If a Man Is Unable to Provide for His Wife, Should He Be Forced to Divorce Her?
Hadith 20127
٢٠١٢٧ - حدثنا أبو بكر قال: نا ابن عيينة (١) عن أبي الزناد قال: سألت سعيد ابن المسيب عن الرجل يعجز عن نفقة امرأته فقال: يفرق بينهما فقلت: سنة؟ ⦗٤٢٧⦘ فقال: سنة (٢).
Hazrat Abu Zanad (may Allah have mercy on him) says that I asked Hazrat Saeed bin Musayyib (may Allah have mercy on him) if a person is unable to provide maintenance for his wife, will he be compelled to divorce her or not? He replied that separation will be made between the two. I asked, is this Sunnah? He replied, yes, this is Sunnah.
Hadith 20128
٢٠١٢٨ - حدثنا أبو بكر قال: نا علي بن مسهر عن سعيد عن قتادة عن سعيد بن المسيب قال: سألته (عن) (١) الرجل يعسر عن نفقة امرأته، (فقال) (٢): (لا بد) (٣) من أن ينفق أو يطلق.
Hazrat Qatadah (may Allah have mercy on him) says that I asked Hazrat Saeed bin Musayyib (may Allah have mercy on him) whether a person who is unable to provide maintenance for his wife should be compelled to divorce her or not? He replied that he should either provide maintenance or divorce.
Hadith 20129
٢٠١٢٩ - حدثنا أبو بكر قال: نا عبد الرزاق عن معمر عن الزهري قال: (يستأنى) (١) به.
Hazrat Zuhri (may Allah have mercy on him) says that he should be given respite, and he also says that Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) says the same.
Hadith 20131
٢٠١٣١ - حدثنا أبو بكر قال: نا حفص عن عمرو عن الحسن قال إذا عجز الرجل (عن) (١) نفقة امرأته لم يفرق بينهما.
Hazrat Hasan (may Allah be pleased with him) says that if a person is unable to provide maintenance for his wife, separation will not be effected between them.
Hadith 20132
٢٠١٣٢ - حدثنا أبو بكر قال: نا عمر بن هارون عن ابن (جريج) (١) عن عطاء في الرجل يعجز عن نفقة امرأته، قال: لا يفرق بينهما، (امرأة) (٢) ابتليت فلتصبر.
Hazrat Ata (may Allah have mercy on him) says that if a person is unable to provide maintenance for his wife, separation will not be enforced between them. This woman is being tested; she should be patient.
Hadith 20133
٢٠١٣٣ - حدثنا أبو بكر قال: نا غندر عن شعبة قال: سألت حمادًا عن رجل تزوج امرأة (و) (١) لم يكن عنده ما ينفق قال: (يؤجل) (٢) سنة، قلت فإن لم يجد؟ قال: يطلقها.
Hazrat Shu’bah, may Allah have mercy on him, says that I asked Hazrat Hammad: If a person marries a woman but has nothing to give her, what should he do? He replied that he should be given a respite of one year. I asked: If even after that he is unable to give anything, what is the ruling? He replied that he should divorce her.
Hadith 20134
٢٠١٣٤ - حدثنا أبو بكر قال: نا أبو أسامة عن سفيان عن يحيى بن سعيد عن (سعيد) (١) بن المسيب قال: يفرق بينهما.
Hazrat Saeed bin Musayyib (may Allah have mercy on him) says that separation will be made between the two.
