Musannaf Ibn Abi Shaybah

Aswad bin Yazid narrates that Hazrat Mu'adh (may Allah be pleased with him) said regarding the daughter and the full sister that the sister will receive half of the wealth and the daughter will receive half of the wealth.

The same statement is also narrated from Hazrat Aswad through another chain of transmission.

Aswad bin Yazid narrates that Ibn Zubair (may Allah be pleased with him) held the opinion that in the presence of a daughter, the sister should not be given anything. Until I narrated to him this hadith: that Hazrat Mu'adh (may Allah be pleased with him) in Yemen gave the ruling regarding a daughter and a full sister that half of the wealth would be for the daughter and half for the sister. Upon this, he said: Go as my messenger to Ibn Utbah and command him regarding this matter.

Aswad narrates that I told the statement of Hazrat Mu'adh (may Allah be pleased with him) to Hazrat Ibn Zubair (may Allah be pleased with him), so he said, "You are my messenger to Ibn Utbah; give him this command."

Abu Salamah narrates that Hazrat Umar (may Allah be pleased with him) divided the wealth equally between the daughter and the sister.

It is narrated from Abu Husain that Abdullah bin Utbah said regarding the daughter and the sister that each of them will receive half.

Aswad narrates that Abdullah ibn Zubair (may Allah be pleased with him) had intended to deprive sisters of inheritance in the presence of daughters. When I related to him the hadith that Mu'adh (may Allah be pleased with him) had given a ruling among us regarding this matter, he then made both the sister and the daughter heirs.

Hazrat Aamir says that Hazrat Ali (may Allah be pleased with him), Ibn Masood, and Mu'adh (may Allah be pleased with them) used to say regarding the shares of the daughter and the sister that each receives half, and this is also the opinion of the companions of Muhammad (ﷺ) except for Hazrat Ibn Zubair (may Allah be pleased with him) and Hazrat Ibn Abbas (may Allah be pleased with them both).

Musayyib bin Rafi’ narrates that I was sitting with Abdullah bin Utbah when he instructed me to reconcile between the daughter and the sister, and Hazrat Ibn Zubair (may Allah be pleased with him) had instructed him not to make the sister an heir in the presence of the daughter. I was about to reconcile between the two when Aswad bin Yazid arrived and said that he had seen Hazrat Mu’adh (may Allah be pleased with him) in Yemen distribute wealth between the daughter and the sister. I went to Hazrat Ibn Zubair (may Allah be pleased with him) and informed him of this, so he instructed me to go to you and inform you as well, so that you may decide accordingly and send this matter in writing to them. And he said, “O Aswad! In our view, you are a truthful man. Go to them and inform them of this so that they may decide accordingly.” Abu Bakr says that this issue will be resolved in two shares, one share for the daughter and one for the sister.
