Musannaf Ibn Abi Shaybah 24809 — Two men who deposit something

It is narrated from Zadhan that two men deposited a trust with a woman and said to her: "Do not give it to either of us unless we both come together." Then they both went away and were absent. Some time later one of them came and said to the woman: "Hand over my trust to me; my friend has died." The woman refused, until his visits to her became very frequent, and then she handed it over to him. Some time later the other came and said: "Hand over my trust to me." The woman said: "Your friend came and said that you had died, and he took your trust from me." The two of them took the dispute to Sayyiduna Umar (may Allah be pleased with him). When they had told Sayyiduna Umar (may Allah be pleased with him) the whole story, Sayyiduna Umar (may Allah be pleased with him) said to the woman: "I can only see that you are liable." The woman said: "O Commander of the Believers! Appoint Sayyiduna Ali (may Allah be pleased with him) as arbitrator between us." Sayyiduna Umar (may Allah be pleased with him) said to Sayyiduna Ali (may Allah be pleased with him): "Judge between them." Sayyiduna Ali (may Allah be pleased with him) said: "This trust is with me, and you both instructed this woman not to give it to either of you until you both came together. So first bring your other companion." He did not hold the woman liable. The narrator says: The people thought that the two men had intended to make off with the woman's wealth.
