Book: On the Explanation of Divorce
بَابُ مَا يَجِبُ فِيهِ تَطْلِيقَةٌ وَاحِدَةٌ مِنَ التَّمْلِيكِ
When only one divorce is required in Tamlik (transfer of divorce right)
Muwatta Malik (Yahya) 1143 — When only one divorce is required
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ سَعِيدِ بْنِ سُلَيْمَانَ بْنِ زَيْدِ بْنِ ثَابِتٍ ، عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ أَنَّهُ أَخْبَرَهُ : أَنَّهُ كَانَ جَالِسًا عِنْدَ زَيْدِ بْنِ ثَابِتٍ، فَأَتَاهُ مُحَمَّدُ بْنُ أَبِي عَتِيقٍ وَعَيْنَاهُ تَدْمَعَانِ، فَقَالَ لَهُ زَيْدٌ : " مَا شَأْنُكَ ؟ " فَقَالَ : مَلَّكْتُ امْرَأَتِي أَمْرَهَا، فَفَارَقَتْنِي، فَقَالَ لَهُ زَيْدٌ : " مَا حَمَلَكَ عَلَى ذَلِكَ ؟ " قَالَ : الْقَدَرُ، فَقَالَ زَيْدٌ : " ارْتَجِعْهَا إِنْ شِئْتَ، فَإِنَّمَا هِيَ وَاحِدَةٌ وَأَنْتَ أَمْلَكُ بِهَا "
It is narrated from Sayyiduna Kharijah bin Zaid (may Allah be pleased with him) that he was sitting with his father, Sayyiduna Zaid bin Thabit (may Allah be pleased with him), when Muhammad bin Abi Atiq came in crying. Sayyiduna Zaid bin Thabit (may Allah be pleased with him) asked: Why? He said: I had given my wife the choice (of divorce), and she left me. Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: Why did you give her the choice? He said: It was destined in fate. Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: If you wish, you may take her back, because only one divorce has occurred; you still have authority over her.
