Hadith 32947
٣٢٩٤٧ - حدثنا وكيع قال: ثنا الأعمش قال: سمعت الشعبي يقول في المسجد مرة: سمعت حديثًا ما بقي أحد سمعه غيري، سمعت عمرو بن شرحبيل يقول: قال عبد اللَّه: إنكم معشر اليمن من أجدر قوم أن يموت الرجل ولا يدع عصبة فليضع ماله حيث شاء (١).
A'mash narrates that I once heard Sha'bi in the mosque saying: I have heard such a hadith that among those who heard it, no one except me is still alive. I heard 'Amr bin Shurahbil saying: Abdullah (may Allah be pleased with him) said: O people of Yemen! It often happens among you that a man dies and leaves behind no agnatic relatives; such a person has the choice to dispose of his wealth as he wishes. A'mash says: I mentioned to Ibrahim that Sha'bi had said this. Ibrahim replied: Hammam bin al-Harith narrated to me from 'Amr bin Shurahbil from Abdullah the same statement.
Hadith 32949
٣٢٩٤٩ - حدثنا أبو أسامة عن هشام بن عروة عن ابن سيرين قال: سألت عبيدة عن رجل ليس عليه عقد وليس عليه عصبة، يوصي بماله كله؟ قال: نعم.
Muhammad bin Sirin narrates that I asked Ubaidah about a man who has neither any dealings with anyone nor any living relative who could be his heir, whether such a person can bequeath all of his wealth at the time of death? He replied: Yes!
Hadith 32950
٣٢٩٥٠ - حدثنا وكيع عن إسماعيل عن الشعبي عن مسروق سئل عن رجل مات ولم يترك مولى عتاقة ولا وارثًا، قال: (ماله) (١) حيث وضعه، فإن لم يكن أوصى بشيء فماله في بيت المال.
Shu'bi narrates that Hazrat Masruq was asked about a person who, at the time of death, left neither a freeing master nor any heir. He replied that Hazrat Salim has said that his wealth should be spent wherever he has made a bequest for it to be spent, and if he has made no bequest, then his wealth should be deposited in the public treasury (Bait-ul-Mal).
Hadith 32951
٣٢٩٥١ - حدثنا عبد الأعلى عن يونس عن الحسن في رجل والى رجلًا فأسلم على يديه، قال: إن شاء أوصى بماله كله.
Yunus narrates that Hasan (may Allah have mercy on him) said regarding the man who made a contract of alliance with someone and then accepted Islam at his hand, that if this man also wishes, he can bequeath all of his wealth at the time of death.
Hadith 32952
٣٢٩٥٢ - حدثنا جرير عن مغيرة أن أبا العالية أوصى بميراثه لبني هاشم.
Mughira narrates that Hazrat Abu Al-Aaliyah had bequeathed his inheritance for the Banu Hashim.
