Musannaf Ibn Abi Shaybah

Hazrat Ibn Abbas (may Allah be pleased with them both) was asked: If a man has several wives, divorces one of them, and then passes away, but it is not known which one he divorced, what is the ruling? He replied: All of them will receive the same share of divorce as they would receive from the inheritance.

Hazrat Sha'bi (may Allah have mercy on him) says that a man had four wives. He divorced one of them and married another woman. Then he passed away, and it was not known which one he had divorced. In this case, three-fourths of the inheritance will be given to the first four wives, and one-fourth will be given to the fifth wife.

Ibrahim (may Allah have mercy on him) said that if a man has four wives and he divorces one of them, but it is not known which one he divorced, and then he marries a fifth woman, then the one whom he married will receive a quarter from the inheritance, and the remaining three quarters will go to the remaining women.

Hazrat Mak'hool (may Allah have mercy on him) says that if a man has four wives and he divorces one of them and marries a fifth, and then he passes away and it is not known which one he divorced, then in this case, one-fourth of one-eighth will be given to the woman whom he married last, and three-fourths will be given to the remaining four women.

Hazrat Ata (may Allah have mercy on him) was asked about this matter, so he said that a quarter of a quarter or a quarter of an eighth will be given to the woman whom he married last, and the remainder will be distributed among the other women.

Hazrat Saeed bin Musayyib (may Allah have mercy on him) and Hazrat Hasan (may Allah be pleased with him) say that a draw will be held among them.
