Can a Trustee Arrange a Marriage?

Hazrat Simak bin Harb narrates that Hazrat Shurayh declared the marriage contracted by a guardian (wasi) to be valid.

Hazrat Harith says that the guardian will consult the executor regarding conducting the marriage, and the guardian himself will supervise the marriage contract.

Hazrat Hammad says that if a guardian marries off an orphan girl under his care, it is permissible.

Hasan says that if a guardian arranges a marriage, it is permissible.

Hazrat Sha'bi and Ibrahim state that every action of the guardian is permissible except for marriage.

16981 - (W) (1) From al-Hakam and Hammad from Ibrahim (they said) (2): Whatever the executor does is permissible except marriage.

Hasan did not allow a guardian by will (wasi) to give permission for marriage, except if the one appointing the wasi says, "You are the guardian (wasi) for the marriages of my sisters and my daughters." If he does so, then the wasi is more entitled than the wali (legal guardian) in the matter of marriage. If this is not said, then the wali is more entitled than the wasi.
