حدثنا أبو علي الحسين بن علي الحافظ، حدثنا الحسين بن عبد الله الرَّقِّي، حدثنا علي بن مَعْبَد الرَّقِّي، حدثنا بقيّة بن الوليد، حدثنا مبشِّر بن عُبيد، عن الحجَّاج بن أَرْطاةَ، عن الفُضيل بن عمرو، عن سالم بن أبي الجعد، عن وابصةَ ابن مَعبَد قال: سمعتُ النبيَّ ﷺ يقول: "لا تتَّخِذوا ظهورَ الدوابِّ منابرَ، وشرُّ هذه الدوابِّ الثَّعَلُ (1) " (2). ذكرُ خُرَيم بن فاتِك الأسَدي (1) ﵁- [التعليق - من تلخيص الذهبي] ترقيم العلميه 6605 - حديث واهي
It is narrated from Sayyiduna Wabisah bin Ma'bad (may Allah be pleased with him) that he said: I heard the Prophet (peace and blessings be upon him) saying: "Do not make the backs of animals into pulpits, and the worst of these animals are those that stumble or are feeble."

(2) إسناده تالف؛ مبشر بن عبيد -وهو القرشي الحمصي- متهم بالكذب. وضعفه جدًا أبو القاسم البغويُّ والحافظ ابن حجر في "الإصابة"، ووهّاه الذهبي في "التلخيص". Grading: This chain is "talif" (unreliable). Technical note / Defect ('illah): The narrator Mubashshir bin Ubayd al-Qurashi al-Himsi is accused of lying. Imam al-Baghawi and al-Hafiz Ibn Hajar called him very weak, and al-Dhahabi declared it wahin (utterly weak) in "al-Talkhis". وسالم بن أبي الجعد كذا نُسب في روايتي الحاكم والطبراني، بينما نسب في كتب "الصحابة": سالم بن وابصة، وذكروا هذا الحديثَ في ترجمته، وكلٌّ من سالم بن أبي الجعد وسالم بن وابصة يروي عن وابصة كما ذكر المزي في ترجمة وابصة من "التهذيب" 30/ 393، لكن سالم بن وابصة هو الأشهر في الرواية عن أبيه وابصة، انظر "الجرح والتعديل" 4/ 188، و"تاريخ الرقة" للحافظ أبي علي الحراني ص 28 - 29. Technical note / Defect ('illah): In the narrations of al-Hakim and al-Tabarani he is named "Salim bin Abi al-Ja'd", whereas in the books on the Companions he is "Salim bin Wabisah", and this hadith is mentioned in his biography. According to al-Mizzi both of them narrate from Wabisah, but his son Salim bin Wabisah is better known for narrating from his father. وأخرجه الطبراني في "الكبير" 22/ (389) عن المقدام بن داود المصري، عن علي بن معبد الرقي، بهذا الإسناد. Reference / Source: Al-Tabarani recorded it in "al-Kabir" (22/ 389) via al-Miqdam bin Dawud al-Misri from Ali bin Ma'bad al-Raqqi, with this same chain. وأخرج شطره الثاني في ترجمة سالم بن وابصة: أبو القاسم البغوي في "معجم الصحابة" (1059)، وابن قانع في "معجم الصحابة" 3/ 185، وابن عدي في "الكامل" 6/ 418 و 418 - 419 (في ترجمة مبشر)، وابن منده في "معرفة الصحابة" 2/ 719، وأبو نعيم في "معرفة الصحابة" (3446) من طرق عن بقية بن الوليد، عن مبشر بن عبيد، عن الحجاج، عن الفضيل، عن سالم بن وابصة قال: سمعتُ رسول الله ﷺ يقول: "ألا إنَّ شرَّ هذه السباع الأثعلُ"، وقال البغوي عقبه: ولا أحسب فضيل بن عمرو سمع من سالم بن وابصة، والذي حدَّث بهذا الحديث بقيةُ عن مبشر بن عبيد، ومبشر ضعيف جدًا، ولا أعلم بهذا الإسناد غير هذا الحديث. وقال ابنُ منده وأبو نعيم: سالم بن وابصة مجهول. Reference / Source: The second part of this hadith was recorded by al-Baghawi, Ibn Qani', Ibn Adi, Ibn Mandah and Abu Nu'aym via Baqiyyah bin al-Walid from Mubashshir bin Ubayd. Grading: Mubashshir bin Ubayd is extremely weak, and no other hadith is known with this chain besides this one. Technical note / Defect ('illah): According to Imam al-Baghawi, Fudayl bin Amr's hearing from Salim bin Wabisah is not established, while Ibn Mandah and Abu Nu'aym declared Salim bin Wabisah "majhul". وفُسِّر "الأثعل" عند البغوي وابن قانع وأبي نعيم بالثعالب، ولم يُذكر اسمُ من فسَّره بذلك، وهذا التفسير مخالف للمعروف في كتب اللغة. Note / Clarification: With al-Baghawi, Ibn Qani' and Abu Nu'aym the word "al-ath'al" is explained as "foxes" (tha'alib), but the name of the one who gave this explanation is not known. Technical note / Defect ('illah): This explanation contradicts the well-known books of language. قلنا: والمقصود به: الحيوان المفترس الشديد الافتراس كالضَّبُع والذئب ونحوهما. Important point: What is established is that "al-ath'al" means a predator that savages its prey fiercely, such as the hyena (dabu') or the wolf. وفي باب النهي عن اتخاذ الدوابِّ منابرَ عن أبي هريرة عند أبي داود (2567) بلفظ: "إياي أن تتخذوا ظهورَ دوابِّكم منابر؛ فإن الله إنما سخَّرها لكم لتُبلغكم إلى بلدٍ لم تكونوا بالغيه إلا بشقِّ الأنفس، وجعل لكم الأرضَ، فعليها فاقضوا حاجاتِكم"، وإسناده حسن. وانظر شرحَه والتعليقَ عليه هناك. General principle: In the chapter on the prohibition of making the backs of animals into pulpits (places for prolonged sitting), Abu Hurayrah (may Allah be pleased with him) narrated that he (peace and blessings be upon him) said: "Do not make the backs of your animals into pulpits; Allah has subjected them to you only so that they may carry you to distant lands, and He has made the earth for you, so fulfil your needs (sitting) on the earth." Grading: Its chain is "hasan" (Abu Dawud: 2567).
