Sale of ‘Urbun

The Holy Prophet (peace and blessings be upon him) has declared ‘urbān permissible in trade. ‘Urbān is when a person pays half the price of something and says that if the sale is completed, this will be counted as part of the price, otherwise, this amount will be yours and I will not take it back from you.

Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) says that 'Arban is not permissible in fat, fodder, and wheat, and 'Arban is permissible in things other than these.

Hazrat Mujahid did not consider there to be any harm in 'urban.

Hazrat Ibn Sirin (may Allah have mercy on him) did not consider it objectionable for a person to give money to a boatman or someone else saying, "If I go to such and such place, it is his, and if I do not go, then this money is yours."

Hazrat Hamzah bin Abdullah bin Umar (may Allah be pleased with them) narrates that we used to sell clothes in the presence of Ibn Umar (may Allah be pleased with them). Whoever gave fidya would give it in dirhams. So he neither commanded us nor forbade us.

It is narrated from Hazrat Abdur Rahman bin Farukh that Hazrat Nafi’ bin Abdul Harith bought a prison from Safwan bin Umayyah for four thousand dirhams on the condition that if Hazrat Umar (may Allah be pleased with him) agreed, the sale would be valid, and if Hazrat Umar (may Allah be pleased with him) did not agree, then four hundred dirhams would belong to Safwan.

Hazrat Ibn Sirin (may Allah have mercy on him) used to say regarding the person who rents a house or a boat on the condition that if he goes to such and such place, then it is for him, otherwise this amount is yours: he said, if he does not go, then the amount will belong to him.

Hazrat Ata and Hazrat Tawus (may Allah have mercy on them) disliked 'Urbaan in trade.
