بَابُ الْقَضَاءِ فِي عِمَارَةِ الْمَوَاتِ
of Judgement Regarding Reviving Dead Land

حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ : " مَنْ أَحْيَا أَرْضًا مَيِّتَةً، فَهِيَ لَهُ، وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ " .
It is narrated from Hazrat Urwah bin Zubair that the Messenger of Allah, peace and blessings be upon him, said: "Whoever cultivates barren land (makes it fertile for cultivation), it belongs to him. Whoever wrongfully takes possession there, he has no right to it."
قَالَ مَالِك : وَالْعِرْقُ الظَّالِمُ : كُلُّ مَا احْتُفِرَ أَوْ أُخِذَ أَوْ غُرِسَ بِغَيْرِ حَقٍّ
Imam Malik, may Allah have mercy on him, said that if someone acts unjustly, for example: digs a pit there, seizes some land, or plants a tree.
وَحَدَّثَنِي مَالِك، عَنْ ابْنِ شِهَابٍ ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ ، عَنْ أَبِيهِ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ ، قَالَ : " مَنْ أَحْيَا أَرْضًا مَيِّتَةً، فَهِيَ لَهُ " . قَالَ مَالِك : وَعَلَى ذَلِكَ الْأَمْرُ عِنْدَنَا
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them) that Sayyiduna Umar (may Allah be pleased with him) said: Whoever cultivates barren land, it belongs to him.
Imam Malik (may Allah have mercy on him) said: In our view, this is the ruling.
