وَحَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ ابْنِ شِهَابٍ ، أَنَّهُ قَالَ : " مَضَتِ السُّنَّةُ أَنَّ الْعَاقِلَةَ لَا تَحْمِلُ شَيْئًا مِنْ دِيَةِ الْعَمْدِ إِلَّا أَنْ يَشَاءُوا ذَلِكَ " .
Ibn Shihab said that the 'aqilah is not made responsible for blood money in the case of intentional killing, unless they wish to give it willingly.
