Ruling if a Man Marries a Woman and Finds Her to Have Leprosy or Vitiligo After Consummation

Hazrat Umar (may Allah be pleased with him) says that if a man marries a woman, and then finds out that the woman has leprosy, leukoderma, or insanity, but he has already consummated the marriage with her, then due to the permissibility of intercourse, the dowry will be obligatory upon the man. Its compensation will be taken from the woman's guardian.

Hazrat Ali (may Allah be pleased with him) says that if someone marries a woman who is insane or suffering from leukoderma and then consummates the marriage with her, she is his wife; but if he does not consummate the marriage, separation will be effected between them.

Hazrat Jabir bin Zaid says that it is neither permissible to marry four types of women nor is it correct to buy them as slaves: a woman afflicted with leucoderma, a madwoman, a leprous woman, and a woman suffering from a disease of the womb or private parts.

Hazrat Khalid narrates that a man married a woman, and then some defect was discovered in her. Regarding this matter, he wrote a letter to Hazrat Umar bin Abdul Aziz. In reply, he said that keep the woman with you.

Yunus reports that Hasan was asked: If a man marries a woman and consummates the marriage with her, and then later some illness becomes apparent, what is the ruling? He replied: The responsibility for this will be upon the man.

Hazrat Umar bin Abdul Aziz says that for a man, there is only the trust of kinship.

Ibrahim says that a free woman cannot be returned because of a defect.

Hazrat Sha'bi narrates that Hazrat Shurayh used to grant the compensation for hunting a phalbahri (a type of animal) belonging to a woman to a man.

Hazrat Mak'hool and Hazrat Zuhri state that if a man marries a woman, and then madness, leprosy, leukoderma, or a uterine disease appears in her, then the woman will be returned, and she will receive the prompt or deferred dower by which the man made her private parts lawful for himself. The responsibility for this dower will be upon the person who encouraged the man to marry.

Hazrat Ka'b bin Abdullah narrates that the Messenger of Allah (peace be upon him) married a woman from the Ghifar tribe. When he was about to consummate the marriage with her, he saw marks of leukoderma on her body. He said to her, "Put your clothes in order and return to your home."

Hazrat Abdullah says that a free woman will not be returned because of a defect.
