وَحَدَّثَنِي وَحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، وَعَبْدَ اللَّهِ بْنَ عُمَرَ، وَعَبْدَ اللَّهِ بْنَ مَسْعُودٍ، وَسَالِمَ بْنَ عَبْدِ اللَّهِ، وَالْقَاسِمَ بْنَ مُحَمَّدٍ، وَابْنَ شِهَابٍ، وَسُلَيْمَانَ بْنَ يَسَارٍ، كَانُوا يَقُولُونَ : " إِذَا حَلَفَ الرَّجُلُ بِطَلَاقِ الْمَرْأَةِ قَبْلَ أَنْ يَنْكِحَهَا، ثُمَّ أَثِمَ، إِنَّ ذَلِكَ لَازِمٌ لَهُ إِذَا نَكَحَهَا "
Sayyiduna Umar bin Khattab (may Allah be pleased with him), Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him), Salim bin Abdullah, Qasim bin Muhammad, Ibn Shihab, and Sulaiman bin Yasar say: Whoever swears an oath regarding the divorce of a woman before marriage, then after marriage breaks that oath, the divorce will take effect.
