Musannaf Ibn Abi Shaybah

It is narrated from Abu Muhallab that Hazrat Uthman (may Allah be pleased with him) was asked about this case, so he said: The woman gets one-fourth of the wealth, the mother gets one-third of the remaining wealth, and all the rest of the wealth is for the father.

It is narrated from Sa'id bin Musayyib that Hazrat Zaid bin Thabit (may Allah be pleased with him) was asked about the shares of the wife and parents, so he ordered to give the wife one-fourth, the mother one-third of the remaining wealth, and the wealth left after that to the father.

It is narrated from Sha'bi that Hazrat Ali (may Allah be pleased with him) was asked about the shares of the wife and the parents, so he said that the wife gets one-fourth and the mother gets one-third of the remainder.

Ibrahim narrates that Abdullah (may Allah be pleased with him) was asked about the shares of one wife and the parents. He replied: Whenever we followed the path of Umar (may Allah be pleased with him), we found it to be straight. A case regarding the shares of one wife and the parents was brought to him, so he divided the wealth into four parts, gave one fourth to the wife, one third of the remaining wealth to the mother, and the rest of the wealth to the father.

The same is also narrated from Hazrat Umar (may Allah be pleased with him) through another chain of transmission.

Shu'bi narrates from Hazrat Ali (may Allah be pleased with him) regarding the situation when among the heirs are the wife and the parents, that the wife receives one-fourth, and the mother receives one-third of the remaining wealth, and the rest is for the father.

Hazrat Abdullah also narrated this subject from Hazrat Umar (may Allah be pleased with him), however, he added that he was asked about the situation when the heirs of the deceased include the wife and the parents.

Hazrat Abdullah (may Allah be pleased with him) narrates that when Hazrat Umar (may Allah be pleased with him) adopted an opinion and then we adopted that opinion, we found it to be easy. Thus, he was asked about (inheritance shares of) the wife and the parents, so he said: For the wife, one-fourth; for the mother, one-third of the remaining wealth; and whatever remains after that is for the father.

Ibrahim states that Hazrat Ibn Abbas (may Allah be pleased with them) opposed the majority of scholars regarding the issue of inheritance for the wife, parents, and husband. He said that the mother receives one third of the entire estate.

Ayyub narrates that Muhammad bin Sirin (may Allah have mercy on him) said: What prevents people from deriving this issue from the number 12, and giving the woman three shares, the mother four shares, and the father five shares.

Musayyib bin Rafi' narrates that Hazrat Abdullah (may Allah be pleased with him) said: Allah Almighty will not see me giving preference to my mother over my father.

Hazrat Abdullah narrates that when Hazrat Umar (may Allah be pleased with him) adopted an opinion and we followed him in that opinion, we found it to be easy. Thus, he was asked about the issue of inheritance regarding the wife and parents, so he gave the wife one-fourth and the mother one-third of the remaining wealth, and ordered that the rest of the wealth be given to the father.

Hajjaj narrates from a shaykh, from Muhammad bin Hanafiyyah, that in the case where both wife and parents are heirs, the wife will be given one-fourth and the mother will be given one-third of the remainder. Abu Bakr says that this will be out of four shares: one share for the wife, that is, one-fourth, and one-third of the remainder for the mother, which will also be one share, and two shares for the father.
