Hadith 1025
´Awf bin Malik said:` "I heard the Messenger of Allah, while he was performing Salat for a deceased person. I could hear him saying in his prayer: (Allahummagfir lahu, war hamhu, waghsilhu bil-baradi (waghsilhu) kama yughsaluth-thawb) 'O Allah! Forgive him, have mercy upon him, and wash him with (snow or ice) (and wash him) just as a garment is washed.'"
Hadith 1027

سُفْيَانُ، عَنْ
سَعْدِ بْنِ إِبْرَاهِيمَ، عَنْ
طَلْحَةَ بْنِ عَبْدِ اللَّهِ بْنِ عَوْفٍ، أَنَّ
ابْنَ عَبَّاسٍ صَلَّى عَلَى جَنَازَةٍ فَقَرَأَ بِفَاتِحَةِ الْكِتَابِ " . فَقُلْتُ لَهُ ، فَقَالَ : " إِنَّهُ مِنَ السُّنَّةِ أَوْ مِنْ تَمَامِ السُّنَّةِ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، يَخْتَارُونَ أَنْ يُقْرَأَ بِفَاتِحَةِ الْكِتَابِ بَعْدَ التَّكْبِيرَةِ الْأُولَى ، وَهُوَ قَوْلُ : الشَّافِعِيِّ ، وَأَحْمَدَ ، وَإِسْحَاق ، وقَالَ بَعْضُ أَهْلِ الْعِلْمِ : لَا يُقْرَأُ فِي الصَّلَاةِ عَلَى الْجَنَازَةِ ، إِنَّمَا هُوَ ثَنَاءٌ عَلَى اللَّهِ ، وَالصَّلَاةُ عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَالدُّعَاءُ لِلْمَيِّتِ ، وَهُوَ قَوْلُ : الثَّوْرِيِّ ، وَغَيْرِهِ مِنْ أَهْلِ الْكُوفَةِ ، وَطَلْحَةُ بْنُ عَبْدِ اللَّهِ بْنِ عَوْفٍ هُوَ : ابْنُ أَخِي عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ ، رَوَى عَنْهُ الزُّهْرِيُّ .
´Talhah bin Abdullah bin Awf narrated:` "Ibn Abbas performed Salat for a funeral and he recited Fatihatil-Kitab. So I asked him about it and he said: 'It is from the Sunnah' or, 'From the completeness of the Sunnah.'"
Hadith 1038
´Sa'eedbin Musayyab narrated:` "Umm Sa'd died while the Prophet was absent. So when he arrived he performed Salat over her, and a month had already passed."
Hadith 1041

عَبَّادُ بْنُ مَنْصُورٍ، قَال : سَمِعْتُ
أَبَا الْمُهَزِّمِ، قَالَ : صَحِبْتُ
أَبَا هُرَيْرَةَ عَشْرَ سِنِينَ سَمِعْتُهُ ، يَقُولُ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " مَنْ تَبِعَ جَنَازَةً وَحَمَلَهَا ثَلَاثَ مَرَّاتٍ فَقَدْ قَضَى مَا عَلَيْهِ مِنْ حَقِّهَا " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ غَرِيبٌ ، وَرَوَاهُ بَعْضُهُمْ بِهَذَا الْإِسْنَادِ وَلَمْ يَرْفَعْهُ ، وَأَبُو الْمُهَزِّمِ اسْمُهُ : يَزِيدُ بْنُ سُفْيَانَ وَضَعَّفَهُ شُعْبَةُ .
´Abu Muhazzim said:` "I accompanied Abu Hurairah for ten years, and I heard him saying: 'I heard the Messenger of Allah saying: "Whoever follows a funeral, and carries it three times, then he has fulfilled the right that is required from him."
Hadith 1048
´Ibn Abbas narrated:` "A red velvet cloth was placed in the grave of the Prophet."

عَلِيًّا، قَالَ لِأَبِي الْهَيَّاجِ الْأَسَدِيّ : أَبْعَثُكَ عَلَى مَا بَعَثَنِي بِهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، " أَنْ لَا تَدَعَ قَبْرًا مُشْرِفًا إِلَّا سَوَّيْتَهُ ، وَلَا تِمْثَالًا إِلَّا طَمَسْتَهُ " . قَالَ : وَفِي الْبَاب ، عَنْ جَابِرٍ . قَالَ أَبُو عِيسَى : حَدِيثُ عَلِيٍّ حَدِيثٌ حَسَنٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ ، يَكْرَهُونَ أَنْ يُرْفَعَ الْقَبْرُ فَوْقَ الْأَرْضِ ، قَالَ الشَّافِعِيُّ : أَكْرَهُ أَنْ يُرْفَعَ الْقَبْرُ إِلَّا بِقَدْرِ مَا يُعْرَفُ أَنَّهُ قَبْرٌ لِكَيْلَا يُوطَأَ وَلَا يُجْلَسَ عَلَيْهِ .
´Abu Wa'il narrated:` "Ali said to Abu Al-Hayyaj Al-Asadi: 'I am dispatching you with what the Prophet dispatched me: "That you not leave an elevated grave without leveling it, nor an image without erasing it."
Hadith 1050
´Abu Marthan Al-Ghanawi narrated that:` The Prophet said: "Do not sit on the graves nor perform Salat towards them."
Hadith 1054
´Sulaiman bin Buraidah narrated from his father that:` The Messenger of Allah said: "I had prohibited you from visiting the graves. But Muhammad was permitted to visit the grave of his mother: so visit them, for they will remind you of the Hereafter."
Hadith 1067
´Sa'd bin Hisham narrated that:` Aishah mentioned that the Messenger of Allah said: "Whoever loves to meet Allah, then Allah loves to meet him. And whoever dislikes meeting Allah, then Allah dislikes meeting him." She said: "O Messenger of Allah! All of us dislike death." He said: "It is not like that. But when the believer is given the good news of Allah's mercy, His pleasure, and His Paradise, then he loves to meet Allah and Allah loves to meet him. Whereas when the disbeliever is given the news of Allah's punishment and His wrath, he dislikes meeting Allah, and Allah dislikes meeting him."
Hadith 1074
´Abdullah bin Amr narrated that:` The Messenger of Allah said: "No Muslim dies on the day of Friday, nor the night of Friday, except that Allah protects him from the trials of the grave."

´Aishah narrated:` "The Messenger of Allah married me in Shawwal, and he took up residence with me in Shawwal."

´Abu Musa narrated that :` the Messenger of Allah said: "There is no marriage except with a Wali."

أَبِيهِ، أَنَّ امْرَأَةً مِنْ بَنِي فَزَارَةَ تَزَوَّجَتْ عَلَى نَعْلَيْنِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَرَضِيتِ مِنْ نَفْسِكِ وَمَالِكِ بِنَعْلَيْنِ ؟ " قَالَتْ : نَعَمْ . قَالَ : " فَأَجَازَهُ " . قَالَ : وَفِي الْبَاب ، عَنْ عُمَرَ ، وَأَبِي هُرَيْرَةَ ، وَسَهْلِ بْنِ سَعْدٍ ، وَأَبِي سَعِيدٍ ، وَأَنَسٍ ، وَعَائِشَةَ ، وَجَابِرٍ ، وَأَبِي حَدْرَدٍ الْأَسْلَمِيِّ . قَالَ أَبُو عِيسَى : حَدِيثُ عَامِرِ بْنِ رَبِيعَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي الْمَهْرِ ، فَقَالَ بَعْضُ أَهْلِ الْعِلْمِ : الْمَهْرُ عَلَى مَا تَرَاضَوْا عَلَيْهِ ، وَهُوَ قَوْلُ : سُفْيَانَ الثَّوْرِيِّ ، وَالشَّافِعِيِّ ، وَأَحْمَدَ ، وَإِسْحَاق ، وقَالَ مَالِكُ بْنُ أَنَسٍ : لَا يَكُونُ الْمَهْرُ أَقَلَّ مِنْ رُبْعِ دِينَارٍ ، وقَالَ بَعْضُ أَهْلِ الْكُوفَةِ : لَا يَكُونُ الْمَهْرُ أَقَلَّ مِنْ عَشَرَةِ دَرَاهِمَ .
´Abdullah bin Amr bin Rabi'ah narrated from his father:` "A woman from Banu Fazarah was married for (the dowry of) two sandals. So the Messenger of Allah said to her: 'Do you approve of (exchanging) yourself and your wealth for two sandals?' She said: 'Yes.'" He said: "So he permitted it."
Hadith 1130
´[Abu Wahb Al-Jaishani narrated from Ad-Dhahhak bin Fairuz Ad-Dailami from his father:` "I said: 'O Messenger of Allah! I accepted Islam and I had two sisters (as wives).' So Messenger of Allah said: 'Chose whichever of them you will.'"]
Hadith 1141
´Abu Hurairah narrated that:` The Messenger of Allah said: "When a man has two wives and he is not just between them, he will come on the Day of Judgment with one side drooping."
Hadith 1147
´Aishah narrated that the Messenger of Allah said:` “Indeed Allah has made unlawful through suckling whatever He made unlawful through birth.”
Hadith 1158
´Jabir (bin Abdullah) narrated:` “The Prophet saw a woman, then he went to Zainab to fulfill his need and he left. He said: ‘Indeed when the woman enters, she enters in the image of Shaitan. So when one of you sees a woman that he is fascinated with, then let him go to his wife, for indeed with her (his wife) is the same as that which is with her.”
Hadith 1173
´Abdullah narrated that The Prophet said:` “The woman is Awrah, so when she goes out, the Shaitan seeks to tempt her.”

عَائِشَةَ بِمِثْلِهِ . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي الْخِيَارِ فَرُوِيَ ، عَنْ عُمَرَ ، وَعَبْدِ اللَّهِ بْنِ مَسْعُودٍ ، أنهما قَالَا : إِنِ اخْتَارَتْ نَفْسَهَا فَوَاحِدَةٌ بَائِنَةٌ ، وَرُوِيَ عَنْهُمَا أَنَّهُمَا ، قَالَا : أَيْضًا وَاحِدَةٌ يَمْلِكُ الرَّجْعَةَ ، وَإِنِ اخْتَارَتْ زَوْجَهَا فَلَا شَيْءَ وَرُوِيَ ، عَنْ عَلِيٍّ ، أَنَّهُ قَالَ : إِنِ اخْتَارَتْ نَفْسَهَا فَوَاحِدَةٌ بَائِنَةٌ ، وَإِنِ اخْتَارَتْ زَوْجَهَا فَوَاحِدَةٌ يَمْلِكُ الرَّجْعَةَ ، وقَالَ زَيْدُ بْنُ ثَابِتٍ : إِنِ اخْتَارَتْ زَوْجَهَا فَوَاحِدَةٌ ، وَإِنِ اخْتَارَتْ نَفْسَهَا فَثَلَاثٌ ، وَذَهَبَ أَكْثَرُ أَهْلِ الْعِلْمِ وَالْفِقْهِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَمَنْ بَعْدَهُمْ ، فِي هَذَا الْبَابِ إِلَى قَوْلِ عُمَرَ ، وَعَبْدِ اللَّهِ ، وَهُوَ قَوْلُ : الثَّوْرِيِّ ، وَأَهْلِ الْكُوفَةِ ، وَأَمَّا أَحْمَدُ بْنُ حَنْبَلٍ ، فَذَهَبَ إِلَى قَوْلِ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ .
´Aishah said:` "The Messenger of Allah gave us the choice, so we chose him. So was that a divorce?"
Hadith 1187
´Thawban narrated that :` The Messenger of Allah said: "Whichever woman seeks a Khul from her husband without harm (cause), then the scent of Paradise will be unlawful for her."

سَعْدِ بْنِ إِسْحَاق بْنِ كَعْبِ بْنِ عُجْرَةَ، عَنْ عَمَّتِهِ
زَيْنَبَ بِنْتِ كَعْبِ بْنِ عُجْرَةَ، أَنَّ
الْفُرَيْعَةَ بِنْتَ مَالِكِ بْنِ سِنَانٍ، وَهِيَ أُخْتُ أَبِي سَعِيدٍ الْخُدْرِيِّ ، أَخْبَرَتْهَا ، أَنَّهَا جَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ تَسْأَلُهُ ، أَنْ تَرْجِعَ إِلَى أَهْلِهَا فِي بَنِي خُدْرَةَ ، وَأَنَّ زَوْجَهَا خَرَجَ فِي طَلَبِ أَعْبُدٍ لَهُ ، أَبَقُوا حَتَّى إِذَا كَانَ بِطَرَفِ الْقَدُومِ ، لَحِقَهُمْ فَقَتَلُوهُ . قَالَتْ : فَسَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنْ أَرْجِعَ إِلَى أَهْلِي فَإِنَّ زَوْجِي لَمْ يَتْرُكْ لِي مَسْكَنًا يَمْلِكُهُ ، وَلَا نَفَقَةً ، قَالَتْ : فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " نَعَمْ " ، قَالَتْ : فَانْصَرَفْتُ حَتَّى إِذَا كُنْتُ فِي الْحُجْرَةِ ، أَوْ فِي الْمَسْجِدِ نَادَانِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَوْ أَمَرَ بِي فَنُودِيتُ لَهُ ، فَقَالَ : " كَيْفَ قُلْتِ ؟ " قَالَتْ : فَرَدَدْتُ عَلَيْهِ الْقِصَّةَ الَّتِي ذَكَرْتُ لَهُ مِنْ شَأْنِ زَوْجِي ، قَالَ : " امْكُثِي فِي بَيْتِكِ ، حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ " . قَالَتْ : فَاعْتَدَدْتُ فِيهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا ، قَالَتْ : فَلَمَّا كَانَ عُثْمَانُ أَرْسَلَ إِلَيَّ فَسَأَلَنِي عَنْ ذَلِكَ ، فَأَخْبَرْتُهُ ، فَاتَّبَعَهُ ، وَقَضَى بِهِ . حَدَّثَنَا

سَعْدُ بْنُ إِسْحَاق بْنِ كَعْبِ بْنِ عُجْرَةَ فَذَكَرَ نَحْوَهُ بِمَعْنَاهُ . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، لَمْ يَرَوْا لِلْمُعْتَدَّةِ أَنْ تَنْتَقِلَ مِنْ بَيْتِ زَوْجِهَا ، حَتَّى تَنْقَضِيَ عِدَّتُهَا ، وَهُوَ قَوْلُ : سُفْيَانَ الثَّوْرِيِّ ، وَالشَّافِعِيِّ ، وَأَحْمَدَ ، وَإِسْحَاقَ ، وقَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ : لِلْمَرْأَةِ أَنْ تَعْتَدَّ حَيْثُ شَاءَتْ ، وَإِنْ لَمْ تَعْتَدَّ فِي بَيْتِ زَوْجِهَا . قَالَ أَبُو عِيسَى : وَالْقَوْلُ الْأَوَّلُ أَصَحُّ .
´Zainab bint Ka'b bin Ujrah narrated that :` Al-Furay'ah bint Malik bin Sinan - the sister of the Abu Sa'eed Al-Khudri - informed her that she went to the Messenger of Allah to ask him if she could return to her family in Banu Khudrah. Her husband had gone out searching for his runaway slaves, and when he was in Turaf Al-Qadum he caught up with them and they killed him. She said: "So I asked the Messenger of Allah if I could return to my family since my husband had not left me a home that he owned nor any maintenance." She said: "So the Messenger of Allah said: 'Yes.' Then I left. When I was in the courtyard," or, "in the Masjid, the Messenger of Allah called me" or, "summoned for me to come back t him and he said: 'What did you say?'" She said: "So I repeated the store that I had mentioned to him about the case of my husband. He said: 'Stay in your house until what is written reaches its term.'" She said: "So I observed my Iddah there for four months and ten (days)." She said: "During the time of Uthman, he sent a message to me asking me about that, so I informed him. He followed it and judged accordingly."
Hadith 1214
'Abdullah bin Abbas (may Allah be pleased with them) says that when the Prophet (peace and blessings of Allah be upon him) passed away, his armor was mortgaged for twenty saa' of grain. He had taken it for his family. © Imam Tirmidhi says: This hadith is Hasan Sahih.

قَتَادَةَ، عَنْ
أَنَسٍ، قَالَ : مَشَيْتُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِخُبْزِ شَعِيرٍ ، وَإِهَالَةٍ سَنِخَةٍ ، وَلَقَدْ رُهِنَ لَهُ دِرْعٌ ، عِنْدَ يَهُودِيٍّ بِعِشْرِينَ صَاعًا مِنْ طَعَامٍ ، أَخَذَهُ لِأَهْلِهِ ، وَلَقَدْ سَمِعْتُهُ ذَاتَ يَوْمٍ يَقُولُ : " مَا أَمْسَى فِي آلِ مُحَمَّدٍ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ صَاعُ تَمْرٍ ، وَلَا صَاعُ حَبٍّ ، وَإِنَّ عِنْدَهُ يَوْمَئِذٍ لَتِسْعَ نِسْوَةٍ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ .
Anas (may Allah be pleased with him) said: I brought to the Prophet (peace and blessings of Allah be upon him) barley bread and melted fat that had undergone some change. His coat of mail was mortgaged with a Jew in exchange for twenty sa’s of grain, which he had taken for his family. Qatadah said: One day I heard Anas (may Allah be pleased with him) saying that the family of Muhammad (peace and blessings of Allah be upon him) would not have a sa’ of dates or a sa’ of grain in the evening, while at that time he had nine wives. __REF_N__ Imam Tirmidhi said: This hadith is hasan sahih.

الْعَدَّاءُ بْنُ خَالِدِ بْنِ هَوْذَةَ : أَلَا أُقْرِئُكَ كِتَابًا كَتَبَهُ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : قُلْتُ : بَلَى فَأَخْرَجَ لِي كِتَابًا " هَذَا مَا اشْتَرَى الْعَدَّاءُ بْنُ خَالِدِ بْنِ هَوْذَةَ ، مِنْ مُحَمَّدٍ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اشْتَرَى مِنْهُ عَبْدًا ، أَوْ أَمَةً ، لَا دَاءَ ، وَلَا غَائِلَةَ ، وَلَا خِبْثَةَ بَيْعَ الْمُسْلِمِ الْمُسْلِمَ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ لَا نَعْرِفُهُ إِلَّا مِنْ حَدِيثِ عَبَّادِ بْنِ لَيْثٍ ، وَقَدْ رَوَى عَنْهُ هَذَا الْحَدِيثَ غَيْرُ وَاحِدٍ مِنْ أَهْلِ الْحَدِيثِ .
‘Abdul Majeed bin Wahb says that ‘Ada bin Khalid bin Huwdhah said to me: “Shall I not read to you a document which the Messenger of Allah (ﷺ) wrote for me?” I said: “Why not, please do.” Then he took out a document, (in which it was written): “This is a sale contract for something which ‘Ada bin Khalid bin Huwdhah bought from Muhammad (ﷺ).” He bought from you a slave or a slave-girl on the condition that there is no disease in it, nor is it a runaway, nor is it unlawful property. This is a sale of a Muslim from a Muslim 1.” © Imam Tirmidhi says:
This hadith is Hasan Ghareeb. We know it only from the narration of ‘Abbad bin Laith. Several people among the hadith scholars have narrated this hadith from him.
Hadith 1236
'Abdullah bin Umar (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings of Allah be upon him) forbade selling and gifting of wala’ 1. © Imam Tirmidhi says:
1 - This hadith is hasan sahih,
2 - We know it only through the narration of Abdullah bin Dinar, who narrated it from Ibn Umar,
3 - Yahya bin Salim narrated this hadith via: «عبيد الله بن عمر عن نافع عن ابن عمر عن النبي صلى الله عليه وسلم» that he (the Prophet) forbade selling and gifting of wala’. There is a mistake in this chain. The mistake is from Yahya bin Salim,
4 - Abdulwahhab Thaqafi, Abdullah bin Numayr, and many others narrated it via: «عن عبيد الله بن عمر عن عبد الله بن دينار عن ابن عمر عن النبي صلى الله عليه وسلم», and this is more authentic than the narration of Yahya bin Salim,
5 - The people of knowledge act upon this hadith.

حَكِيمِ بْنِ حِزَامٍ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِنْ صَدَقَا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا ، وَإِنْ كَتَمَا وَكَذَبَا مُحِقَتْ بَرَكَةُ بَيْعِهِمَا " ، هَذَا حَدِيثٌ صَحِيحٌ وَهَكَذَا رُوِيَ ، عَنْ أَبِي بَرْزَةَ الْأَسْلَمِيِّ وَهَكَذَا رُوِيَ عَنْ أَبِي بَرْزَةَ الْأَسْلَمِيِّ ، أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَيْهِ فِي فَرَسٍ بَعْدَ مَا تَبَايَعَا ، وَكَانُوا فِي سَفِينَةٍ ، فَقَالَ : لَا أَرَاكُمَا افْتَرَقْتُمَا ، وَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا " . وَقَدْ ذَهَبَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَهْلِ الْكُوفَةِ وَغَيْرِهِمْ ، إِلَى أَنَّ الْفُرْقَةَ بِالْكَلَامِ ، وَهُوَ قَوْلُ : سُفْيَانَ الثَّوْرِيِّ . وَهَكَذَا رُوِيَ عَنْ مَالِكِ بْنِ أَنَسٍ ، وَرُوِي عَنْ ابْنِ الْمُبَارَكِ ، أَنَّهُ قَالَ : كَيْفَ أَرُدُّ هَذَا ؟ وَالْحَدِيثُ فِيهِ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ صَحِيحٌ وَقَوَّى هَذَا الْمَذْهَبَ ، وَمَعْنَى قَوْلِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِلَّا بَيْعَ الْخِيَارِ " مَعْنَاهُ : أَنْ يُخَيِّرَ الْبَائِعُ الْمُشْتَرِيَ بَعْدَ إِيجَابِ الْبَيْعِ ، فَإِذَا خَيَّرَهُ فَاخْتَارَ الْبَيْعَ ، فَلَيْسَ لَهُ خِيَارٌ بَعْدَ ذَلِكَ فِي فَسْخِ الْبَيْعِ ، وَإِنْ لَمْ يَتَفَرَّقَا هَكَذَا فَسَّرَهُ الشَّافِعِيُّ ، وَغَيْرُهُ ، وَمِمَّا يُقَوِّي قَوْلَ : مَنْ يَقُولُ الْفُرْقَةُ بِالْأَبْدَانِ ، لَا بِالْكَلَامِ حَدِيثُ عَبْدِ اللَّهِ بْنِ عَمْرٍو ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .
Hakim bin Hizam (may Allah be pleased with him) says that the Messenger of Allah (peace and blessings of Allah be upon him) said: "The seller and the buyer have the option (to cancel or confirm the sale) as long as they do not separate. 1 Both have the right to keep the sale or to annul it. If both speak the truth and make clear the good and bad aspects of the goods, there will be blessing in their sale. But if they conceal defects and tell lies, the blessing of their sale will be erased." © Imam Tirmidhi says:
1- This hadith is authentic.
2- Similarly, it is also narrated from Abu Barzah Aslami that two men, after selling a horse, brought their case to him while they were in a boat. Abu Barzah said: "I do not think that you both have separated, and the Messenger of Allah (peace and blessings of Allah be upon him) said: 'The seller and the buyer have the option as long as they do not separate (from the gathering).' "
3- Some scholars among the people of Kufa and others have held the view that separation is by statement, and this is also the saying of Sufyan Thawri, and similarly it is narrated from Malik bin Anas.
4- And Ibn Mubarak said: "How can I reject this view when an authentic hadith has been reported from the Prophet (peace and blessings of Allah be upon him)?"
5- And he has declared it strong. The meaning of the saying of the Prophet (peace and blessings of Allah be upon him) «إلا بيع الخيار» is that after the sale becomes binding, the seller gives the buyer the option, then when the buyer chooses the sale, after that he will not have the option to annul the sale, even if they have not separated. Similarly, Shafi'i and others have interpreted it.
6- And the view of those who say that separation is physical (separation of bodies) is supported by the hadith of Abdullah bin Amr, which he narrates from the Prophet (peace and blessings of Allah be upon him) (which is coming ahead).
Hadith 1252

أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنِ اشْتَرَى مُصَرَّاةً فَهُوَ بِالْخِيَارِ ثَلَاثَةَ أَيَّامٍ ، فَإِنْ رَدَّهَا رَدَّ مَعَهَا صَاعًا مِنْ طَعَامٍ لَا سَمْرَاءَ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ أَصْحَابِنَا مِنْهُمْ : الشَّافِعِيُّ ، وَأَحْمَدُ ، وَإِسْحَاق ، وَمَعْنَى قَوْلِهِ : " لَا سَمْرَاءَ " يَعْنِي : لَا بُرَّ .
Narrated from Abu Hurairah (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) said: "Whoever buys an animal whose milk has been withheld in its udder, he has the option for three days. If he returns it, he should return with it a sa’ of grain, which should not be wheat." © Imam Tirmidhi says:
1- This hadith is hasan sahih,
2- Our companions act upon this, among them are Shafi’i, Ahmad, and Ishaq bin Rahwayh. The meaning of your statement «لا سمراء» is «لابُرّ», that is, it should not be wheat (it should be some other food; in the previous hadith, dates are mentioned).

عَائِشَةَ، أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ بَرِيرَةَ ، فَاشْتَرَطُوا الْوَلَاءَ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اشْتَرِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْطَى الثَّمَنَ ، أَوْ لِمَنْ وَلِيَ النِّعْمَةَ " . قَالَ : وَفِي الْبَاب ، عَنْ ابْنِ عُمَرَ . قَالَ أَبُو عِيسَى : حَدِيثُ عَائِشَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ ، قَالَ : وَمَنْصُورُ بْنُ الْمُعْتَمِرِ يُكْنَى : أَبَا عَتَّابٍ . حَدَّثَنَا أَبُو بَكْرٍ الْعَطَّارُ الْبَصْرِيُّ ، عَنْ ابْنِ الْمَدِينِيِّ ، قَال : سَمِعْتُ يَحْيَى بْنَ سَعِيدٍ ، يَقُولُ : إِذَا حُدِّثْتَ عَنْ مَنْصُورٍ ، فَقَدْ مَلَأْتَ يَدَكَ مِنَ الْخَيْرِ لَا تُرِدْ غَيْرَهُ ، ثُمّ قَالَ يَحْيَى : مَا أَجِدُ فِي إِبْرَاهِيمَ النَّخَعِيِّ ، وَمُجَاهِدٍ ، أَثْبَتَ مِنْ مَنْصُورٍ ، قَالَ مُحَمَّدٌ : عَنْ عَبْدِ اللَّهِ بْنِ أَبِي الْأَسْوَدِ ، قَالَ : قَالَ عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ مَنْصُورٌ ، أَثْبَتُ أَهْلِ الْكُوفَةِ .
Narrated from Umm al-Mu’minin Aisha (may Allah be pleased with her) that she wanted to buy Barirah (the slave woman), so Barirah’s owners set the condition of wala’ 1. The Prophet (peace and blessings of Allah be upon him) said to Aisha: “Buy her (and set her free), for the wala’ belongs to the one who pays the price, or to the one who owns the favor (of setting free).” © Imam Tirmidhi says:
1- The hadith of Aisha (may Allah be pleased with her) is hasan sahih,
2- In this chapter, a hadith is also narrated from Ibn Umar (may Allah be pleased with them both),

Hadith 1294
Anas bin Malik (may Allah be pleased with him) reports that the Prophet Muhammad (peace and blessings be upon him) was asked: Can wine be turned into vinegar? He replied: "No." © Imam Tirmidhi says: This hadith is hasan sahih.

وَابْنِ عَبَّاسٍ يَرْفَعَانِ الْحَدِيثَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِهَذَا الْحَدِيثِ . قَالَ أَبُو عِيسَى : حَدِيثُ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا حَدِيثٌ حَسَنٌ صَحِيحٌ ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ ، قَالُوا : مَنْ وَهَبَ هِبَةً لِذِي رَحِمٍ مَحْرَمٍ ، فَلَيْسَ لَهُ أَنْ يَرْجِعَ فِيهَا ، وَمَنْ وَهَبَ هِبَةً لِغَيْرِ ذِي رَحِمٍ مَحْرَمٍ ، فَلَهُ أَنْ يَرْجِعَ فِيهَا ، مَا لَمْ يُثَبْ مِنْهَا ، وَهُوَ قَوْلُ : الثَّوْرِيِّ ، وقَالَ الشَّافِعِيُّ : لَا يَحِلُّ لِأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً فَيَرْجِعَ فِيهَا ، إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ . وَاحْتَجَّ الشَّافِعِيُّ بِحَدِيثِ عَبْدِ اللَّهِ بْنِ عُمَرَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " لَا يَحِلُّ لِأَحَدٍ أَنْ يُعْطِيَ عَطِيَّةً ، فَيَرْجِعَ فِيهَا إِلَّا الْوَالِدَ فِيمَا يُعْطِي وَلَدَهُ " .
‘Abdullah bin ‘Umar and Ibn ‘Abbas (may Allah be pleased with them) narrated that the Prophet (peace and blessings of Allah be upon him) said: “It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son.” © Imam Tirmidhi says:
1- The hadith of Ibn ‘Abbas (may Allah be pleased with them both) is Hasan Sahih.
2- Some of the people of knowledge among the Companions and others have acted upon this hadith. They say that if someone gives something as a gift to a close relative (mahram), then he does not have the right to take it back, but if he gives something as a gift to someone who is not a close relative (non-mahram), then it is permissible for him to take it back if he has not received compensation for it. This is also the saying of Thawri.
3- And Shafi’i says: It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son. Shafi’i has used as evidence the hadith of ‘Abdullah bin ‘Umar (may Allah be pleased with them both), which he narrated from the Prophet (peace and blessings of Allah be upon him), that he said: “It is not permissible for anyone to give a gift and then take it back, except for a father who gives something to his son.”
Hadith 1308
Narrated from Abu Huraira (may Allah be pleased with him) that the Prophet Muhammad (peace and blessings be upon him) said: "Delaying the repayment of a debt by a wealthy person is injustice __QUR_N__, and if any one of you is referred to a wealthy person (for payment), he should accept the referral." __XREF_N__.

أَنَسٍ، قَالَ : غَلَا السِّعْرُ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالُوا : يَا رَسُولَ اللَّهِ ، سَعِّرْ لَنَا ، فَقَالَ : " إِنَّ اللَّهَ هُوَ الْمُسَعِّرُ الْقَابِضُ الْبَاسِطُ الرَّزَّاقُ ، وَإِنِّي لَأَرْجُو أَنْ أَلْقَى رَبِّي ، وَلَيْسَ أَحَدٌ مِنْكُمْ ، يَطْلُبُنِي بِمَظْلِمَةٍ فِي دَمٍ ، وَلَا مَالٍ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ .
Anas (may Allah be pleased with him) narrates that once, during the time of the Messenger of Allah (peace and blessings be upon him), the prices (of grain and other goods) increased. So the people said: "O Messenger of Allah! Fix prices for us." He replied: "The One who fixes prices is Allah alone. He is the One who restricts provision, expands it, opens it, and grants abundant sustenance. I wish to meet my Lord in such a state that none of you demands from me compensation for any injustice regarding life or wealth." © Imam Tirmidhi says:

´Abu Hurairah narrated that the Messenger of Allah (ﷺ) said:` "Whoever frees a portion" or he said: "a part of a slave, then he should finish paying his price if he can afford it. If he can not afford to pay reasonable price then he should be allowed to work to earn the amount that will free him without overburdening him." (Another chain) similar, and he said: "a part".
Hadith 1356

الْمُثَنَّى بْنُ سَعِيدٍ , عَنْ
قَتَادَةَ , عَنْ
بُشَيْرِ بْنِ كَعْبٍ الْعَدَوِيِّ , عَنْ
أَبِي هُرَيْرَةَ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا تَشَاجَرْتُمْ فِي الطَّرِيقِ , فَاجْعَلُوهُ سَبْعَةَ أَذْرُعٍ " . قَالَ أَبُو عِيسَى : وَهَذَا أَصَحُّ مِنْ حَدِيثِ وَكِيعٍ . قَالَ : وَفِي الْبَاب , عَنْ ابْنِ عَبَّاسٍ . قَالَ أَبُو عِيسَى : حَدِيثُ بُشَيْرِ بْنِ كَعْبٍ الْعَدَوِيِّ , عَنْ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ , وَرَوَى بَعْضُهُمْ هَذَا عَنْ
قَتَادَةَ , عَنْ
بَشِيرِ بْنِ نَهِيكٍ , عَنْ
أَبِي هُرَيْرَةَ , وَهُوَ غَيْرُ مَحْفُوظٍ .
´Abu Hurairah narrated that the Messenger of Allah (ﷺ) said:` "When you disagree over the road, then make it seven forearm lengths."
Hadith 1373
حَدَّثَنَا
مُحَمَّدُ بْنُ بَشَّارٍ , حَدَّثَنَا
أَبُو بَكْرٍ الْحَنَفِيُّ، أَخْبَرَنَا
الضَّحَّاكُ بْنُ عُثْمَانَ , حَدَّثَنِي
سَالِمٌ أَبُو النَّضْرِ , عَنْ
بُسْرِ بْنِ سَعِيدٍ , عَنْ
زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ , أَنَّ ّرَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُئِلَ عَنِ اللُّقَطَةِ , فَقَالَ : " عَرِّفْهَا سَنَةً فَإِنِ اعْتُرِفَتْ فَأَدِّهَا , وَإِلَّا فَاعْرِفْ وِعَاءَهَا , وَعِفَاصَهَا , وَوِكَاءَهَا , وَعَدَدَهَا , ثُمَّ كُلْهَا , فَإِذَا جَاءَ صَاحِبُهَا فَأَدِّهَا " . قَالَ أَبُو عِيسَى : حَدِيثُ زَيْدِ بْنِ خَالِدٍ حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ , أَصَحُّ شَيْءٍ فِي هَذَا الْبَابِ هَذَا الْحَدِيثُ , وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ , وَرَخَّصُوا فِي اللُّقَطَةِ إِذَا عَرَّفَهَا سَنَةً , فَلَمْ يَجِدْ مَنْ يَعْرِفُهَا أَنْ يَنْتَفِعَ بِهَا , وَهُوَ قَوْلُ : الشَّافِعِيِّ , وَأَحْمَدَ , وَإِسْحَاق , وقَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ : يُعَرِّفُهَا سَنَةً , فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا تَصَدَّقَ بِهَا , وَهُوَ قَوْلُ : سُفْيَانَ الثَّوْرِيِّ , وَعَبْدِ اللَّهِ بْنِ الْمُبَارَكِ , وَهُوَ قَوْلُ : أَهْلِ الْكُوفَةِ , لَمْ يَرَوْا لِصَاحِبِ اللُّقَطَةِ أَنْ يَنْتَفِعَ بِهَا إِذَا كَانَ غَنِيًّا , وقَالَ الشَّافِعِيُّ : يَنْتَفِعُ بِهَا وَإِنْ كَانَ غَنِيًّا , لِأَنَّ أُبَيَّ بْنَ كَعْبٍ أَصَابَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ صُرَّةً فِيهَا مِائَةُ دِينَارٍ , فَأَمَرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُعَرِّفَهَا , ثُمَّ يَنْتَفِعَ بِهَا , وَكَانَ أُبَيٌّ كَثِيرَ الْمَالِ , مِنْ مَيَاسِيرِ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , فَأَمَرَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُعَرِّفَهَا , فَلَمْ يَجِدْ مَنْ يَعْرِفُهَا , فَأَمَرَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَأْكُلَهَا , فَلَوْ كَانَتِ اللُّقَطَةُ لَمْ تَحِلَّ إِلَّا لِمَنْ تَحِلُّ لَهُ الصَّدَقَةُ , لَمْ تَحِلَّ لِعَلِيِّ بْنِ أَبِي طَالِبٍ , لِأَنَّ عَلِيَّ بْنَ أَبِي طَالِبٍ أَصَابَ دِينَارًا عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَعَرَّفَهُ , فَلَمْ يَجِدْ مَنْ يَعْرِفُهُ , فَأَمَرَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَكْلِهِ , وَكَانَ لَا يَحِلُّ لَهُ الصَّدَقَةُ , وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ إِذَا كَانَتِ اللُّقَطَةُ يَسِيرَةً أَنْ يَنْتَفِعَ بِهَا , وَلَا يُعَرِّفَهَا وقَالَ بَعْضُهُمْ : إِذَا كَانَ دُونَ دِينَارٍ يُعَرِّفُهَا قَدْرَ جُمْعَةٍ , وَهُوَ قَوْلُ : إِسْحَاق بْنِ إِبْرَاهِيمَ .
´Zaid bin Khalid Al-Juhni narrated that the Messenger of Allah (ﷺ) was asked about the lost item. He said:` "Make a public announcement about it for one year, if it is claimed then give it to him. Otherwise remember its sack, string, and its count. Then use it, and if its owner comes, give it to him."

أَيُّوبُ , عَنْ
هِشَامِ بْنِ عُرْوَةَ , عَنْ
أَبِيهِ , عَنْ
سَعِيدِ بْنِ زَيْدٍ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ أَحْيَى أَرْضًا مَيِّتَةً فَهِيَ لَهُ , وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ " . قَالَ أَبُو عِيسَى : هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ , وَقَدْ رَوَاهُ بَعْضُهُمْ , عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ , عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُرْسَلًا , وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ , وَهُوَ قَوْلُ : أَحْمَدَ , وَإِسْحَاق , قَالُوا لَهُ : أَنْ يُحْيِيَ الْأَرْضَ الْمَوَاتَ بِغَيْرِ إِذْنِ السُّلْطَانِ , وَقَدْ قَالَ بَعْضُهُمْ : لَيْسَ لَهُ أَنْ يُحْيِيَهَا إِلَّا بِإِذْنِ السُّلْطَانِ , وَالْقَوْلُ الْأَوَّلُ أَصَحُّ , قَالَ : وَفِي الْبَاب , عَنْ جَابِرٍ , وَعَمْرِو بْنِ عَوْفٍ الْمُزَنِيِّ جَدِّ كَثِيرٍ , وَسَمُرَةَ , حَدَّثَنَا أَبُو مُوسَى مُحَمَّدُ بْنُ الْمُثَنَّى , قَالَ : سَأَلْتُ أَبَا الْوَلِيدِ الطَّيَالِسِيَّ عَنْ قَوْلِهِ : وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ , فَقَالَ : الْعِرْقُ الظَّالِمُ : الْغَاصِبُ الَّذِي يَأْخُذُ مَا لَيْسَ قُلْتُ : هُوَ الرَّجُلُ الَّذِي يَغْرِسُ فِي أَرْضِ غَيْرِهِ . قَالَ : هُوَ ذَاكَ .
´Narrated Sa'eed bin Zaid:` that the Prophet (ﷺ) said: "Whoever revives a barren land then it is for him, and there is no right for the unjust root."
