حدثنا أبو العباس محمد بن يعقوب، حدثنا يحيى بن أبي طالب، حدثنا عبد الوهاب بن عطاء، أخبرنا سعيد، عن قَتَادة عن أنس بن مالك: أنَّ رجلًا كان على عهدِ رسولِ الله ﷺ يبتاعُ، وكان في عُقْدته ضعفٌ، فأتَى أهلُه رسولَ الله ﷺ، فقالوا: يا نبيَّ الله، احجُزْ على فلان، فإنه يبتاعُ وفي عُقدتِه ضعفٌ، فدعاه نبيُّ الله ﷺ، فنهاه عن البيع، قال: يا نبيَّ الله، إني لا أصبِرُ عن البيع، فقال: "إن كنتَ غيرَ تاركٍ البيعَ، فقُلْ: ها ولا خِلَابةَ" (2). و هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه. It is narrated from Sayyiduna Anas bin Malik (may Allah be pleased with him) that during the time of the Messenger of Allah (peace and blessings be upon him) there was a man who used to buy and sell, and there was some weakness in his judgement (that is, in his intellect or power of decision). His family came to the Prophet (peace and blessings be upon him) and said: O Prophet of Allah, place a restriction (on trading) on so-and-so, for he makes deals and there is weakness in his understanding. So the Prophet (peace and blessings be upon him) called him and forbade him from buying and selling. He said: O Prophet of Allah, I cannot do without trading. So he (peace and blessings be upon him) said: "If you are not going to give up trading, then say (when making a deal): 'Ha wa la khilabah' (Here it is, and let there be no deception)."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(2) حديث صحيح، وهذا إسناد قوي من أجل يحيى بن أبي طالب وعبد الوهاب بن عطاء - وهو الخفاف - وقد توبعا. Grading: The hadith is sahih. Technical note / Defect ('illah): This chain is strong because of Yahya bin Abi Talib and Abd al-Wahhab bin Ata' al-Khaffaf, and both of them have also been corroborated. وأخرجه أحمد 21/ (13276)، وأبو داود (3501)، وابن حبان (5049) و (5050) من طرق عن عبد الوهاب بن عطاء بهذا الإسناد. Reference / Source: Imam Ahmad (21/13276), Abu Dawud (3501) and Ibn Hibban (5049, 5050) narrated it through various routes from Abd al-Wahhab bin Ata', with this same chain. وأخرجه ابن ماجه (2354)، والترمذي (1250)، والنسائي (6033) من طريق عبد الأعلى بن عبد الأعلى السامي، عن سعيد بن أبي عروبة، به. Reference / Source: Ibn Majah (2354), al-Tirmidhi (1250) and al-Nasa'i (6033) narrated it by way of Abd al-A'la bin Abd al-A'la al-Sami, from Sa'id bin Abi Arubah. وفي الباب عن ابن عمر سلف عند المصنف برقم (2232). Corroborating chains and supporting reports: In this chapter, the narration of Ibn Umar (may Allah be pleased with them both) has passed earlier with the author (al-Hakim) at number (2232). قوله: "في عقدته ضعف" أي: في رأيه ونظره في مصالح نفسه. قاله ابن الأثير في "النهاية". Important point: The phrase "في عقدته ضعف" means that there is weakness in his judgement and his understanding of matters concerning his own interests. Ibn al-Athir gave this explanation in "al-Nihayah". وقوله: "ها ولا خلابة" قال الخطابي في "معالم السنن" 3/ 67 - 68: ها وها معناه التقابض، وأصحاب الحديث يقولون: ها وها، مقصورَيْن والصواب مدُّهما ونصب الألف منهما. وقوله: هاء، إنما هو قول الرجل لصاحبه إذا ناوله الشيء: هاك، أي: خذ، فأسقطوا الكاف منه، وعوَّضوه المدّ بدلًا من الكاف. Important point: About the phrase "ها ولا خلابة", al-Khattabi says in "Ma'alim al-Sunan" (3/67-68) that "ha' wa ha'" means exchanging on the spot (hand to hand). The hadith scholars read it in the shortened form (maqsur), but the correct way is to read it with the lengthening (madd). "Ha'" is in fact said when a person, handing something to another, says "hak" (i.e., take this); here the "kaf" was dropped and the lengthening was put in its place. ومعنى "لا خِلابة" قال ابن الأثير: أي: لا خِداع. Important point: According to Ibn al-Athir, the meaning of "لا خِلابة" is "no deceiving" (there is to be no fraud).
