Muwatta Malik (Yahya) 1448 — of Judgement Regarding the Elbow
وَحَدَّثَنِي وَحَدَّثَنِي مَالِك، عَنْ عَمْرِو بْنِ يَحْيَى الْمَازِنِيِّ ، عَنْ أَبِيهِ ، أَنَّهُ قَالَ : كَانَ فِي حَائِطِ جَدِّهِ، رَبِيعٌ لِعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، فَأَرَادَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ أَنْ يُحَوِّلَهُ إِلَى نَاحِيَةٍ مِنَ الْحَائِطِ هِيَ أَقْرَبُ إِلَى أَرْضِهِ، فَمَنَعَهُ صَاحِبُ الْحَائِطِ، فَكَلَّمَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ، عُمَرَ بْنَ الْخَطَّابِ فِي ذَلِكَ، " فَقَضَى لِعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ بِتَحْوِيلِهِ "
It is narrated from Yahya Mazni that a canal used to flow through my grandfather's garden, belonging to Abdur Rahman bin Awf. Abdur Rahman wanted to divert it to the other side of the garden because it was closer to his land, but the owner of the garden, that is, my grandfather, did not permit it. Abdur Rahman mentioned this to Sayyiduna Umar (may Allah be pleased with him). Sayyiduna Umar (may Allah be pleased with him) granted permission.
