Note / Clarification: In manuscript (M) it has been corrupted into "Hanash" and in manuscript (S) into "Hunaysh".
(2) ما بين المعقوفين سقط من النسخ الخطية، وسيشير الحاكم إلى وجوده في الإسناد عقب الحديث، وسمَّاه بشارَ بن الحكم، وكذا هو موجود في مصادر التخريج.
Note / Clarification: The words between the square brackets have dropped out of the manuscripts. Imam al-Hakim (may Allah have mercy on him) will point out after the hadith that they are present in the chain, and he named him Bashshar bin al-Hakam; it is likewise present in the other sources of the takhrij.
(3) قوله: لم يحرم عليهم، سقط من (م) و (ص)، وأثبتناه من (ب).
Note / Clarification: The words of the Prophet (peace and blessings be upon him) "lam yuharrim 'alayhim" (He did not make it unlawful for them) have dropped out of manuscripts (M) and (S), and we have entered them according to manuscript (B).
(4) صحيح لغيره، وهذا إسناد ضعيف؛ بكر بن خنيس ضعيف، وأبو بدر -وهو بشار بن الحكم- قال أبو زرعة: منكر الحديث، وقال ابن حبان: ينفرد عن ثابت بأشياء ليست من حديثه، وقال ابن عدي: منكر الحديث عن ثابت البناني وغيره، ثم قال: يروي عن ثابت وغيره ممّا لا يرويه غيره، وأحاديثه عن ثابت أفرادات، وأرجو أنه لا بأس به. وقال الذهبي في "التلخيص": أورد له الحاكم حديثًا ضعيفًا.
Grading: This narration is "sahih li-ghayrihi", but this particular chain is weak.
Technical note / Defect ('illah): Bakr bin Khunays is a weak narrator, and about Abu Badr, whose name is Bashshar bin al-Hakam, Imam Abu Zur'ah said: "munkar al-hadith". Ibn Hibban says that he is alone in narrating from Thabit (bin Aslam al-Bunani) things that are not from Thabit's hadith. Ibn 'Adi said that he is munkar al-hadith from Thabit al-Bunani and others; then he said that he narrates from Thabit and others what no one else narrates, and that his narrations from Thabit are "afradat" (solitary reports), "but I hope there is no harm in him". Imam al-Dhahabi wrote in "al-Talkhis" that al-Hakim cited a weak hadith through him.
أبو علاثة: هو محمد بن عَمرو بن خالد الحَراني.
Important point: Abu 'Ulathah refers to Muhammad bin 'Amr bin Khalid al-Harrani.
وأخرجه مختصرًا البخاري في "التاريخ الكبير" 5/ 25 و 6/ 530، ومطولًا الطبراني في "المعجم الكبير" 17 / (105) -وعنه أبو نعيم في "الحلية" 3/ 357 - من طريق عمرو بن خالد الحراني، عن بكير بن خنيس، عن أبي بدر، عن عبد الله بن عبيد بن عمير، به. وقال أبو نعيم عقبه: غريب من حديث عبد الله بن عبيد بن عمير، لم نكتبه بهذا التمام إلَّا من هذا الوجه، وقال سليمان (يعني الطبراني): وأبو بدر هو عندي بشار بن الحكم البصري، صاحب ثابت البناني.
Reference / Source: Imam al-Bukhari narrated this in abridged form in "al-Tarikh al-Kabir" (5/ 25 and 6/ 530), and Imam al-Tabarani in full in "al-Mu'jam al-Kabir" (17/ 105) (and via him Abu Nu'aym in "al-Hilyah" 3/ 357). It is narrated with the chain of 'Amr bin Khalid al-Harrani, from Bukayr bin Khunays, from Abu Badr, from 'Abd Allah bin 'Ubayd bin 'Umayr.
Note / Clarification: Abu Nu'aym said after it: "It is gharib (unusual) as a hadith of 'Abd Allah bin 'Ubayd bin 'Umayr; we have not written it in this complete form except through this route." And Imam al-Tabarani said: "Abu Badr, in my view, is Bashshar bin al-Hakam al-Basri, the companion (student) of Thabit al-Bunani."

Details of the narration: In the narration of al-Marwazi, al-Fakihi and Ibn Bishran, when he (peace and blessings be upon him) was asked about the best jihad, he said: "The one whose blood is shed and whose horse is wounded (killed)." In some of the sources there are also words additional to al-Hakim's narration.
وقال أبو نعيم عقبه: هذا حديث تفرَّد به سويد موصولًا عن عبد الله، ورواه صالح بن كيسان عن الزهري عن عبد الله عن أبيه، من دون جده. قلنا: وسويد -وهو ابن إبراهيم الجحدري الحناط- ضعيف.
Technical note / Defect ('illah): Abu Nu'aym said after this narration that Suwayd is alone in narrating this hadith from 'Abd Allah bin 'Ubayd bin 'Umayr in connected (mawsul) form, whereas Salih bin Kaysan narrated it from al-Zuhri, from 'Abd Allah, from his father ('Ubayd bin 'Umayr), without mentioning the grandfather. We say: Suwayd (Ibn Ibrahim al-Jahdari al-Hannat) is a weak narrator.
ورواية صالح بن كيسان أخرجها البخاري في "التاريخ" 5/ 25، وابن نصر المروزي (643) من طريقين عن يعقوب بن إبراهيم بن سعد، عن أبيه، عن صالح، عن ابن شِهاب، عن عبد الله ابن عبيد بن عمير، عن أبيه عبيد بن عمير: أنَّ رسول الله ﷺ قيل له: ما الإسلام؟ قال: "إطعام الطعام وطيب الكلام" قيل: فما الإيمان؟ قال: "السماحة والصبر" قيل: فمن أفضل المسلمين إسلامًا؟ قال: "من سلم المسلمون من لسانه ويده" قيل: فمن أفضل المؤمنين إيمانًا؟ قال: "أحسنهم خلقا"، قيل: فما أفضل الهجرة؟ قال: من هجر ما حرم الله عليه. ورجاله ثقات لكنه مرسل.
Reference / Source: The narration of Salih bin Kaysan was transmitted by Imam al-Bukhari in "al-Tarikh" (5/ 25) and by Ibn Nasr al-Marwazi (643) through two routes from Ya'qub bin Ibrahim bin Sa'd, from his father, from Salih, from Ibn Shihab (al-Zuhri), from 'Abd Allah bin 'Ubayd bin 'Umayr, from his father 'Ubayd bin 'Umayr: that the Messenger of Allah (peace and blessings be upon him) was asked: "What is Islam?" He said: "Feeding people and good speech." It was asked: "What is iman (faith)?" He said: "Generosity and patience." It was asked: "Who is the best of the Muslims in Islam?" He said: "The one from whose tongue and hand the Muslims are safe." It was asked: "Who is the best of the believers in faith?" He said: "The best of them in character." It was asked: "What is the best hijrah?" He said: "Leaving what Allah has made unlawful for him."
Grading: All its narrators are thiqah (trustworthy), but this narration is "mursal" (a Successor attributing it directly to the Prophet (peace and blessings be upon him)).
ورواه مرسلًا كذلك عبد الرزاق (4844)، وسعيد بن منصور (2557) مختصرًا عن ابن عيينة، عن عمرو بن دينار قال: سمعت عبيد بن عمير يحدث قال: قيل: أي الجهاد أفضل؟ قال: "من عقر جواده وأهريق دمه" قيل: فأي الصلوات أفضل؟ قال: "طول القنوت" قيل: فأي الصدقة أفضل؟ قال: "جهد المقُل" قيل: فأي الهجرة أفضل؟ قال: "من هجر ما نهاه الله عنه ورسولُه" قيل: فأي الناس أحكم؟ قال: "الذي يحكم للناس كما يحكم لنفسه" قيل: فأي الناس أعلم؟ قال: "الذي يجمع علمَ الناس إلى علمه". قال: لا أعلم عبيدًا إلَّا رفعه إلى النبي ﷺ. ورجاله ثقات أيضًا.
Reference / Source: 'Abd al-Razzaq (4844) and Sa'id bin Mansur (2557), in abridged form, likewise narrated it as "mursal" from Sufyan bin 'Uyaynah, from 'Amr bin Dinar, who said: I heard 'Ubayd bin 'Umayr narrating: It was asked: "Which jihad is best?" He said: "The one whose horse is killed and whose blood is shed." It was asked: "Which prayer is best?" He said: "The one with long standing (qunut)." It was asked: "Which charity is best?" He said: "The effort of the one who has little." It was asked: "Which hijrah is best?" He said: "Leaving what Allah and His Messenger have forbidden." It was asked: "Which person judges best?" He said: "The one who judges for people as he judges for himself." It was asked: "Who is the most knowledgeable of people?" He said: "The one who gathers the knowledge of people to his own knowledge." The narrator said: I know only that 'Ubayd raised it (marfu') to the Prophet (peace and blessings be upon him).
Grading: Its narrators are also thiqah.
ورواه عثمان بن أبي سليمان عند أحمد 24/ (15401)، وأبي داود (1449)، والنسائي (2317) عن علي بن عبد الله الأزدي، عن عبيد بن عمير، عن عبد الله بن حُبشي: أنَّ النبي ﷺ سئل: أي الأعمال أفضل؟ قال: "إيمان لا شك فيه، وجهاد لا غُلول فيه، وحجة مبرورة" قيل: فأيُّ الصلاة أفضل؟ قال: "طول القنوت" قيل: فأي الصدقة أفضل؟ قال: "جهد المقلِّ" قيل: فأي الهجرة أفضل؟ قال: "من هجر ما حرم الله عليه" قيل: فأي الجهاد أفضل؟ قال: "من جاهد المشركين بماله ونفسه" قيل: فأي القتل أشرف؟ قال: "من أهريق دمه، وعقر جواده" فجعله من حديث عبد الله بن حبشي، ورجاله لا بأس بهم.
Reference / Source: 'Uthman bin Abi Sulayman narrated it, in Imam Ahmad (24/ 15401), Abu Dawud (1449) and al-Nasa'i (2317), from 'Ali bin 'Abd Allah al-Azdi, from 'Ubayd bin 'Umayr, from 'Abd Allah bin Hubshi: that the Prophet (peace and blessings be upon him) was asked: "Which deed is best?" He said: "Faith in which there is no doubt, jihad in which there is no misappropriation of spoils, and an accepted (mabrur) Hajj." In reply to further questions he declared best the prayer with long standing, the charity of the one who has little, the hijrah from what Allah has made unlawful, and jihad against the polytheists with one's wealth and self. About being killed (martyrdom) he said: "The one whose blood is shed and whose horse is killed."
Important point: This narration makes it a hadith of 'Abd Allah bin Hubshi, and there is no harm in its narrators (la ba'sa bihim).
ورواه جرير بن حازم عند ابن المبارك في "الجهاد" (51) قال: حدثني عبد الله بن عبيد بن عمير قال: قيل يا رسول الله: أي الجهاد أفضل؟ قال: "من عقر جواده وأهريق دمه"، فأعضله.
Reference / Source: Jarir bin Hazim narrated it in Ibn al-Mubarak's book "al-Jihad" (51), saying: 'Abd Allah bin 'Ubayd bin 'Umayr narrated to me that the Messenger of Allah (peace and blessings be upon him) was asked: "Which jihad is best?" He said: "The one whose horse is killed and whose blood is shed."
Technical note / Defect ('illah): Jarir bin Hazim made this narration "mu'dal" (two or more consecutive narrators missing from the chain).
ورواه عمران بن حدير كما في "التاريخ الكبير" للبخاري 5/ 143، و"علل الحديث" لابن أبي حاتم (1941) عن بديل بن ميسرة، عن عبد الله بن عبيد الليثي، عن أبيه -قال بديل: ولم يسمعه من أبيه- قال النبي ﷺ: "الإسلام طِيب الكلام". قلنا: سماعُ عبد الله بن عبيد من أبيه ثبَّته البخاري، لكن ربما هذا الحديث بعينه لم يسمعه من أبيه.
Reference / Source: 'Imran bin Hudayr narrated it, as in al-Bukhari's "al-Tarikh al-Kabir" (5/ 143) and Ibn Abi Hatim's "'Ilal al-Hadith" (1941), from Budayl bin Maysarah, from 'Abd Allah bin 'Ubayd al-Laythi, from his father, that the Prophet (peace and blessings be upon him) said: "Islam is good speech."
Technical note / Defect ('illah): Budayl says that 'Abd Allah did not hear it from his father. We say: Imam al-Bukhari affirmed that 'Abd Allah bin 'Ubayd heard from his father, but it is possible that he did not hear this particular hadith from his father.
قال أبو حاتم الرازي: قد صحَّ الحديث عن عبيد بن عمير عن النبي ﷺ مرسلًا، واختلفوا فيمن فوق عبيد بن عمير، وقصر قوم مثل جرير بن حازم وغيره؛ فقالوا: عن عبد الله بن عبيد ابن عمير، عن النبي ﷺ لا يقولون: عبيد، وحديث عمران بن حدير أشبه؛ لأنه بيَّن عورته. فسأله ابنه: فحديث الزهري هذا؟ قال: أخاف ألا يكون محفوظًا، أخاف أن يكون: صالح بن كيسان عن عبد الله بن عبيد نفسه؛ بلا زهري.
Important point: Abu Hatim al-Razi says that this hadith is authentically established from 'Ubayd bin 'Umayr from the Prophet (peace and blessings be upon him) as "mursal", but they differed about who is above 'Ubayd bin 'Umayr. Some, such as Jarir bin Hazim and others, cut it short, saying "from 'Abd Allah bin 'Ubayd bin 'Umayr, from the Prophet (peace and blessings be upon him)" without mentioning 'Ubayd. The hadith of 'Imran bin Hudayr is more likely correct, because he made its weakness (the absence of hearing) clear. When his son asked him about this hadith of al-Zuhri, he said: "I fear it is not preserved (mahfuz); I fear it is Salih bin Kaysan from 'Abd Allah bin 'Ubayd himself, without al-Zuhri."
وفي باب "الإيمانُ السماحةُ والصبر" عن عمرو بن عبسة عند أحمد 32/ (19435)، وعن عبادة ابن الصامت عنده أيضًا 37 / (22717)، وعن جابر عند ابن أبي شيبة 11/ 33، وأبي يعلى (1854)، ولا يخلو كل منها من مقال، لكن تتقوى بمجموع طرقها.
Corroborating chains and supporting reports: In the chapter "Faith is generosity and patience" there are narrations from other Companions as well: 'Amr bin 'Abasah (Musnad Ahmad 32/ 19435), 'Ubadah bin al-Samit (Musnad Ahmad 37/ 22717) and Jabir bin 'Abd Allah (Ibn Abi Shaybah 11/ 33 and Abu Ya'la 1854).
Grading: Although each of these chains has some criticism (weakness), all these routes together strengthen one another.
وفي باب أفضل المؤمنين أحسنهم خلقًا عن أبي هريرة سلف عند المصنف برقم (1).
Reference / Source: In the chapter "The best of the believers is the best of them in character", the narration of Abu Hurayrah (may Allah be pleased with him) has already passed with the author (al-Hakim) at number (1).
وفي باب المسلم من سلم المسلمون من لسانه ويده عن أبي هريرة وجابر وفضالة بن عبيد وبلال بن الحارث، سلفت أحاديثهم عند المصنف على التوالي بالأرقام (22) و (23) و (24) و (6325).
Corroborating chains and supporting reports: In the chapter "The Muslim is the one from whose tongue and hand the Muslims are safe", the narrations of Abu Hurayrah, Jabir, Fadalah bin 'Ubayd and Bilal bin al-Harith (may Allah be pleased with them) have already passed with the author (al-Hakim) at numbers (22), (23), (24) and (6325) respectively.
وفي باب أفضل الجهاد كلمة عدل عند إمام جائر عن طارق بن شِهاب عند أحمد 31 (18828) و (18830)، والنسائي (7786).
Reference / Source: In the chapter "The best jihad is a word of justice before a tyrannical ruler", the narration of Tariq bin Shihab is in Musnad Ahmad (31/ 18828 and 18830) and al-Nasa'i (7786).
وعن أبي أمامة عند أحمد 36/ (22158)، وابن ماجه (4012).
Reference / Source: A narration with the same meaning is reported from Abu Umamah (may Allah be pleased with him) in Musnad Ahmad (36/ 22158) and Sunan Ibn Majah (4012).
وعن أبي سعيد الخدري عند أبي داود (4344)، وابن ماجه (4011)، والترمذي (2174)، وسيأتي عند المصنف برقم (8754) من طريق آخر.
Reference / Source: From Abu Sa'id al-Khudri (may Allah be pleased with him) this narration is in Sunan Abi Dawud (4344), Sunan Ibn Majah (4011) and Sunan al-Tirmidhi (2174), and it will come later with the author at number (8754) through another route.

Note / Clarification: In this connection see the hadith of Jabir (may Allah be pleased with him) that has passed at number (4945).
ويشهد لقوله: "أعظم المسلمين جرمًا … إلخ" حديث سعد بن أبي وقاص عند البخاري (7289)، ومسلم (2358).
Corroborating chains and supporting reports: For his (peace and blessings be upon him) saying "The Muslim who commits the greatest crime (etc.)" a supporting report is the hadith of Sa'd bin Abi Waqqas (may Allah be pleased with him) in Sahih al-Bukhari (7289) and Sahih Muslim (2358).
