Mustadrak al-Hakim — Hadith 7089

حدثني أحمد بن محمد بن رُمَيح، حدَّثنا يحيى بن محمد بن صاعد، حدثني أبي قال: خاصمَ ابن أبي الفُرات مولى أسامةَ بن زيدٍ الحسنَ بن أُسامة ونازعَه، فقال له ابن أبي الفُرات في كلامه: يا ابنَ بَرَكةَ، يُريدُ أمَّ أيمن، فقال الحسن: اشْهَدُوا، ورفعَه إلى أبي بكر بن محمد بن عمرو بن حَزْم وهو يومئذٍ قاضي المدينة، وقصَّ عليه القصةَ، فقال أبو بكر لابن أبي الفُرات: ما أردتَ بقولك له: يا ابنَ بركة؟ قال: سمَّيتُها باسمِها، فقال أبو بكر: إنما (1) أردتَ بهذا التصغيرَ بها، وحالُها من الإسلام حالُها، ورسولُ الله ﷺ يقول لها: "يا أمَّهْ" و "يا أمَّ أيمن"، لا أقالَني الله ﷿ إن أقَلتُك، فضربَه سبعينَ سوطًا (2). ذكرُ أَروى بنت كُرَيز القُرشية ﵂

Yahya bin Muhammad bin Sa'id narrates from his father that a dispute arose between Ibn Abi al-Furat, the freed slave of Usamah bin Zayd, and al-Hasan bin Usamah. During the exchange Ibn Abi al-Furat said to him (mockingly): O son of Barakah! (By this he meant Umm Ayman.) Al-Hasan said: Bear witness, all of you. Then he took the matter to Abu Bakr bin Muhammad bin Amr bin Hazm, who was the judge of Madinah at that time, and related the whole incident. Abu Bakr asked Ibn Abi al-Furat: What did you mean by calling him "O son of Barakah"? He said: I only called her by her name. Abu Bakr said: Your intention by this was to insult and belittle her, although her standing in Islam is very high, and the Messenger of Allah (peace and blessings be upon him) himself used to address her as "O my mother!" and "O Umm Ayman". May Allah, the Mighty and Majestic, not pardon me if I pardon you. So he sentenced him to seventy lashes.

Note / Clarification: In manuscripts (M) and (S) the words "لا إنما" are found at this place.

(2) إسناده ضعيف لإعضاله ولجهالة حال محمد بن صاعد والد يحيى.
Grading: Its chain is weak.
Technical note / Defect ('illah): The reason for its weakness is that the chain is "mu'dal" (two or more consecutive narrators missing) and that the condition of Muhammad bin Sa'id (the father of Yahya) is unknown (majhul).
وأخرجه ابن سعد في "الطبقات" 10/ 215 - ومن طريقه ابن عساكر في "تاريخه" 13/ 27 - عن الواقدي، فذكره.
