بَابُ الْمَقَامِ عِنْدَ الْبِكْرِ وَالْأَيِّمِ

Muwatta Malik (Yahya) 1088 — Staying with a virgin and a previously
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ حُمَيْدٍ الطَّوِيلِ ، عَنْ أَنَسِ بْنِ مَالِكٍ ، أَنَّهُ كَانَ يَقُولُ : " لِلْبِكْرِ سَبْعٌ، وَلِلثَّيِّبِ ثَلَاثٌ " .
Sayyiduna Anas bin Malik (may Allah be pleased with him) used to say that a virgin woman has seven days and a previously married woman has three days.
قَالَ مَالِكٌ : وَذَلِكَ الْأَمْرُ عِنْدَنَا . قَالَ مَالِكٌ : فَإِنْ كَانَتْ لَهُ امْرَأَةٌ غَيْرُ الَّتِي تَزَوَّجَ، فَإِنَّهُ يَقْسِمُ بَيْنَهُمَا بَعْدَ أَنْ تَمْضِيَ أَيَّامُ الَّتِي تَزَوَّجَ بِالسَّوَاءِ، وَلَا يَحْسِبُ عَلَى الَّتِي تَزَوَّجَ مَا أَقَامَ عِنْدَهَا
Imam Malik, may Allah have mercy on him, said: This is the ruling according to us. Imam Malik, may Allah have mercy on him, said: If a man has married a woman and, besides her, he has other wives as well, then after those days he should stay with all of them equally. However, these days will be counted in favor of the new woman, because this is the right of the new woman.
