A Man Marrying a Woman After Committing Zina with Her

Hazrat Abu Yazid says that Saba’ bin Thabit married the daughter of Rabah bin Wahb. Saba’ had a son from another woman, and the daughter of Rabah had a daughter from another husband. The boy committed adultery with the girl and the girl became pregnant. This matter was brought before Hazrat Umar bin Khattab (may Allah be pleased with him), and both of them confessed to the sin. Hazrat Umar (may Allah be pleased with him) had them flogged and expressed the desire that they be married, but the boy refused.

Hazrat Ibn Abbas (may Allah be pleased with both of them) was asked: If a man and a woman are mutually involved in an immoral act, and the prescribed punishment is also carried out on them, and then that man wishes to marry that woman, what is the ruling? He replied: There is no harm in it; the matter began with immorality and will end with marriage.

Hazrat Sha'bi says that this matter began with evil and will end with marriage.

Hazrat Akhnas says that one night I was reciting Surah { حم عسق }, when I reached this verse: He is Allah who accepts the repentance of His servants and forgives their mistakes, and He knows whatever you do. This verse had a great effect on my heart, so in the morning I went to Hazrat Abdullah (may Allah be pleased with him) to ask about it. Meanwhile, a man came to him and said, "If a person commits adultery with a woman and then marries her, what is the ruling on this?" Upon this, Hazrat Abdullah (may Allah be pleased with him) recited this verse: "He is Allah who accepts the repentance of His servants and forgives their mistakes."

Hazrat Ibn Umar (may Allah be pleased with them both) narrates that the beginning of this matter is evil and its end is marriage, or he said: its beginning is unlawful and its end is lawful.

Hazrat Zuhri narrates that when an unmarried man and woman committed adultery, Hazrat Abu Bakr (may Allah be pleased with him) had them flogged and exiled for one year, and after one year, he had them married to each other.

Hazrat Saeed bin Musayyib did not consider there to be any objection in this marriage.

Ibrahim narrates that a person asked Hazrat Alqama whether it is permissible if someone commits adultery with a woman and then marries her. He replied, "Yes," and then recited this verse of the Holy Qur'an: "Allah accepts the repentance of His servants and forgives their mistakes."

Hazrat Shaibah narrates that a person asked Hazrat Saeed bin Jubair whether it is permissible if someone commits adultery with a woman and then marries her. He replied that the beginning of this matter is evil and its end is marriage, and wealth has made this woman lawful for the man.

Hazrat Amr narrates that a person asked Hazrat Jabir bin Zaid whether it is permissible if someone commits adultery with a woman and then marries her. He replied, "He has more right to that woman because he is the one who corrupted her."

Hazrat Ikrimah says about this marriage that there is no harm in it. The example of such a person is like someone who steals dates and then buys them.

Hazrat Salim says that there is no harm in it.

Hazrat Jabir bin Abdullah (may Allah be pleased with him) narrates that when both repent and reform themselves, then there is no harm in it.

Hazrat Sillah bin Ashyam says that there is no harm in doing so; if both of them repent, then Allah is the One who accepts their repentance. If they are sinful, then only a sinner is suitable for a sinner.

Hazrat Yahya bin Saeed narrates that once Hazrat Umar bin Abdul Aziz was asked: If a woman commits a sin with a man, and later good deeds begin to appear from her actions and conduct, can she marry that man? Hazrat Umar bin Abdul Aziz replied: Do you think that I would prohibit this?!

Hazrat Ubaidullah bin Abi Yazid narrates that a person asked Hazrat Ibn Abbas (may Allah be pleased with them) whether it is permissible if someone commits adultery with a woman and then marries her. He replied, "Now he has found the lawful way."

Hazrat Mujahid and Hazrat Ata state that if a person commits adultery with a woman, it is permissible to marry that woman.

Hazrat Saeed bin Musayyib, Hazrat Jabir bin Abdullah (may Allah be pleased with him), and Hazrat Saeed bin Jubair state that if a person commits adultery with a woman and then marries her, there is no harm in it if both repent and change their way of life.

Hazrat Ikrimah narrates that a person asked Hazrat Abdullah bin Abbas (may Allah be pleased with them) whether it is permissible if someone commits adultery with a woman and then marries her. He replied: Its beginning was evil and its end is marriage; its beginning is forbidden and its end is lawful.
