حَدَّثَنَا مُعَاذُ بْنُ الْمُثَنَّى، ثنا عَلِيُّ بْنُ الْمَدِينِيِّ، ثنا أَبُو دَاوُدَ الطَّيَالِسِيُّ، حَدَّثَنِي يَعْقُوبُ بْنُ مُحَمَّدٍ، عَنْ نُجَيْدِ بْنِ عِمْرَانَ بْنِ الْحُصَيْنِ، حَدَّثَنِي أَبِي مُحَمَّدِ بْنِ نُجَيْدٍ، عَنْ أَبِيهِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ قَالَ: لَمَّا كَانَ يَوْمُ الْفَتْحِ قَتَلَتْ خُزَاعَةُ رَجُلًا مِنْ قُرَيْشٍ يُقَالُ لَهُ الْحَارِثُ، فَأَتَيْتُ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرْتُهُ، فَقَالَ: «أَقَبْلَ النَّهْيِ قَتَلُوهُ أَوْ بَعْدُ؟» فَقَالُوا: بَلْ بَعْدُ، قَالَ: فَأَتَيْنَا النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرْنَاهُ، فَعَقَلْنَاهُ، فَكَانَ أَوَّلَ عَقْلٍ كَانَ فِي الْإِسْلَامِ
Sayyiduna Imran bin Husayn (may Allah be pleased with him) said: On the day of the Conquest of Makkah, Khuza'ah killed a man from Quraysh called al-Harith. I came to the Prophet (peace and blessings be upon him) and informed him. He (peace and blessings be upon him) said: "Did they kill him before the prohibition or after?" People said: "Rather, after." Then we came to the Prophet (peace and blessings be upon him) and informed him, and we paid his blood money (diyah), and it was the first blood money in Islam.
حَدَّثَنَا مُحَمَّدُ بْنُ شُعَيْبٍ الْأَصْبَهَانِيُّ، ثنا حَفْصُ بْنُ عُمَرَ الْمَهْرِقَانِيُّ، ثنا مُسْلِمُ بْنُ قُتَيْبَةَ، حَدَّثَنِي يَعْقُوبُ بْنُ عَبْدِ اللهِ بْنِ نُجَيْدِ بْنِ عِمْرَانَ بْنِ حُصَيْنٍ، عَنْ أَبِيهِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ قَالَ: قَتَلَ رَجُلٌ مِنْ هُذَيْلٍ رَجُلًا مِنْ خُزَاعَةَ فِي الْجَاهِلِيَّةِ، فَكَانَ الهدلي مُتَوَارِيًا، فَلَمَّا كَانَ يَوْمُ الْفَتْحِ وَظَهَرَ النِّدَاءُ ظَهْرَ، فَلَقِيَهُ رَجُلٌ مِنْ خُزَاعَةَ فَذَبَحَهُ كَمَا تُذْبَحُ الشَّاةُ، فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «قَتَلَهُ قَبْلَ النِّدَاءِ أَوْ بَعْدَ النِّدَاءِ؟» قَالُوا: قَتَلَهُ بَعْدَ النِّدَاءِ، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «لَوْ كُنْتُ قَاتِلًا مُؤْمِنًا بِكَافِرٍ لَقَتَلْتُهُ بِهِ، وَلَكِنْ أَخْرِجُوا عَقْلِهِ» فَأَخْرَجُوا عَقْلِهِ فَبَدَأَ أَوَّلُ عَقْلٍ كان فِي الْإِسْلَامِ
Sayyiduna Imran bin Husayn (may Allah be pleased with him) said: In the time of Ignorance (Jahiliyyah), a man from the tribe of Hudhayl killed a man from the tribe of Khuza'ah, and that Hudhali remained in hiding. Then when the day of the Conquest of Makkah came and the announcement was made, he came out into the open. A man from Khuza'ah met him and slaughtered him as a sheep is slaughtered. The matter reached the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Did he kill him before the announcement or after the announcement?" People said: "He killed him after the announcement." The Prophet (peace and blessings be upon him) said: "If I were to kill a believer in retaliation for a disbeliever, I would have killed him for him; but pay his blood money." So they paid his blood money, and it was the first blood money in Islam.
