضِيَ عَنْكِ كِتَابَتَكِ وَيَكُونَ وَلَاؤُكِ لِي ، فَعَلْتُ ، فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لِأَهْلِهَا فَأَبَوْا ، وَقَالُوا : إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ ، فَلْتَفْعَلْ وَيَكُونَ لَنَا وَلَاؤُكِ ، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " ابْتَاعِي فَأَعْتِقِي ، فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ " ، ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " مَا بَالُ أُنَاسٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ ، مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللَّهِ ، فَلَيْسَ لَهُ ، وَإِنْ شَرَطَ مِائَةَ مَرَّةٍ شَرْطُ اللَّهِ أَحَقُّ وَأَوْثَقُ " .
'A'isha (Allah be pleased with her) reported that Barira came to her in order to seek her help in securing freedom, but she had (so far) paid nothing out of that sum stipulated in the contract. 'A'isha said to her. Go to your family (who owns you), and if they like that I should pay the amount (of the contract) on your behalf (for purchasing your freedom), then I shall have the right in your inheritance. If they accepted it, I am prepared to make this payment. Barira made a mention of that to the (members of) her family, but they refused and said: If she (Hadrat 'A'isha) wants to do good to you for the sake of Allah, she may do it, but the right of inheritance will be ours. She (Hadrat 'A'isha) made a mention of that to Allah's Messenger (ﷺ) , and he said to her: Buy her, and emancipate her, for the right of inheritance vests with one who emancipates (the slave). Allah's Messenger (ﷺ) then stood up and said: What has happened to the people that they lay down conditions which are not (found) in the Book of Allah? And he who laid down a condition not found in the Book of Allah, that is not valid, even if it is laid down hundred times. The condition laid down by Allah is the most weighty and the most valid.

عَائِشَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهَا ، قَالَتْ : جَاءَتْ بَرِيرَةُ إِلَيَّ ، فَقَالَتْ : يَا عَائِشَةُ ، إِنِّي كَاتَبْتُ أَهْلِي عَلَى تِسْعِ أَوَاقٍ فِي كُلِّ عَامٍ أُوقِيَّةٌ بِمَعْنَى حَدِيثِ اللَّيْثِ ، وَزَادَ فَقَالَ : لَا يَمْنَعُكِ ذَلِكِ مِنْهَا ابْتَاعِي وَأَعْتِقِي ، وَقَالَ فِي الْحَدِيثِ ، ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي النَّاسِ ، فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ، ثُمَّ قَالَ : أَمَّا بَعْدُ .
'A'isha, the wife of Allah's Apostle (ﷺ) , reported: Barira came to me and said: 'A'isha, I have entered into contract for securing freedom with my family (who owns me) for nine 'uqiyas (of silver), one 'uqiya every year. The rest of the hadith is the same (but with this addition): "This (the problem of the right of inheritance) should not stand in your way. Buy her, and set her free. He said in a hadith: Allah's Messenger (ﷺ) stood up among men, extolled Allah, praised Him, and then said: "for......"

عَامِرُ بْنُ سَعْدِ بْنِ أَبِي وَقَّاصٍ ، أن
أبا سعيد الخدري ، قَالَ : " نَهَانَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعَتَيْنِ ، وَلِبْسَتَيْنِ ، نَهَى عَنْ : الْمُلَامَسَةِ ، وَالْمُنَابَذَةِ فِي الْبَيْعِ " ، وَالْمُلَامَسَةُ : لَمْسُ الرَّجُلِ ثَوْبَ الْآخَرِ بِيَدِهِ بِاللَّيْلِ ، أَوْ بِالنَّهَارِ وَلَا يَقْلِبُهُ إِلَّا بِذَلِكَ ، وَالْمُنَابَذَةُ أَنْ يَنْبِذَ الرَّجُلُ إِلَى الرَّجُلِ بِثَوْبِهِ ، وَيَنْبِذَ الْآخَرُ إِلَيْهِ ثَوْبَهُ وَيَكُونُ ذَلِكَ بَيْعَهُمَا مِنْ غَيْرِ نَظَرٍ وَلَا تَرَاضٍ .
Abu Sa'id al-Khudri (RA) reported: Allah's Messenger (ﷺ) forbade us (from), two types of business transactions and two ways of dressing. He forbade Mulamasa and Munabadha in transactions. Mulamasa means the touching of another's garment with his hand, whether at night or by day, without turning it over except this much. Munabadha means that a man throws his garment to another and the other throws his garment, and thus confirming their contract without the inspection of mutual agreement.

Hadith 1520
Abu Hurairah (RA) reported it directly from Allah's Apostle (ﷺ) : The townsman'should not sell for a man from the desert (with a view to taking advantage of his ignorance of the market conditions of the city). And Zuhair reported from the Holy Prophet (ﷺ) that he forbade the townsman to sell on behalf of the man from the desert.
Hadith 1527
Ibn 'Umar (RA) reported that they were beaten during the lifetime of Allah's Messenger (ﷺ) if they had bought foodgrains in bulk and then sold them in the spot without shifting them (to some other place).

أَبَاهُ ، قَال : " قَدْ رَأَيْتُ النَّاسَ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذَا ابْتَاعُوا الطَّعَامَ جِزَافًا ، يُضْرَبُونَ فِي أَنْ يَبِيعُوهُ فِي مَكَانِهِمْ ، وَذَلِكِ حَتَّى يُؤْوُوهُ إِلَى رِحَالِهِمْ " . قَالَ ابْنُ شِهَابٍ : وَحَدَّثَنِي عُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّ أَبَاهُ كَانَ يَشْتَرِي الطَّعَامَ جِزَافًا ، فَيَحْمِلُهُ إِلَى أَهْلِهِ .
Salim bin 'Abdullah (RA) reported his father havingsaid this: I saw people being beaten during the lifetime of Allah's Messenger (ﷺ) in case they bought the foodgrain in bulk, and then sold them at that spot before taking it to their places.
Hadith 1534
Ibn Umar (Allah be pleased with them) reported Allah's Apostle (ﷺ) forbidding the sale of fruits until their good condition becomes evident and the purchase of dates for dates.
Hadith 1538
Abu Huraira (Allah be pleased with him) reported Allah's Messenger (ﷺ) as saying:Do not buy the fruit until their condition is clear, and do not buy the fresh dates.

سَعِيدِ بْنِ الْمُسَيِّبِ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " نَهَى عَنْ بَيْعِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ " ، وَالْمُزَابَنَةُ : أَنْ يُبَاعَ ثَمَرُ النَّخْلِ بِالتَّمْرِ ، وَالْمُحَاقَلَةُ : أَنْ يُبَاعَ الزَّرْعُ بِالْقَمْحِ ، وَاسْتِكْرَاءُ الْأَرْضِ بِالْقَمْحِ ، قَالَ : وَأَخْبَرَنِي
سَالِمُ بْنُ عَبْدِ اللَّهِ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ : " لَا تَبْتَاعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ ، وَلَا تَبْتَاعُوا الثَّمَرَ بِالتَّمْرِ " . وقَالَ
سَالِمٌ : أَخْبَرَنِي
عَبْدُ اللَّهِ ، عَنْ
زَيْدِ بْنِ ثَابِتٍ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَنَّهُ رَخَّصَ بَعْدَ ذَلِكَ فِي بَيْعِ الْعَرِيَّةِ بِالرُّطَبِ أَوْ بِالتَّمْرِ ، وَلَمْ يُرَخِّصْ فِي غَيْرِ ذَلِكَ " .
Sa'id bin al-Musayyib said that Allah's Messenger (ﷺ) forbade the transaction of Af Muzabana and Muhaqala. Muzabana means that fresh dates on the trees should be sold against dry dates. Muhaqala implies that the wheat in the ear should be sold against the wheat and getting the land on rent for the wheat (produced in it).
Hadith 1543
Abdullah bin 'Umar (RA) reported Allah's Massenger (ﷺ) as saying: He who buys a tree after it has been fecundated, its fruit belongs to one who sells it except when the provision has been laid down by the buyer (that it will belong to him), and he who buys a slave, his property belongs to one who sells him except when a provision has been laid down by the buyer (that it will be transferred to him with the slave).

عَبْدَ اللَّهِ بْنَ عُمَرَ ، كَانَ يُكْرِي أَرَضِيهِ حَتَّى بَلَغَهُ أَنَّ رَافِعَ بْنَ خَدِيجٍ الْأَنْصَارِيَّ كَانَ يَنْهَى عَنْ كِرَاءِ الْأَرْضِ ، فَلَقِيَهُ عَبْدُ اللَّهِ ، فَقَالَ : يَا ابْنَ خَدِيجٍ ، مَاذَا تُحَدِّثُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي كِرَاءِ الْأَرْضِ ؟ قَالَ
رَافِعُ بْنُ خَدِيجٍ ، لِعَبْدِ اللَّهِ : سَمِعْتُ
عَمَّيَّ ، وَكَانَا قَدْ شَهِدَا بَدْرًا ، يُحَدِّثَانِ أَهْلَ الدَّارِ : أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " نَهَى عَنْ كِرَاءِ الْأَرْضِ " ، قَالَ عَبْدُ اللَّهِ : لَقَدْ كُنْتُ أَعْلَمُ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّ الْأَرْضَ تُكْرَى ، ثُمَّ خَشِيَ عَبْدُ اللَّهِ : أَنْ يَكُونَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَحْدَثَ فِي ذَلِكَ شَيْئًا لَمْ يَكُنْ عَلِمَهُ ، فَتَرَكَ كِرَاءَ الْأَرْضِ .
Salim bin'Abdullah reported that AbduUah bin 'Umar (RA) used to give land on rent until (this news) reached him that Rafi bin Khadij Ansari used to forbid the renting of land.'Abdullah met him and said: Ibn Khadij, what is this that you narrate from Allah's Messenger (ﷺ) pertaining to renting of land? Rafi bin Khadij said to'Abdullah (RA) : I heard it from two uncles of mine and they had participated in the Battle of Badr who narrated to the members of the family that Allah's Messenger (ﷺ) forbade the renting of land.'Abdullah said: I knew it that the land was rented during the lifetime of Allah's Messenger (ﷺ) .'Abdullah then apprehended that Allah's Messenger (ﷺ) might have said something new in this connection (in regard to prohibition of renting) which I failed to know. So he abandoned the renting of land.

أَبِيهِ ، أَنَّهُ تَقَاضَى ابْنَ أَبِي حَدْرَدٍ دَيْنًا كَانَ لَهُ عَلَيْهِ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْمَسْجِدِ ، فَارْتَفَعَتْ أَصْوَاتُهُمَا حَتَّى سَمِعَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَهُوَ فِي بَيْتِهِ ، فَخَرَجَ إِلَيْهِمَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَتَّى كَشَفَ سِجْفَ حُجْرَتِهِ وَنَادَى كَعْبَ بْنَ مَالِكٍ ، فَقَالَ : يَا كَعْبُ ، فَقَالَ : لَبَّيْكَ يَا رَسُولَ اللَّهِ ، " فَأَشَارَ إِلَيْهِ بِيَدِهِ أَنْ ضَعِ الشَّطْرَ مِنْ دَيْنِكَ ، قَالَ كَعْبٌ : قَدْ فَعَلْتُ يَا رَسُولَ اللَّهِ ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " قُمْ فَاقْضِهِ " .
Abdullah bin Ka'ab bin Malik reported from his father that he pressed in the mosque Ibn Abu Hadrad for the payment of the debt that he owed to him during the lifetime of Allah's Messenger (ﷺ) . (In this altercation) their voices became loud, until Allah's Messenger (ﷺ) heard them, while he was in the house, so Allah's Messenger (ﷺ) came out towards them, and he lifted the curtain of his apartment and he called upon Ka'b bin Malik and said: O Ka'b. He said: At thy beck and call, Allah's Messenger. He pointed out with the help of his hand to remit half of the loan due to him. Ka'b said: Allah's Messenger, I am ready to do that, whereupon Allah's Messenger (ﷺ) said (to Ibn Abu Hadrad): Stand up and make him the payment (of the rest).

Abu Hurairah (RA) reported Allah's Messenger (ﷺ) as saying: There was a person who gave loans to the people and said to his men: When an insolvent comes to you show him leniency that Allah may overlook our (faults). So when he met Allah, He overlooked his faults (forgave him).

Salim reported on the authority of his father that Allah's Apostle (ﷺ) said: He who kept a dog other than one meant for hunting or for watching the herd, lost two qirat of his reward every day.

Abu Hurairah (RA) reported Allah's Messenger (ﷺ) as saying: He who kept a dog which is neither meant for hunting nor for watching the anitmals nor for watching the fields would lose two qirat every day out of his reward; and there is no mention of the fields in the hadith transmitted by Abu Tahir.

أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ اتَّخَذَ كَلْبًا ، إِلَّا كَلْبَ مَاشِيَةٍ ، أَوْ صَيْدٍ ، أَوْ زَرْعٍ ، انْتَقَصَ مِنْ أَجْرِهِ كُلَّ يَوْمٍ قِيرَاطٌ " . قَالَ الزُّهْرِيُّ : فَذُكِرَ لِابْنِ عُمَرَ ، قَوْلُ أَبِي هُرَيْرَةَ ، فَقَالَ : يَرْحَمُ اللَّهُ أَبَا هُرَيْرَةَ كَانَ صَاحِبَ زَرْعٍ .
Abu Hurairah (RA) reported Allah's Messenger (ﷺ) as saying: He who kept a dog except one meant for watching the herd, or for hunting or for watching the fields. he lost two qirat of reward every day. Zuhri said: The words of Abu Hurairah (RA) were conveyed to Ibn 'Umar (RA) who said: May Allah have mercy upon Abu Hurairah (RA) ; he owned a field.
