Hadith 6774
حَدَّثَنَا قُتَيْبَةُ ، حَدَّثَنَا عَبْدُ الْوَهَّابِ ، عَنْ أَيُّوبَ ، عَنْ ابْنِ أَبِي مُلَيْكَةَ ، عَنْ عُقْبَةَ بْنِ الْحَارِثِ ، قَالَ : " جِيءَ بِالنُّعَيْمَانِ أَوْ بِابْنِ النُّعَيْمَانِ شَارِبًا ، فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ كَانَ بِالْبَيْتِ أَنْ يَضْرِبُوهُ ، قَالَ : فَضَرَبُوهُ ، فَكُنْتُ أَنَا فِيمَنْ ضَرَبَهُ بِالنِّعَالِ " .
Narrated `Uqba bin Al-Harith: An-Nu`man or the son of An-Nu`man was brought to the Prophet on a charge of drunkenness. So the Prophet ordered all the men present in the house, to beat him. So all of them beat him, and I was also one of them who beat him with shoes.
Hadith 6775
حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا وُهَيْبُ بْنُ خَالِدٍ ، عَنْ أَيُّوبَ ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي مُلَيْكَةَ ، عَنْ عُقْبَةَ بْنِ الْحَارِثِ " أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أُتِيَ بِنُعَيْمَانَ أَوْ بِابْنِ نُعَيْمَانَ وَهُوَ سَكْرَانُ ، فَشَقَّ عَلَيْهِ ، وَأَمَرَ مَنْ فِي الْبَيْتِ أَنْ يَضْرِبُوهُ ، فَضَرَبُوهُ بِالْجَرِيدِ وَالنِّعَالِ ، وَكُنْتُ فِيمَنْ ضَرَبَهُ ".
Narrated' `Uqba bin Al-Harith: An-Nu`man or the son of An-Nu`man was brought to the Prophet in a state of intoxication. The Prophet felt it hard (was angry) and ordered all those who were present in the house, to beat him. And they beat him, using palm-leaf stalks and shoes, and I was among those who beat him.
Hadith 6946
حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ ، حَدَّثَنَا سُفْيَانُ ، عَنِ ابْنِ جُرَيْجٍ ، عَنِ ابْنِ أَبِي مُلَيْكَةَ ، عَنْ أَبِي عَمْرٍو هُوَ ذَكْوَانُ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : قُلْتُ : " يَا رَسُولَ اللَّهِ ، يُسْتَأْمَرُ النِّسَاءُ فِي أَبْضَاعِهِنَّ ؟ ، قَالَ : نَعَمْ ، قُلْتُ : فَإِنَّ الْبِكْرَ تُسْتَأْمَرُ ، فَتَسْتَحْيِي ، فَتَسْكُتُ ، قَالَ : سُكَاتُهَا إِذْنُهَا " .
Narrated `Aisha: I asked the Prophet, "O Allah's Apostle! Should the women be asked for their consent to their marriage?" He said, "Yes." I said, "A virgin, if asked, feels shy and keeps quiet." He said, "Her silence means her consent."
Hadith 6971
حَدَّثَنَا أَبُو عَاصِمٍ ، عَنِ ابْنِ جُرَيْجٍ ، عَنِ ابْنِ أَبِي مُلَيْكَةَ ، عَنْ ذَكْوَانَ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْبِكْرُ تُسْتَأْذَنُ ، قُلْتُ : إِنَّ الْبِكْرَ تَسْتَحْيِي ، قَالَ : إِذْنُهَا صُمَاتُهَا " ، وَقَالَ بَعْضُ النَّاسِ : إِنْ هَوِيَ رَجُلٌ جَارِيَةً يَتِيمَةً أَوْ بِكْرًا ، فَأَبَتْ فَاحْتَالَ ، فَجَاءَ بِشَاهِدَيْ زُورٍ عَلَى أَنَّهُ تَزَوَّجَهَا ، فَأَدْرَكَتْ ، فَرَضِيَتِ الْيَتِيمَةُ ، فَقَبِلَ الْقَاضِي شَهَادَةَ الزُّورِ ، وَالزَّوْجُ يَعْلَمُ بِبُطْلَانِ ذَلِكَ ، حَلَّ لَهُ الْوَطْءُ .
Narrated `Aisha: Allah's Apostle said, "It is essential to have the consent of a virgin (for the marriage). I said, "A virgin feels shy." The Prophet; said, "Her silence means her consent." Some people said, "If a man falls in love with an orphan slave girl or a virgin and she refuses (him) and then he makes a trick by bringing two false witnesses to testify that he has married her, and then she attains the age of puberty and agrees to marry him and the judge accepts the false witness and the husband knows that the witnesses were false ones, he may consummate his marriage."
Hadith 7188
حَدَّثَنَا مُسَدَّدٌ ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنِ ابْنِ جُرَيْجٍ ، سَمِعْتُ ابْنَ أَبِي مُلَيْكَةَ ، يُحَدِّثُ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَبْغَضُ الرِّجَالِ إِلَى اللَّهِ الْأَلَدُّ الْخَصِمُ " .
Narrated `Aisha: Allah's Apostle said, "The most hated person in the sight of Allah, is the most quarrelsome person."
Hadith 7302
حَدَّثَنَا مُحَمَّدُ بْنُ مُقَاتِلٍ ، أَخْبَرَنَا وَكِيعٌ ، أَخْبَرَنَا نَافِعُ بْنُ عُمَرَ ، عَنْ ابْنِ أَبِي مُلَيْكَةَ ، قَالَ : " كَادَ الْخَيِّرَانِ أَنْ يَهْلِكَا أَبُو بَكْرٍ ، وَعُمَرُ لَمَّا قَدِمَ عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَفْدُ بَنِي تَمِيمٍ أَشَارَ أَحَدُهُمَا بِالْأَقْرَعِ بْنِ حَابِسٍ التَّمِيمِيِّ الْحَنْظَلِيِّ أَخِي بَنِي مُجَاشِعٍ وَأَشَارَ الْآخَرُ بِغَيْرِهِ ، فَقَالَ أَبُو بَكْرٍ لِعُمَرَ : إِنَّمَا أَرَدْتَ خِلَافِي ، فَقَالَ عُمَرُ : مَا أَرَدْتُ خِلَافَكَ ، فَارْتَفَعَتْ أَصْوَاتُهُمَا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَنَزَلَتْ : يَأَيُّهَا الَّذِينَ آمَنُوا لا تَرْفَعُوا أَصْوَاتَكُمْ فَوْقَ صَوْتِ النَّبِيِّ إِلَى قَوْلِهِ عَظِيمٌ سورة الحجرات آية 2- 3 " ، قَالَ ابْنُ أَبِي مُلَيْكَةَ : قَالَ ابْنُ الزُّبَيْرِ : فَكَانَ عُمَرُ بَعْدُ وَلَمْ يَذْكُرْ ذَلِكَ عَنْ أَبِيهِ يَعْنِي أَبَا بَكْرٍ إِذَا حَدَّثَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِحَدِيثٍ حَدَّثَهُ كَأَخِي السِّرَارِ لَمْ يُسْمِعْهُ حَتَّى يَسْتَفْهِمَهُ .
Narrated Ibn Abi Mulaika: Once the two righteous men, i.e., Abu Bakr and `Umar were on the verge of destruction (and that was because): When the delegate of Bani Tamim came to the Prophet, one of them (either Abu Bakr or `Umar) recommended Al-Aqra' bin H`Abis at-Tamimi Al-Hanzali, the brother of Bani Majashi (to be appointed as their chief), while the other recommended somebody else. Abu Bakr said to `Umar, "You intended only to oppose me." `Umar said, "I did not intend to oppose you!" Then their voices grew louder in front of the Prophet whereupon there was revealed: 'O you who believe! Do not raise your voices above the voice of the Prophet..a great reward.' (49.2-3) Ibn Az-Zubair said, 'Thence forward when `Umar talked to the Prophet, he would talk like one who whispered a secret and would even fail to make the Prophet hear him, in which case the Prophet would ask him (to repeat his words).
