Musannaf Ibn Abi Shaybah

Yunus (may Allah have mercy on him) narrates that a man from Syria told me that we were in a military expedition, when one of our companions was afflicted with a disease that made him speak incoherently. He gave his wife three divorces. When he recovered, people told him that he had said such and such things. He said, "I have no knowledge that I said anything like that, whether little or much, and I do not know." One of us rode out for some need to Umar bin Abdul Aziz (may Allah have mercy on him). When he had fulfilled his need, he asked about this matter. He (Umar bin Abdul Aziz) said, "It has no effect."

It is narrated similarly through another chain of transmission.

Hazrat Hakam (may Allah have mercy on him) says that the divorce of a person suffering from a disease called Barsam, who speaks incoherently, and of a feverish person who speaks incoherently, and the marriage of a madman, are not valid.

Hazrat Dahhak (may Allah have mercy on him) says that hunting by a person suffering from Barsam and the divorce of someone who has lost their senses are not valid during their illness.

Hazrat Jabir bin Zaid (may Allah have mercy on him) says that if a person who hunts with barsam (a type of weapon) speaks incoherently and does not understand his own words, then his divorce and freeing (of slaves) are not considered valid.

Ibrahim (may Allah have mercy on him) said that the divorce of a person afflicted with barsam is not valid.

Ibrahim (may Allah have mercy on him) said that the divorce of a person afflicted by barsam is not valid, nor is the divorce of a person who is struck by any calamity other than intoxication that impairs his intellect.

Ayub (may Allah have mercy on him) says that I wrote a letter to Hazrat Abu Qilabah (may Allah have mercy on him) and asked him about the divorce of a person who hunts with barsam. He wrote to me in a letter that in this matter, the testimony of witnesses will be considered; if he has understanding, then his divorce is valid, and if he does not have understanding, then his divorce is not valid.
