Mustadrak al-Hakim — Hadith 4649

فحدَّثَناه أبو عبد الله محمد بن يعقوب الشَّيباني، حدثنا حامد بن أبي حامد المقرئ، حدثنا عبد الرحمن بن عبد الله بن سعد الدَّشْتَكي، حدثنا عمرو بن أبي قيس الرازي، عن إبراهيم بن مُهاجِر، عن أبي الشَّعثاء، عن عمِّه، عن أسامة بن زيد، قال: بعثني رسولُ الله ﷺ في سَرِيّة في أُناس من أصحابه، فاستَبَقْنا أنا ورجلٌ من الأنصار إلى العدوّ، فحملتُ عليه، فلما دنوتُ منه كَبّر، فطعنتُه فقتلتُه، ورأيتُ أنه إنما فَعَل ذلك ليُحرِزَ دمَه، فلما رجعْنا سبقَني إلى النبيّ ﷺ، فقال: يا رسول الله، لا فارسَ خيرٌ من فارسِكم، إنّا استَلحَقْنا رجلًا فسبقَني إليه، فكبّر فلم يمنعه ذلك أن قَتَلَه، فقال النبي ﷺ: "يا أسامةُ، ما صنعتَ اليوم؟ " فقلت: حملتُ على رجلٍ فكبّر، فرأيتُ أنه إنما فعل ليُحرِزَ دمَه فقتلتُه، فقال: "كيف بعدَ اللهُ أكبرُ، فهلّا شَقَقَتَ عن قلبِه فعَلِمت (1) ما قال؟! فلم يزَلْ يقول لي يومئذٍ، فلا أقاتلُ رجلًا يقول: اللهُ أكبرُ مما نهاني عنه، حتى ألقاُه (2).
It is narrated from Sayyiduna Usamah bin Zayd (may Allah be pleased with him) that he said: The Messenger of Allah (peace and blessings be upon him) sent me on a sariyyah (military expedition) together with some of his Companions. A man of the Ansar and I rushed towards a man of the enemy. I attacked him, and when I came near him he said 'Allahu Akbar', but I struck him with my spear and killed him, for I thought he had said these words only to save his life. When we returned, he (the Ansari) reached the Prophet (peace and blessings be upon him) before me and said: O Messenger of Allah! There is no horseman better than this horseman of yours. We pursued a man, and I was just about to reach him when he said 'Allahu Akbar', yet that did not stop him (Usamah) from killing him. The Prophet (peace and blessings be upon him) said: "O Usamah! What is this you did today?" I said: I attacked a man and he said 'Allahu Akbar'; I thought he had done so only to save his life, so I killed him. He (peace and blessings be upon him) said: "After he had said 'Allahu Akbar', what then will become of you (before Allah)? Why did you not split open his heart and look, so that you would know what he had said (sincerely)?!" He (peace and blessings be upon him) kept saying this to me that whole day. (Usamah, may Allah be pleased with him, says:) So now I will not fight any man who says 'Allahu Akbar', because the Messenger of Allah (peace and blessings be upon him) has forbidden me from it, until I meet him (peace and blessings be upon him).

(1) في النسخ الخطية: فقلت، وهو تحريف إذ لا يُفهَم الكلام بها، والصواب ما أثبتنا، وهو موافق لبعض روايات هذا الخبر.
Note / Clarification: (1) The manuscripts have "fa-qultu" (so I said), which is a corruption since the sentence cannot be understood with it. The correct reading is what we have established, and it agrees with some narrations of this report.

(2) حديث صحيح لكن بذكر "لا إله إلّا الله" بدل "الله أكبر"، وهذا إسناد ضعيف لجهالة عم أبي الشعثاء - واسم أبي الشعثاء سُليم بن أسود المُحاربي - وإبراهيم بن مُهاجر ضعيف يعتبر به في المتابعات والشواهد ولكنه اختلف عليه في إسناده فروي عنه مرة بزيادة ذكر إبراهيم النخعي بينه وبين أبي الشعثاء، كما في الطريق التالية.
Grading: (2) The hadith is sahih, but with the mention of "La ilaha illa Allah" instead of "Allahu akbar". This chain is weak because the paternal uncle of Abu al-Sha'tha' (Sulaym bin Aswad al-Muharibi) is unknown. Ibrahim bin Muhajir is weak but is considered in corroborating chains and supporting reports; however, there is disagreement over his chain: sometimes Ibrahim al-Nakha'i is mentioned as an intermediary between him and Abu al-Sha'tha', as in the next route.
وأخرجه ابن أبي عاصم في "الديات" ص 35 عن أبي عمرو عثمان بن سعيد بن عمرو، عن عبد الرحمن بن عبد الله بن سعد الدشتكي الرازي، بهذا الإسناد.
Reference / Source: Ibn Abi Asim narrated it in "al-Diyat" (page 35) from Abu Amr Uthman bin Sa'id, from Abd al-Rahman bin Abdullah bin Sa'd al-Dashtaki, with this same chain.
وأخرجه بنحوه أحمد 36/ (21745) و (21802)، والبخاري (4269) و (6872)، ومسلم (96)، وأبو داود (2643)، والنسائي (8540) و (8541)، وابن حبان (4751) من طريق أبي ظَبيان حُصين بن جُندب، عن أسامة بن زيد. غير أنه جاء في هذه الرواية أنَّ الرجل الذي قتله أسامة قال: لا إله إلّا الله.
Reference / Source: Ahmad (36/21745, 21802), al-Bukhari (4269, 6872), Muslim (96), Abu Dawud (2643), al-Nasa'i (8540, 8541) and Ibn Hibban (4751) narrated it through the route of Abu Zabyan Husayn bin Jundub from Usamah bin Zayd. But in this narration, the man whom Usamah killed said "La ilaha illa Allah".
